HomeMy WebLinkAboutORD 122 (1959)Mirl"i W XIB ORDINANCE NO. 122 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN AMENDING ZONING ORDINANCE NO. 71 OF THE CITY OF TUSTIN AND REZONING AND ESTABLISHING BUILDING LINES FOR CERTAIN PROPERTY IN THE CITY OF TUSTIN DESCRIBED HEREIN:'' The City Council of the City of Tustin does ordain follows WHEREAS, TherCity Council of the City of Tustin u ad6pted No. 457, de.claring its intention to initiateproceedings, on -its 'own motion for the rezoning and establishment of building lines on that certain real property hereinafter described; and WHEREAS, the Planning Commission of the City of Tustin, after notice duly given, held a public hearing on February 9, 1959, to consider objections to said rezoning and the estab- lishment of building lines on that real property more particularly described hereinafter, all in accordance with Ordinance.No. 71, of the City of Tustin, as amended; and WHEREAS, the Planning Commission of the City of Tustin, after'said hearing, duly reported its recommendations concerning rezoning and establishing building lines on said property to the City Council.of the City of Tustin; and WHEREAS, THE City Council of the City of Tustin finds and determines that public necessity, . convenience, general welfare and good zoning practice require certain changes in the, zoning and . building line requirements on the property hereinafter described; NOW, THEREFORE, the City Council of the City of Tustin does ordain as follows: Section 1. That the following described property, situated in the I City of Tustin, County of Orange, State of California, be and the same is hereby zoned R-1: PARCEL 1:- Beginning at the intersection of a line drawn parallel with and 10 feet Southeasterly, measured at right angles from the Southeasterly line of the Northwesterly one-half of Lot 32 in Block 12 as per Map of Irvine's Subdivision re- HE corded in Book 1, page 88, Miscellaneous Record Maps, Orange County, California, with the boundary line of the City of Tustin, said boundary line also being the North- easterly right of way line of Laguna Road, 80 feet in width. Thence from said point of beginning running Northeasterly along said parallel line, also being the Southeasterly right of way line of Orange Avenue, 40 feet in width a distance of 1281.47 feet a little more or less', to a line drawn parallel with and 30 feet Southwesterly measured at right angles from.the Northeasterly line of said Lot 32, Block 12, said point also being in the Southwesterly right of way line of San Juan Street, 60 feet in width. Thence Southeasterly along said parallel line, and continuing along a line drawn parallel to the Northeasterly line of Lot 31 in said Block 12 a distance of 981-38 feet, a little more or less, to the Southeasterly line of the North- westerly one-quarter of Lot 31 in said Block 12. Thence Southwesterly along said South, easterly line, 1200.00 feet, a little more or less, to the boundary line of the City of Tustin, also being the Northeasterly right of way line of Laguna Road. Thence Northwesterly following-the.City of Tustin boundary line to the point of beginning. PARCEL 2: Beginning at the intersection of a line drawn parallel with and 30 feet southwesterly., measured at right angles, from the northeasterly line of Lot 31 in Block 12 as per Map of Irvine's Subdivision recorded in Book 1, page 88, Miscellaneous Record Maps, Orange County, California, with the southeasterly line of the northwesterly one-quarter fl/4) of Lot 31 in said Block 12, said point being an angle point in the boundary line of the City of Tustin. Thence from said angle point, south- easterly along a line drawn parallel to and 30 feet southwesterly, measured at right angles from the northeasterly line of said Lot 31, in Block 12, a distance of 661.40 feet, a little more or less, to an intersection with the northwesterly line of the southeasterly one-quarter (1/4) of said Lot 31 in Block 12. Thence South 400 001 West (record) along the northwesterly line of said southeasterly one- quarter (1/4), 630.60 feet, a little more. or less, to the westerly corner of the northeasterly one-half (1/2) of said southeasterly one-quarter (1/4). Thence North 500 00 1 West (record) along the southwesterly I linel,of the northeasterly one-half (1/2) of said Lot 31, in Block 12, 661.40 feet, more or less, to an intersection with the boundary line of the City of Tustin. Thence North 40°00' East (record) along said boundary line to the point of beginning., Section 2. Ordinance No. 71 of the City of Tustin, as amended, is further amended as above set forth, all in accordance with a map, which map is attached heretD and incorporated herein, marked: "District Zoning and Buil I ding Line Map", Plate 14, and made a part hereof. The building line requirements for the property herein described are set forth on the,map referred to herein, and said map is made a part of this Ordinance as if the matters and information set forth on said map were fully described herein. It is the intention of the City Council of the City of Tustin that the printed map referred to hereinabove shall prevail over the written description in the event of conflict. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once, within fifteen days after its adoption, in the Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustin.
