ITEM # 4 GENDA REPORT MEETING DATE: OCTOBER 23, 2012 TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: SUMMARY OF PROJECTS RECOMMENDATION: That the Planning Commission receive and file this item. DISCUSSION: The following is a list of projects and activities since the Summary of Projects report provided at the July 24, 2012, Planning Commission meeting. The list focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificates of Appropriateness; Code Enforcement activities; and, other items of interest. • The Lost Bean Coffee & Tea (13011 Newport Avenue): The coffee shop at Plaza Lafayette is expanding to an adjacent suite. Plans have been submitted for plan check. • 24 Hour Convenience Store (13842 Newport Avenue): The Planning Commission approved Conditional Use Permit 2011-16 to establish and operate a 24-hour 7 -Eleven convenience store located at 13842 Newport Avenue. The location is now open for business. • Nunos Brothers Retail Building (15761 Tustin Village Way): The project involves reconstruction of a 15,000 square foot retail center to replace a former retail center that was destroyed by fire. The exterior of the building is at partial color coat stage and the interior is still awaiting tenant improvements. Planning Commission Report Summary of Projects October 23, 2012 Page 2 • Granada Plaza (17291 Irvine Blvd.): Reconstruction of the burned -down, two-story office building at Irvine Boulevard and Yorba Street is currently at the stucco stage and the interior has been drywalled. The parking lot is complete; however, the courtyard and elevator are currently in progress. The project is approaching final completion. • Groundwater Remediation (535 E. Main Street): The Zoning Administrator approved Conditional Use Permit 2011-18 to allow temporary groundwater remediation activities for a period of two (2) years. The groundwater remediation equipment is installed and is currently operating. • Old Town Mixed -Use Building (170 EI Camino Real): Conditional Use Permit 07- 014 and Design Review 07-015 were approved for the construction of a three-story mixed-use building, including commercial, office and residential uses. Tenant improvements are currently underway to open a beauty salon on the first floor of the building. • Vintage Lady (434 EI Camino Real): Plans to rebuild the burned retail building have been submitted for plan check. • First Street Specific Plan: Staff is working with the Planning Commission to update the First Street Specific Plan district regulations. The project has been set for a public hearing before the Planning Commission on October 23, 2012. • 195 EI Camino Real (former Riteway Cleaners): A new mixed-use proposal consisting of offices, a jewelry shop, and a coffee shop, was approved by the Planning Commission on May 8, 2012. Plans have been submitted for plan check. Planning Commission Report Summary of Projects October 23, 2012 Page 3 • Mixed-use Hotel Project (Southwest corner of Newport Avenue & Edinger Avenue.): On April 10, 2012, the Planning Commission approved a request to develop a mixed use project on a property located at the southwest corner of Edinger Avenue and Newport Avenue intersection. The project includes 1) a 149 - room Residence Inn; 2) 144 -room Fairfield Inn and Suites; 3) an 8,885 square foot restaurant; 4) a 7,295 square foot retail building; and 5) a conditional use permit for a master sign program and joint use parking. Grading permits have been issued for Marriott Residence Inn and Fairfield Inn. Construction plans are in plan check and the site is currently being graded. • Goodwill Industries of Orange County (502 E. First Street): The Planning Commission considered and approved a request to operate a retail store selling new and used merchandise and clothing with an ancillary donation area within an existing tenant space. This project was appealed and subsequently approved by City Council on October 2, 2012. • Conditional Use Permit 2012-04 (17542 17th Street, Suite 200): On May 9, 2012, the Zoning Administrator approved a request to operate an instructional school use (Springfield College) with a maximum 200 students in an existing 14,919 square feet office tenant space. The tenant improvement permit has been issued. • Conditional Use Permit 2011-20 (1022-1112 Walnut Avenue & 14510-14520 Newport Avenue): On May 14, 2012, the Zoning Administrator approved a request to establish and operate a recycling facility (bulk vending machine) in conjunction with the existing R -Ranch Market located in Park Lane Plaza. Plans have been submitted for plan check. Planning Commission Report Summary of Projects October 23, 2012 Page 4 • Archie's Ice Cream (12932 Newport Avenue): Tenant Improvements for Archie's Ice Cream next to Trader Joe's on Newport Avenue and Irvine Boulevard are have been completed. The location is now open for business. • Famous Footwear (2821 EI Camino Real): A new shoe store is now open for business in the Market Place. • Capriotti's Sandwich Shop (2487 Park Avenue): A new sandwich shop is now open in The District lifestyle area. • Red Robin (2667 Park Avenue): A Red Robin restaurant is now open in The District in the former location of Marmalade Cafe. • Lunna Rossa Ristorante (2449 Park Avenue): An Italian restaurant is now open in The District lifestyle area in the former Chaparosa Grill location. • Flame Broiler (2419 Park Avenue): A new Flame Broiler restaurant will be opening at the District. This project is currently in plan check. Planning Commission Report Summary of Projects October 23, 2012 Page 5 • Tutoring Center (3057 Edinger Avenue): A new request has been received to establish a tutoring center in an existing 4,600 square foot tenant space located within Jamboree Plaza. The entitlement package is currently under review. • Commercial Design Guidelines: Draft Design Guidelines are in progress and are anticipated to be complete within the next few months. The Commercial Design Guidelines would provide property owners and developers with information related to: Tustin's historic commercial building styles, preservation and rehabilitation guidelines, siting, design, and architecture for additions and new infill development, landscaping, and signage. City of Tustin DRAFT CULTURAL RESOURCES DISTRICT COMMERCIAL DESIGN GUIDELINES ;MORE. rig, .... • Red Hill Lutheran Church (13152, 13162, and 13232 Red Hill Avenue and 1532, 1542, 1552 and 1562 Melvin Way): The Planning Commission recommended approval of General Plan Amendment 2012-002, Zone Change 2012-001, and Conditional Use Permit 2012-08 to the City Council. The City Council subsequently approved the project on October 16, 2012. This approval allows for converting existing residences adjacent to the church into parsonages for church members, permitting a storage area, and a youth center. • Wilcox Manor (310 S. Pasadena Avenue): The Planning Commission recommended approval to City Council for Conditional Use Permit 2012-10 to allow a total of 24 outdoor events per year. This project is scheduled for a public hearing before City Council on November 6, 2012. • Kiddie Academy Daycare (14501 Newport Avenue): A new request has been received for a new 6,300 square foot daycare facility including an amendment of parking requirements for daycare facilities. The request for entitlement is under review. Planning Commission Report Summary of Projects October 23, 2012 Page 6 • Kaku Casual Bistro (1150 Irvine Blvd.): On August 28, 2012, the Planning Commission approved a request to locate a new restaurant with alcoholic beverage sales. Kaku Casual Bistro will be located adjacent to Cafe Rio in the Tustin Heights Center. This project is currently in plan check. • Tentative Parcel Map, Subdivision, and Conditional Use Permit (15621, 15641, and 15661 Red Hill Avenue): A new request has been received to subdivide an existing office complex into two (2) parcels and establish Joint Use Parking among three parcels. The request for entitlement is under review. • 435 W. 6t" Street: A new request for a garage remodel has been submitted; however, the submitted plans are incomplete. Staff is working with the owner to obtain a complete submittal. • 125 W. Main Street: On July 17, 2012, the City Council approved a proposal for a mixed-use development including restaurant, office and residential uses. There has been no plan check submittal to date. • 13841 Red Hill Avenue: Entitlements for Design Review (DR) 10-018 and Conditional Use Permit (CUP) 10-009 for the construction of a 201 unit age - restricted (62 years or older) assisted/independent living facility on a 2.882 acre site expired on October 1, 2012 after numerous extensions had been granted. RFPs for certain development sites have been released. The following projects have been authorized by the City Council: o The Irvine Company Apartment Development (Legacy Disposition Package 2A): On October 9, 2012, the Planning Commission recommended approval to the City Council for the development of 533 residential apartment units. The project is scheduled for a public hearing before City Council on October 30, 2012. View of Front Elevation o St. Anton Partners Apartment Development (Legacy Disposition Package 1A -North): On October 9, 2012, the Planning Commission recommended approval to the City Council for the development of 225 affordable multi -family residential apartment units. The project is scheduled for a public hearing before City Council on October 30, 2012. Uri nit o Standard Pacific has been selected as the developer for the for -sale residential site 1B. Approximately 235 homes will be built at Disposition Parcel 1 B. o The City Council recently approved an Exclusive Agreement to Negotiate with the Regency for a commercial development at site 1 C located at the southeast corner of Kensington and Edinger Avenue. The following are updates related to each development: Mirabella: The development of 60 attached townhomes at the Mirabella site is underway. The project is on schedule to close out Phases 4 and 5 by the end of 2012 and Phase 6 by the end of February 2013. Augusta (formerly Astoria): The development of 64 detached single family homes is currently underway. The project is on schedule to close out the remaining phases by the end of 2012. • Columbus Grove: The last remaining development of Ainsley Park (84 duplex units) is complete. All units have been finaled and sold. • Fire Station 37 (Relocation): Design of Fire Station 37 has been completed. The bidding of the plans and specifications is underway, with the opening of bids scheduled for October 30, 2012. The project is expected to begin construction in January 2013 and to be completed by the end of 2013. Planning Commission Report Summary of Projects October 23, 2012 Page 9 • The District at Tustin Legacy: Vestar Development Company together with the U.S. Army Reserves are in the process of exchanging properties to accommodate a new parking area for the District at Tustin Legacy. B Unusual or distinctive buildings in terms of age and architecture. C Pre -1940 buildings with much of the original architectural style. D Pre -1940 buildings with substantial alteration or no significant architecture style. Non-contributing Buildings: Buildings that are located in the Cultural Resources District but do not fall under any of the above categories. Code Enforcement • Graffiti: There were 1,628 incidents from June 15, 2012 thru October 16, 2012. • Water Quality: Existing Development Inspections (NPDES Inspections): The new permit cycle (five- year cycle which may be extended to seven years) began July 1, 2010. There are currently 59 commercial and 43 industrial for a total of 102 inspections to be completed. All required inspections have been completed for this fiscal year. Water Quality Management Plans (WQMPs): There are currently 84 WQMPs on file. Twenty-five percent (25%) of the WQMPs on file must be inspected every year (21 inspections this year). • Administrative Citations: Ten citations were issued (6/30/12 — 9/30/12) for various violations such as water quality, unpermitted signage and unsafe housing conditions. Nine citations remain open and one has been closed. Public Improvements — Public Works Department Update • Newport Avenue Extension (CIP No. 70131): Dokken Engineering, the City's consultant, is currently addressing Orange County Flood Control District comments on the final design plans, with the objective of obtaining design approvals from the County. With the elimination of Redevelopment Agencies funding, the project will be on hold until alternate sources of funding are found. Planning Commission Report Summary of Projects October 23, 2012 Page 10 • Roadway Rehabilitation & Sidewalk Repair (CIP No. 70001): The FY 2011-2012 Roadway Rehabilitation (Street Maintenance) and Sidewalk Repair projects started in June 2012 and is scheduled to be completed this fall. The project included repaving and slurry sealing streets within and adjacent to the business park west of Red Hill Avenue, east of the SR 55 Freeway, south of Edinger Avenue, and north of Warner Avenue. It also included repaving the City Hall and Senior Center parking lots, and slurry sealing Main Street and various City parks. Design for the FY 2012- 2013 project is underway. • Rawlings Reservoir Replacement Project (CIP No. 60136): Phase I Demolition of the Reservoir was completed in September 2011. The Phase 11 Construction project was awarded to Pacific Hydrotech Corporation on March 6, 2012. The construction started mid April 2012. The Phase 11 construction is on schedule to be completed by October 2013. i 8 1 � F • Red Hill Avenue Rehabilitation between Valencia Avenue and Edinger Avenue (CIP No. 70212): Slurry sealing of Red Hill Avenue was performed in conjunction with CIP No. 70001. • Tustin Avenue Well (CIP No. 60150): Project design is nearly complete for the drilling of the Tustin Avenue Well at 1822 N. Tustin Avenue. Staff is working to secure the temporary construction easements required for the drilling and construction of the well. The drilling of the well (Phase I of the project) is tentatively scheduled to begin July 2013. Planning Commission Report Summary of Projects October 23, 2012 Page 11 • Tustin Ranch Road: Extension from Walnut Avenue to Warner Avenue Construction Project (CIP Nos. 70100, 70206, 70214, & 70215). Tustin Ranch Road Phase 1 consisting of grading, storm drain, and retaining wall work, is complete. The Phase 2 construction contract covering the remaining roadway improvements on Tustin Ranch Road, Valencia Avenue, Park Avenue, and Legacy Road including the Edinger Avenue/SCRRA/ Santa Ana -Santa Fe Flood control Channel Overpass, utilities installation, sound wall construction, and median landscaping on Tustin Ranch Road is under construction. Completion is scheduled for Spring/Summer 2013. • Traffic Signal Battery Backup Systems (BBS's), Phase I (CIP No. 40079) and Traffic Signal Controller Upgrades/ Replacements, Phase I (CIP No. 40080): The two projects were bid as one, and construction started in August 2012. The BBS project is the first of four phases, after which all City maintained traffic signals will be protected with battery backup systems. The Controller Upgrades / Replacement Project is the first of three phases aimed at providing dependable traffic signal operation. Design of the second phase of each project is almost completed. Planning Commission Report Summary of Projects October 23, 2012 Page 12 • Enderle Center Drive/Vandenberg Lane Intersection Enhancements (CIP 40078): Design is underway. Construction is tentatively scheduled for Spring/Summer 2013. The project is partially funded with State -Local Partnership Program (SLPP) Formula Grant funds through the Orange County Transportation Authority (OCTA). wr. PLANT MATERIAL PPpv06EP %.AHi PeyEiiF • Warner Avenue Storm Drain: Vestar awarded a contract to KEC Engineering for construction of the Phase 2 Warner Avenue storm drain from west of Jamboree Road to Peters Canyon Channel. The construction started May 2012 and will be completed by January 2013. • Robinson Drive/Keller Drive (CIP No. 40083) and Browning Avenue/Parkview Way (CIP No. 40084) Pedestrian Enhancements: Design of lighted crosswalks, signage, and sidewalk improvements at each location is almost complete. The projects will be constructed under a single contract which will be primarily funded with State legislated Safe Routes to School (SR2S) Grant Funds. • Edinger Avenue Well (CIP No. 60165): The construction of the Edinger Avenue Well CIP 60165 has been advanced to coordinate with the construction of the Residence Inn and the Fairfield Inn by RD Olson Company and to complete the drilling phase (Phase 1) of the project before the grand opening and occupancy of the hotels. Plans and Specifications are complete for the drilling phase of the project. The Phase I Drilling of the project is tentatively scheduled to begin mid January 2013. Construction is tentatively scheduled for spring/summer 2013. The project is partially funded with State -Local Partnership Program (SLPP) Formula Grant funds through the Orange County Transportation Authority (OCTA). • McFadden Avenue Rehabilitation (CIP 70213) and Irvine Blvd. Rehabilitation (CIP 70218): Design is underway on both projects. The projects will be bid together with construction tentatively scheduled for spring/summer 2013. The projects are partially funded with State -Local Partnership Program (SLPP) Formula Grant funds through the Orange County Transportation Authority (OCTA). Attachments: A.
