Home My WebLink AboutORD 135 (1960)ORDINANCE NO. 135 AN ORDINANCE OF THE CITY OF TUSTIN APPROVING THE ANNEXATION TO THE CITY - OF TUSTIN OF CERTAIN INHABITED TERRITORY DESIGNATED AS "YORBA STREET ANNEXATION" �.T1?EREAS, pursuant to the provisions of the Annexation Act of 1913,, and pursuant to Ordinance No. 132 adopted by the City Council of the City of Tustin on the 25th day of February, 1960, a, special election was held on the 26th day of April, 1960, in inhabited territory contiguous to the City of Tustin designated as "Yorba Street Annexation" and which is hereinafter more particularly de- scribed; and WHEREAS, at said special election the following question was submitted to the qualified electors residing in said territory: SHALL "YORBA STREET ANNEXATION" BE ANNEXED TO THE CITY OF TUSTIN? WHEREAS, it appears from the canvass of the returns of the votes cast at the special election that a majority of all votes cast in said territory on the question of annexation favor annex- ation; and WHEREAS, it appears that the special election and all pro- ceedings relating thereto have been conducted strictly in accordance with law; WHEREAS, in accordance with the provisions of Ordinance No. 105 of the City of Tustin, the Planning Commission and the City Council have duly held public hearings and received a report from the City Engineer, and said Planning Commission and the City Council have recommended certain zoning and building line set back require- ments to be established in the territory upon annexation of said territory to the City of Tustin; follows: NOW THEREFORE the People of the City of Tustin do ordain as 1. That the annexation of inhabited territory contiguous to the City of Tustin designated as -""Yorba. Street Annexation" be and the same hereby is approved upon the terms contained in the afore- said question which was submitted at the special election held on the 26th day of April, 1960. Said territory is described as follows: 6 Beginning at the Northwest corner of Block "A" as shown on a map of Tract No. 396, recorded in Book 16, on Page 10, Miscellaneous Maps, records of Orange County, California, said point of beginning being in the exterior boundary line of the City of Tustin. Thence Westerly along the Westerly prolongation of the Northerly line of said Block "A",; forty feet (40 feet) to the Easterly line of the Felipe Yorba Tract as shown on a map recorded in Book 4, Page 206, Miscellaneous Records of Los Angeles County, California, said Easterly line of Felipe Yorba Tract, also being the Westerly right of way line of Yorba Street, forty feet in width. Thence Northerly along the Easterly line of said Felipe Yorba Tract, 4366.97 feet a little more or less, to a point 52 feet Southerly, measured at right angles from the surveyed center line of Seventeenth Street (17th St.), said point being an angle point in the boundary line of the City of Santa Ana. Thence continuing Northerly seven (7) feet to a point 45 feet Southerly, measured at right angles from said surveyed center line of Seventeenth (17) Street. Thence Easterly, parallel to said surveyed center line, 340.00 feet, a little more or less to the Southerly prolongation of the Westerly line of the Easterly one-half of Lot 14 in Block "B", A. B. Chapman Tract as per map filed in the office of the County Recorder, Orange County, California. Thence Northerly along said Southerly prolongation and continuing along said Westerly line to the Northwest corner of the East one-h4alf.:o ThenEasterly, along the North line of said Lot 14 in Block B",F,-05.5 feet a little rnore or less to a line drawn parallel withnd 205 feet Easterly r;asured at right angles from said destely line of the East or -half; and passing through sr;.id. That the zones defined by Ordinance No. 71 of the City of Tust„in as amended and the.b'15�zndaries of said zones and the building line all within the subject territory known as "Yorba Street Ann ation” are shown on a!m p attached hereto market Exhibit "A" f. i and made a part of this ordinance, being designated as the "Zoning Classification and Building Line Requirements for "Yorba Street Annexation" to the City of Tustin", and said map and all the notations, references and other information shown thereon shall be made a part of this ordinance as if the materials and information set forth _ on said map were fully described herein. 3. The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in The Tustin News, a newspaper of general circulation, printed, published and circulated in the City of Tustin, County of Orange, State of California. PASSED AND ADOPTED by the City Council of the City of Tustin at a regular adjourned meeting held on the 9th day of May, 1960.
