ORDINANCE NO. 120
AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
PROHIBITING FORTUNE TELLING OR ADVERTISING TO
TELL FORTUNES WITHIN THE CITY OF TUSTIN: PRE-
SCRIBING PENALTIES FOR VIOLATION OF THIS ORDI-
NANCE, AND REPEALING SECTION 10-32, OF ORDINANCE
NO. 87, OF THE CITY OF TUSTIN, AND ALL ORDINANCES
OR: PARTS OF ORDINANCES IN CONFLICT HEREWITH.
The City Council of the City of Tustin, California,
does ordain as follows:
SECTION 1. It shall be unlawful to and no person, firm
or corporation shall advertise by sign, circular, handbill, or
in any newspaper, periodical or magazine, or other publication
or publications, or by any other means, to tell fortunes, to
find or restore lost or stolen property, to locate oil wells,
gold or silver or other ore or metal, or natural product, to
restore lost love or friendship,or affection, to unite or procure
lovers, husbands, wives, lost relatives or friends, for or with-
out -,pay, by means of occult or psychic powers, faculties or forces,
clairvoyance, psychology, psychometry, spirits, mediumship, seer-
8h1p, prophecy,.;astrology, palmistry, necromacy, or other craft,
sdiftce.,,cards, talisman, charms, potions, magnetism or magnetized
articles or substances, oriental mysteries or magic of any kind
or nature, or numerology, or to engage in or carry on any business,
the advertisement of which is prohibited by this section.
SECTION 2. Theprovisionsof the preceding section
shallnot be construed to include, prohibit or'interfere with the
exercise of any religious or spiritual functions of,any priest,
minister, rector or an acredited representative of any bonafide
church or religion where such priest, minister, rector or accredited
representative holds a certificate of credit commission or ordi-
nation under the ecclesiastical laws of a religious corporation
incorporated under the laws of any state or territory of the
United States of America or any voluntary religious association,
and who fully conforms to the rights and practices prescribed by
the supreme conference, convocation, convention, assembly, associ-
ation or snynod of the system, or faith, with which they are
affiliated. Provided, however, that any church or religious or-
ganization'which is organized for the primary purpose of con-
ferring certificates of commission, credit or ordination for a

price and not primarily for the purpose of teaching and tracticing
a religious doctrine or belief, shall not be deemed to be a bonafide
church or religous organization.
SECTION 3. Any.person, firm or corporation violating
any of the -provisions of this ordinance shall be deemed guilty
of a misdemeanor, and upon conviction thereof shall be punishable
by a fine of not more than $500.00 or by imprisonment for a
period of not more than six months, or by both such fine and
imprisonment. Such person, firm or corporation shall be guilty
of a separate offense for each and every day in which the
violation of this ordinance is committed or continued by such
person, firm or corporation and shall be chargeable as herein
provided.
SECTION 4. Section 10-32, entitled "Palmistry", of
Ordinance No. 87, of the City of Tustin, is hereby repealed,
however, the balance of Ordinance No. 87, of the City of
Tustin-, shall remain in.full force and effect; all other
ordinances or.parts of ordinances to the extent the same
conflict herewith are to that extent hereby repealed.
SECTION S. If any section, subsection, sentence,
clause, phrase or portions of this ordinance, is for any
reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, suchdecision shall
not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Tustin, hereby
declares that it would have adopted this ordinance and each
section, subsection, sentence, clause, phrase or portion
thereof, irrespective of the fact that any one or more
sections, subsections, clauses, phrases or portions hereof
be declared invalid or unconstitutional.
SECTION 6. The City Clerk shall certify to the
adoption of this Ordinance, and shall cause the same to be
published, once within fifteen days after its adoption in
The Tustin News, a weekly newspaper of general circulation,

and said Ordinance shall take affect thirty days after its
final adoption.
PASSED AND ADOPTED by the City Council of the City of
Tustin at a regular meeting of the City Council held
on the 2nd day of February, 1959•

that the whole number of members of the City Council of the
City of Tustin is five -0 that the foregoing Ordinance was
duly and regularly introduced at a regular meeting of the
City Council of the City of Tustin, held on the 19th day
of January, 1959, and was duly passed and adopted at a
regular meeting of the City Council held on the 2nd day
,of February, 1959.
