SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE FRONTIER PARK
FITNESS ELEMENT (CIP NO. 20068)
SUMMARY:
The Frontier Park Fitness Element has been completed and the project is ready for
acceptance and filing of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 12 -89 accepting the Frontier Park Fitness Element (CIP
No. 20068), and
2. Authorize the City Clerk to file the Notice of Completion with the County
Recorder's office.
FISCAL IMPACT:
The Frontier Park Fitness Element is funded with Community Development Block Grant
(CDBG) dollars as part of the 2012 -2013 Capital Improvement Program. The final cost of
the project was $76,309.47.
BACKGROUND:
Over the last several years the area around the handball walls at Frontier Park (1400
Mitchell Avenue) has seen an increase in illicit activities, thus making the park less
desirable for local residents. To address this issue and make the park more useable for
the surrounding community, the idea of changing the facility to encourage healthier
activities was identified. Outdoor fitness equipment provides a suitable option that can
be easily installed with a minimum amount of impact on the park. This type of
equipment offers options for various upper and lower body exercises utilizing the users
own body weight as resistance. A total of fourteen (14) different fitness pieces will be
installed as well as an instructional sign. Examples of the proposed equipment are
attached.

The Community Services Commission has identified the installation of the fitness
element at Frontier Park as the next project to be completed on their seven -year CIP
priority list.
The project was completed on October 1, 2012. The City has retained 10% of the contract
amount, which will b rele sed no sooner than 35 days after the recordation of the Notice
of/ ornpletion with t� Cd�nty Recorder's Office.

RESOLUTION NO. 12 -89
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE FRONTIER PARK FITNESS ELEMENT (CIP
NO. 20068)
WHEREAS, Micon Construction Inc., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the Project Manager has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
work and improvement should be filed and payment of the balance due said contractor
authorized in accordance with the contract documents;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement be accepted, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:

CIP No. 20068
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 16th day of October 2012.
