CALL TO ORDER:

recording of the meeting can be attributed to you. Completion of this form is not

CONSENT CALENDAR:
All matters listed under the Consent Calendar are considered routine and will be
enacted by one motion. There will be no separate discussion of these items prior
to the time of the voting on the motion unless members of the Commission, staff,
or public request specific items to be discussed and/or removed from the
Consent Calendar for separate action.
1. APPROVAL OF MINUTES – SEPTEMBER 11, 2012, PLANNING
COMMISSION.
RECOMMENDATION:
That the Planning Commission approve the minutes of the September 11, 2012,
meeting as provided.
Any writings or documents provided to a majority of the Planning Commission regarding any item on this
agenda will be made available for public inspection in the Community Development Department located at
300 Centennial Way, Tustin, California, during normal business hours.
In compliance with the Americans With Disabilities Act, if you need special assistance to participate
in this meeting, please contact the office of the City Clerk at (714) 573-3025. Notification 72 hours
prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to
this meeting.

PUBLIC HEARINGS:
2. DEVELOPMENT AGREEMENT (DA) 2012-001, DESIGN REVIEW (DR) 2012-
004, CONCEPT PLAN (CP) 2012-002, DENSITY TRANSFER, DENSITY
BONUS, CONCESSIONS OR INCENTIVES AUTHORIZED UNDER TUSTIN
CITY CODE SECTION 9123 RELATED TO THE PROVISION OF
AFFORDABLE HOUSING UNITS IN COMPLIANCE WITH CALIFORNIA
GOVERNMENT CODE SECTION 65915(1), AND PARCEL MAP (PM) 2012-
136.
The request is for DA 2012-001, CP 2012-002, DR 2012-004, Density Transfer,
Density Bonus, concessions or incentives authorized under Tustin City Code
Section 9123 related to the provision of affordable housing units in compliance
with California Government Code Section 65915(1), and PM 2012-136,
required for proposed development of Tustin Legacy Disposition Package 2A
which includes 37 moderate income units and 496 market rate units for a total
of 533 residential apartment units.

LOCATION: Tustin Legacy Disposition Package 2A bounded by future
Warner Avenue on the north, future Park Avenue on the
south, and existing Tustin Ranch Road on the east.
RECOMMENDATION:
City staff and the applicant have not yet completed the Disposition and
Development Agreement (DDA) that involves the sale of the land that is the
subject of the proposed applications. However, completion of the DDA is
considered imminent. Therefore, staff is requesting that the Planning
Commission continue the public hearing to the October 9, 2012, Planning
Commission meeting.

The request is for DA 2012-002, CP 2012-003, DR 2012-005, Density Transfer,
Density Bonus, and concessions or incentives authorized under Tustin City Code

RECOMMENDATION:

REGULAR BUSINESS:
4. WORKSHOP - AMENDMENT OF FIRST STREET SPECIFIC PLAN.
Members of the Planning Commission and staff have expressed a concern that
the First Street Specific Plan is outdated, but an update has not been pursued
due to budget constraints. On January 25 and March 22, 2011, the Planning
Commission held workshops on the First Street Specific Plan. At that time, the
staff presentation indicated that although a comprehensive revision of the
Specific Plan is not within the current City budget, there are measures and
updates that can and should be pursued using in-house resources. As a result,
the Planning Commission directed staff to pursue a modification of the First
Street Specific Plan using available staff resources, as time permits. On July
24, 2012, the preliminary draft First Street Specific Plan was distributed to the
Planning Commission as information in anticipation of a formal workshop and
presentation on the matter by staff.

ENVIRONMENTAL ANALYSIS - DRAFT NEGATIVE DECLARATION
The California Environmental Quality Act requires an analysis of a project’s
potential impacts prior to formal consideration by the appointed decision maker.
Consistent with CEQA, a Negative Declaration has been prepared in support of
the proposed amendment of the First Street Specific Plan and associated
amendment of the General Plan. The proposed GPA 2012-01 and SPA 2012-
01 are considered a “project” subject to the terms of the California
Environmental Quality Act (“CEQA”). An Initial Study and findings for a
proposed Negative Declaration have been prepared regarding this project for
consideration and recommendation by the Planning Commission. In
compliance with the State CEQA Guidelines, the Initial Study and Draft
Negative Declaration was made available for a 20-day public review and
comment period from September 27, 2012, through October 23, 2012. A Notice
of Intent to adopt a Negative Declaration will be prepared for subsequent City
Council consideration since the City Council is the final approval authority for
the project.
RECOMMENDATION:
Conduct a workshop on the proposed amendment of the First Street Specific
Plan. The item is tentatively scheduled for formal hearing by the Planning
Commission at the regular meeting of October 23, 2012, when all discretionary
actions necessary to implement the update, including any required General
Plan Amendment, Zone Change, and necessary environmental documents will
be considered.
