Binsack, Zoning Administrator PUBLIC CONCERNS: None. CONSENT CALENDAR: None. No Items on Consent Calendar PUBLIC HEARING: 1. DESIGN REVIEW 2012-003 AND VARIANCE 2012-001 – to construct a new 2,244 square foot, 2-story retail and office structure with eight (8) on-site parking stalls at 155 W. First Street. APPLICANT: RICHARD J RENGEL RENGEL+COMPANY, ARCHITECTS 333 EL CAMINO REAL TUSTIN, CA 92780 PROPERTY OWNER: GERSAIN BUSTOS GROWER’S DIRECT FLOWERS 1169 IRVINE BLVD TUSTIN, CA 92780 ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO SECTION 15332 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. Zoning Administrator Action Agenda October 4, 2012 Page 2 RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action 12-005 approving Design Review 2012-003 (DR 2012-003) to construct a new 2,244 square foot, 2-story retail and office structure with 8 on-site parking stalls and Variance 2012-001 (VAR 2012-001) for a 20% reduction in on- site parking at 155 W. First Street. The meeting opened at 10:33 a.m. The Zoning Administrator gave the roll call and introduced herself. Amy Stonich gave the presentation for DR 2012-003 and VAR 2012-001. The Zoning Administrator asked Mr. Rengel if he and the property owner had reviewed and understood the conditions of approval, and if they had any questions regarding the conditions. The Zoning Administrator opened the public hearing. The project applicant, Richard Rengal, spoke representing the property owner. Mr. Rengel stated that he and the property owner read the conditions of approval and had no problems with the conditions. He stated he was available to respond to questions as needed. Arnold Surfas spoke in opposition to the project proposal. Mr. Surfas is a neighboring business owner, and stated overflow parking from the proposed project may impact his business parking. He also did not believe that the proposed two-story building is compatible with the area. The Zoning Administrator closed the public hearing. Amy Stonich responded that the number of parking stalls for the proposed project has been maximized to the greatest extent possible. She additionally commented that the building height is compatible, due to the second floor being used as office space. The Acting Zoning Administrator approved Zoning Administrator Action No. 2012-005, approving Design Review 2012-003 and Variance 2012-001. The meeting adjourned at 10:43 a.m. REGULAR BUSINESS: None.
