HomeMy WebLinkAboutORD 119 (1958)ORDINANCE NO. 119 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN AMENDING ZONING ORDINANCE NO. 71 OF THE CITY OF TUSTIN AND REZONING AND ESTA- BLISHING BUILDING LINES FOR CERTAIN PROPERTY IN THE CITY OF TUSTIN. I The City Council of the City of Tustin does ordain as follows: WHEREAS, The Planning Commission of the City of Tustin duly adopted Resolution No. 511 declaring its intention tD commence proceedings on its own motion for the rezoning of that certain real property hereinafter described; and WHEREAS, The'Planning Commission of the City of Tustin after notice.duly given, held a public hearing to hear objections to and to consider the rezoning of that certain real property more particularly described hereinafter, all in accordance with Ordinance No. 71 of the City of Tustin as amended; and WHEREAS, The Planning Commission of -the City of Tustin, after said hearing, has duly reported its recommendation concerning the rezoning of said property to the City Council of the City of Tustin; and WHEREAS, The City Council of the City of Tustin, after notice duly given of the time and place for public hearing concerning said rezoning, held a public hearing on the rezoning of said property on November 3, 1959; and WHEREAS, all provisions of Ordinance No. 71 as amended . C' relating to amendments thereto have been duly complied with; and WHEREAS, The City Council of the City of Tustin finds and determines that public necessity, convenience, general welfare and good zoning practice require certain changes in the zones and building line requirements on the property hereinafter described, NOW, THEREFORE, The City Council of the City of Tustin does ordain as follows: Section 1. That the following described, property, situated in the City of Tustin, be and the same is hereby rezoned from C-1 and R-3 to C-2: That area bounded; North by Main Street, East by South D Street, South by Sixth Street and West by South C Street, excepting portion now zoned C-2. Section 2. That the following described property, situated in the City of Tustin, be and the same is hereby rezoned from R-1 to R-3; The East one-half of Tract No. 324, including ,vacated 5th Street adjacent on the North. Section 3. That the following described parcels of property, situated in the City of Tustin, be and the same are hereby rezoned from R-1 to R-2: Parcel 1; The West one-half of Tract No. 324 including vacated 5th Street adjacent on the North. Parcel 2; Lots 10 through 15, inclusive, in Tract No. 176. Parcel 3: The East 210 feet of the South 106 feet of the North one-half of Lot "U", Stafford and Tustin Tract. Section 4. Ordinance No. 71 as amended is further amended as above set forth, all in accordance with a map, which map is attached hereto, incorporated herein, marked "District Zoning and Building Line Map", plate 12, and made a part hereof. The building line requirements for the property described hereinabove are set forth on the map referred to herein and said map is made a part of this Ordinance, as if the matters and information .set forth on said map were fully described herein. It is the intention of the City Council of the City of Tustin that the printed map referred to hereinabove shall pre- vail over the written description in the event of conflict. Section 5. The City Clerk shall certify to the adoption of this Ordinance.and shall cause the same to be published once within fifteen days after its adoption in the Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustin.
