SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR TUSTIN SPORTS PARK
BASEBALL DIAMOND #2 (CIP NO. 20060)
SUMMARY:
Tustin Sports Park Baseball Diamond #2 renovations are completed and the project is
ready for acceptance and filing of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 12 -101 accepting the Tustin Sports Park Baseball Diamond
#2 Renovation (CIP No. 20060), and
2. Authorize the City Clerk to file the Notice of Completion with the County
Recorder's office.
FISCAL IMPACT:
The Tustin Sports Park Diamond #2 Baseball Diamond Renovation was included in the
Capital Improvement Program (CIP) for Fiscal Year 2011 -2012. Adequate funds were
available in the Park Development Fund (131) for this project. The final cost of the
project was $212,257.02.
BACKGROUND:
The Community Services Commission identified the renovation of the Tustin Sports
Park Baseball Diamond #2 as a priority during FY2011 -2012 Capital Improvement
Program (CIP) workshop. Tustin Sports Park Baseball Diamond #2 served local
baseball programs comprised primarily of players 13 years and older. Since Tustin
Sports Park #2 was the only park facility capable of hosting players of this age group, it
was impacted by high use on a year -round basis and was in need of renovation.
The renovation of the Tustin Sports Park Baseball Diamond improved playing conditions
for local youth baseball players. Improvements included: infield and pitching mound

upgrades, perimeter turf and irrigation enhancements, new shaded dugout structures,
backstop, and fencing refinements.
The project was co 'pleted on November 14, 2012. The City has retained 10% of the
contract amount, which Mll be released no sooner than 35 days after the recordation of
he otice of Comple ioryt�ith the County Recorder's Office.

RESOLUTION NO. 12 -101
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE TUSTIN SPORTS PARK BASEBALL DIAMOND
#2 (CIP NO. 20060)
WHEREAS, Lehman Construction, Inc., having a contract with the City of Tustin
to construct the hereinafter described public works and improvement; and
WHEREAS, the Project Manager has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
work and improvement should be filed and payment of the balance due said contractor
authorized in accordance with the contract documents;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement be accepted, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:

BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 4th day of December 2012.
