ORDINANCE NO. 125
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUSTIN AMENDING ORDINANCE NO. 71 OF THE CITY OF
TUSTIN AND AMENDING AND ESTABLISHING NEW BUILDING
LINE SETBACK REQUIREMENTS FOR CERTAIN PROPERTY IN
THE CITY OF TUSTIN.
The City Council of the City of Tustin does ordain as
follows:
WHEREAS, the City Council of the City of Tustin duly
adopted Resolution No. 466, declaring its intention to inititate
proceedings on its own motion for the amendment of the building
line setback requirments for property fronting on First Street
in the City of Tustin; and
WHEREAS, the Orange County Master Plan of Highways
indicates that First Street is eventually to be 100 feet in
width; and
WHEREAS, it is in the public interest to have that
portion of First Street lying within the City of Tustin the same
widthas that portion o 4 f First Street situated in the County--bf
Orange and.the City of Santa Ana; and
WHEREAS, there are, at the present time, only a small
number of parcels of property on which buildings extend into the
proposed future right-of-way; and
WHEREAS, the Planning Commission of the City of Tustin,
after due notice, held a public hearing to consider objections
to the amendment of the building line setback requirements
for that certain real property more particularly described
hereinafter, all in accordance with Ordinance No. 71, as amended;
and
WHEREAS, the Planning Commission of the City of Tustin.,
after said hearing, has duly reported its recommendations concern-
ing said setback requirements to the City Council of the City,
of Tustin; and
WHEREAS, the City Council of the City of Tustin, after
due notice, held a public hearing to consider the amendment
of the building line setback requirements for said property,

described hereinafter,.on June 15,, 1959; and
WHEREAS, all provisions of.Ordinance No. 71,
as amended, relating to amendments thereto, have been duly
complied with; and
WHEREAS, the City Council of the City of
Tustin finds and determines that public necessity, convenience,
general welfare, and good zoning practice require that the
building line setback requirements be amended for the hereim.
after described property, as hereinafter set forth;
NOW, THEREFORE, the City Council of the
City of Tustin does ordain as follows:
Section 1. That the building line 'setback
requirements on the hereinafter described property be amended
as follows:
The building line setback requirements on the
North side of First Street to be 50.00 feet Northerly, measured
at right angles from the surveyed center line of First Street
and extending from the Westerly City limits of Tustin,
Easterly to the Northwesterly line of Irvine's Subdivision,
being the'Southeasterly City limits of Tustin; excepting therefrom
any portions thereof in County territory.
Said building line setback requirements on
the South side of First Street to be 50.00 feet Southerly,
measured at right angles from the surveyed center line of
First Street from the East line of Tustin Avenue,,as it now
exists, Southerly from First Street, extending Easterly to
the Northwesterly line of Irvine's Subdivision, being the
Southeasterly City limits of Tustin.
Section 2. Ordinance No. 71, as amended, is
further amended as above set forth all in accordance with a
map, which map is attached hereto, incorporated herein, marked
"District Zoning and Building Line Map", Plate lb, and made a
part hereof. The building line requirements for the property

described hereinabove are set forth on said map, referred to
herein, and said map is made a part, of this Ordinance as if the
matters and information set forth on said map were fully des-
cribed herein. It is the intention of the City Council of
the City of Tustin that the printed map referred to herein-
above shall. prevail over the written description in the event
of conflict.
Section 3. The City Clerk shall certify to
the adoption of this Ordinance and shall cause the same to be
published once, within fifteen days after its adoption, in
the Tustin News, a weekly newspaper of general circulation,
printed, published and circulated in the City of Tustin.
PASSED AND ADOPTED by the City Council of
the City of Tustin at a regular meeting thereof held on the
6th day of July, 1959.

does hereby certify that the whole number of members of the
City Council of the City of Tustin is five; that the above
and foregoing Ordinance was duly and regularly introduced
at a regular meeting of the City Council of the City of
Tustin held on the 15th day of June, 1959, and was duly
passed and adopted at a regular meeting of the City. Council
held on the 6th day of July, 1959, by the following vote:
AYES: Councilmen Bacon, Byrd, Humeston, Tadlock
NOES: Councilmen None
ABSENT: Councilmen Kidd
