On September 4, 2012, the City Clerk received an appeal of UD 2012-03 and CUP 2012-09 which was filed by Tustin City Councilmember Gavello. Ej The appeal identified location of the proposed business as a concern. Pursuant to Tustin City Code Section 9294b, the appeal hearing before the City Council is de novo. Site Location �M W 9 First Street Specific Plan (FSSP) zoning district Commercial as a primary use Planned Community Commercial/Business General Plan Land Use Designation Surrounding uses include commercial uses with resta u ra nt, retail and office. There is an apartment complex to the west of the subject property. Use Determination 2012-03 k.A Retail stores selling new and previously used goods and clothing with ancillary donation areas are not a listed use within the FSSP. Ej The City has required CUP's in the past for retail stores with secondhand sales (thrift stores) and donation areas in other commercial zoning districts. Due to the nature of the proposed use, a CUP would be necessary to ensure that the use would operate free of nuisances. The City Council must decide if the proposed use would be permitted, conditionally permitted or prohibited. Conditional Use Permit 2012-09 ©5 ❑ Primary use is a retail store with ancillary donation area. ❑ Existing 11,000 s.f. tenant space with 8,180 s.f. retail area and 1,920 s.f. donation area. Threads boutique concept based on T.J. Maxx, Ross, and Nordstrom Rack stores. New merchandise will comprise 20% of store sales. ❑ Hours of operation from 9:00 a.m. to 9:00 p.m. daily. Donation Area oL. ❑ New 8' by 10' roll -up door located at the rear of the building provides access and serves as collection point. Trained employee to staff the donation area during all hours of operation. ❑ No outdoor storage permitted and all donations to be brought into the store. ❑ No donations including drop-offs permitted during non -business hours. Approval of CUP 2012-09 serves as a precitation notice, any violations may result in fines via an administrative citation. ❑ All donations are transferred to a regional facility for processing and distribution. Proposed location is in Larwin Square shopping center with over 200,000 square feet of retail uses. ❑ Proposed use is consistent with similar conditionally permitted uses in commercially zoned districts. ❑ The primary use of retail sales is permitted in commercial zoning districts. ❑ The donation component is to be ancillary to the primary retail sales. ❑ Numerous retail businesses within the City that buy and sell used goods Recommendation That the City Council: Adopt Resolution No. 12-85, approving Use Determination 2012-03 to allow retail stores selling new and previously used goods and clothing with ancillary donation areas as a conditionally permitted use within the commercial land use designations of the First Street Specific Plan. Adopt Resolution No. 12-86, approving Conditional Use Permit 2012-09 to establish a Goodwill retail store selling new and previously used goods and clothing with ancillary donation area located at 502 E.
