APPROVAL OF MINUTES – SEPTEMBER 11, 2012, PLANNING COMMISSION. RECOMMENDATION: That the Planning Commission approve the minutes of the September 11, 2012, meeting as provided. Motion: It was moved by Thompson, seconded by Kozak, to move the consent calendar. Motion carried 4-0. DEVELOPMENT AGREEMENT (DA) 2012-001, DESIGN Commission meeting of REVIEW (DR) 2012-004, CONCEPT PLAN (CP) 2012-002, October 9, 2012 DENSITY TRANSFER, DENSITY BONUS, CONCESSIONS OR INCENTIVES AUTHORIZED UNDER TUSTIN CITY CODE SECTION 9123 RELATED TO THE PROVISION OF AFFORDABLE HOUSING UNITS IN COMPLIANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65915(1), AND PARCEL MAP (PM) 2012-136. The request is for DA 2012-001, CP 2012-002, DR 2012-004, Density Transfer, Density Bonus, concessions or incentives authorized under Tustin City Code Section 9123 related to the provision of affordable housing units in compliance with California Government Code Section 65915(1), and PM 2012-136, required for proposed development of Tustin Legacy Disposition Package 2A which includes 37 moderate income units and 496 market rate units for a total of 533 residential apartment units. APPLICANT: The Irvine Company, LLC 550 Newport Center Drive Newport Beach, CA 92660 PROPERTY OWNER: City of Tustin LOCATION: Tustin Legacy Disposition Package 2A bounded by future Warner Avenue on the north, future Park Avenue on the south, and existing Tustin Ranch Road on the east. RECOMMENDATION: City staff and the applicant have not yet completed the Disposition and Development Agreement (DDA) that involves the sale of the land that is the subject of the proposed applications. However, completion of the DDA is considered imminent. Therefore, staff is requesting that the Planning Commission continue the public hearing to the October 9, 2012, Planning Commission meeting. Chair Kozak requested a brief presentation from staff regarding both public hearing items for clarity purposes. Minutes – Planning Commission September 25, 2012 – Page 2 of 7 The Director stated the items were placed on the agenda because they were given a public notice in the newspaper; however, the projects are not considered complete at this time. Both projects require a disposition and development agreement to be executed which involves the sale of land from the city. Requested that the Planning Commission continue the item to a date certain. Commissioner Moore inquired regarding which elements of the disposition and development agreement and entire entitlement package would be heard and decided upon by the Planning Commission. Motion: It was moved by Eckman, seconded by Moore, to continue the item to the Planning Commission’s regularly scheduled meeting of October 9, 2012. Motion carried 4-0. Continued to the Planning 3. The request is for DA 2012-002, CP 2012-003, DR 2012-005, Density Transfer, Density Bonus, and concessions or incentives authorized under Tustin City Code Section 9123 related to the provision of affordable housing units in compliance with California Government Code Section 65915(1) required for proposed development of Tustin Legacy Disposition Package 1A-North which includes 225 affordable multi-family residential apartment homes. REGULAR BUSINESS: Heard and tentatively 4. WORKSHOP - AMENDMENT OF FIRST STREET SPECIFIC scheduled for a PLAN. public hearing on October 23, 2012 Members of the Planning Commission and staff have expressed a concern that the First Street Specific Plan is outdated, but an update has not been pursued due to budget constraints. On January 25 and March 22, 2011, the Planning Commission held workshops on the First Street Specific Plan. At that time, the staff presentation indicated that although a comprehensive revision of the Specific Plan is not within the current City budget, there are measures and updates that can and should be pursued using in-house resources. As a result, the Planning Commission directed staff to pursue a modification of the First Street Specific Plan using available staff resources, as time permits. On July 24, 2012, the preliminary draft First Street Specific Plan was distributed to the Planning Commission as information in anticipation of a formal workshop and presentation on the matter by staff. ENVIRONMENTAL ANALYSIS - DRAFT NEGATIVE DECLARATION: The California Environmental Quality Act requires an analysis of a project’s potential impacts prior to formal consideration by the appointed decision maker. Consistent with CEQA, a Negative Declaration has been prepared in support of the proposed amendment of the First Street Specific Plan and associated amendment of the General Plan. The proposed GPA 2012-01 and SPA 2012-01 are considered a “project” subject to the terms of the California Environmental Quality Minutes – Planning Commission September 25, 2012 – Page 4 of 7 Act (“CEQA”). An Initial Study and findings for a proposed Negative Declaration have been prepared regarding this project for consideration and recommendation by the Planning Commission. In compliance with the State CEQA Guidelines, the Initial Study and Draft Negative Declaration was made available for a 20-day public review and comment period from September 27, 2012, through October 23, 2012. A Notice of Intent to adopt a Negative Declaration will be prepared for subsequent City Council consideration since the City Council is the final approval authority for the project. RECOMMENDATION: Conduct a workshop on the proposed amendment of the First Street Specific Plan. The item is tentatively scheduled for formal hearing by the Planning Commission at the regular meeting of October 23, 2012, when all discretionary actions necessary to implement the update, including any required General Plan Amendment, Zone Change, and necessary environmental documents will be considered. Ogdon & Reekstin Gave a presentation of the item. Planning Commission questions included: feedback from prior workshops; incentives to promote new businesses in the area; implementing a parking in-lieu fee Ordinance similar to the one established in Old Town; the general effect of the zone change on the property owners; auto-related uses becoming nonconforming or conforming after the implementation of the FSSP; removal of the expansion areas and permitted uses in these areas; prior code enforcement action along First Street; redevelopment of auto-related uses; and opportunities for mixed-use buildings. Chair Kozak invited members of the audience forward for public input. The following members of the public stepped forward to speak: Randy Rock Richard J. Rengel Gwen Masters Mr. Rock, a resident of Palmwood Community, came to the lectern. He stated he fully supports the reunification of the Palmwood Community as a residential zone. Would love to have First Street become a continuum of Old Town Tustin. Mr. Rengel, of Rengle+Company Architects, stepped forward. Minutes – Planning Commission September 25, 2012 – Page 5 of 7 Stated he is currently working on a project on First Street, and has encountered issues with parking due to the small lot size. Would like the Commission and staff to explore parking options similar to the Parking Exception Ordinance implemented in Old Town Tustin. Inquired regarding a bicycle circulation plan and suggested creating bike lanes along First Street. Ms. Masters, a business owner on First Street, stepped forward. She inquired whether the requirements for parking and signage would change for current businesses after implementation of the First Street Specific Plan. Chair Kozak brought the item back to the Commission for discussion. Thompson Appreciated how staff addressed concerns regarding the integration of historic homes into First Street, the connecting of residential to retail establishments, and eliminating the “hop-scotch” pattern of the plan. Agreed with public comments that the continuum of Old Town Tustin onto First Street would be positive, and that it would be complimentary to evaluate the bike-lane circulation plan along with the on-street parking plan. Suggested establishing a timeline prioritizing the immediate versus long-term updates to the First Street Specific Plan. Eckman Agreed with Commissioner Thompson’s comments and stated he is in support of the updates to the First Street Specific Plan Moore Stated that it is beneficial to focus on the long-term goals of the Specific Plan to not lose sight of the bigger picture. Appreciated the public’s input on the item. Kozak Agreed with the comments of his fellow Commissioners in that creating a timeline for the immediate and future plans for First Street is an excellent idea. Thanked staff for their work on the project. No formal motion was taken, and the item was tentatively set for a public hearing on October 23, 2012. STAFF CONCERNS: The Director reported as follows:  At the October 2, 2012, City Council meeting, the Council will consider the Planning Commission’s recommendation on the Red Hill Lutheran General Plan Amendment/Conditional Use Permit/Zone Change; Minutes – Planning Commission September 25, 2012 – Page 6 of 7  The Council will also consider the appeal of the Goodwill Industries application. COMMISSION CONCERNS: Eckman  Had no items to report on this evening. Moore  Reminded the audience that Tustin Tiller Days is approaching;  Encouraged increased public participation at future Planning Commission meetings. Thompson  Attended an OCTA Citizens Advisory Committee meeting for the Bicycle and Pedestrian Subcommittee. Reported that OCTA is completing a master plan of all Metrolink Stations in Orange County, and requested public input on improving circulation;  Is looking forward to the Tustin Tiller Days Parade;  Reminded the audience about the upcoming Old Town Tustin Art Walk, and stated he will be conducting tours of Old Town at the event as well. Kozak  Attended a California Preservation Foundation webinar earlier that day, thanked staff for the opportunity to attend;  Attended Mayor Nielsen’s Town Hall meeting. Stated many great questions were asked, and staff is working on coordinating responses;  Stated the soccer field at Hillview High School was recently dedicated as Barry Turner Field. Barry Turner was a math teacher at Hillview for 20 years, and a soccer coach at Foothill High School for 23 years until last year when his Lou Gehrig’s disease progressed to the point where he could no longer participate in coaching. Added that a plaque was also unveiled in his honor at the dedication of the field. 8:15 p.m. ADJOURNMENT: The next regular meeting of the Planning Commission is scheduled for Tuesday, October 9, 2012, at 7:00 p.m. in the City Council Chamber at 300 Centennial Way.
