SUBJECT: AWARD CONTRACT FOR THE ROBINSON DRIVE / KELLER DRIVE
PEDESTRIAN ENHANCEMENTS (CIP 40083) AND BROWNING AVENUE
PARKVIEW WAY PEDESTRIAN ENHANCEMENTS (CIP 40084)
SUMMARY
Staff is requesting that the City Council award the construction contract for the Robinson
Drive/Keller Drive Pedestrian Enhancements (CIP 40083) and Browning Avenue/Parkview Way
Pedestrian Enhancements (CIP 40084) to the lowest responsive/responsible bidder.
RECOMMENDATION
It is recommended that the City Council award the construction contract for the Robinson
Drive/Keller Drive Pedestrian Enhancements (CIP 40083) and Browning Avenue/Parkview Way
Pedestrian Enhancements (CIP 40084) to the lowest responsive/responsible bidder, Asplundh
Construction Corporation, in the amount of $228,383, and authorize the Mayor and the City Clerk
to execute the contract documents on behalf of the City.
FISCAL IMPACT
Funding has been budgeted and appropriated in this fiscal year's Capital Improvement Program;
ninety percent (90%) of the funding for these improvements is funded with a grant from the
California Department of Transportation (Caltrans) Safe Routes to School (SR2S) Program — Cycle
10 and the minimum required local agency match is provided by the Gas Tax Fund (Fund 130).
DISCUSSION
The work will include installation of In-Roadway Warning Lights (IRWL's) at Robinson Drive/Keller
Drive, adjacent to Tustin Ranch Elementary School, and on Browning Avenue/Parkview Way,
adjacent to Utt Middle School, along with flashers, signs, sidewalk, curb & gutter, and ADA ramp
improvements. Power will be delivered using solar panels and due to the nature of the work
involved, in accordance with provisions of Section 3300 of the California Public Contract Code, an
electrical contractor license (C-10) was required together with a general contractor license (A).
Formal bids were publicly opened on January 3, 2013. The engineer's estimate was $236,500.
There were five (5) bids received and the results are summarized below by order of least dollar
amount as follows:

The lowest bid submitted by Unique Performance Construction, Inc. has been determined non-
responsive for not possessing, at the time of making a bid, the required C-10 electrical contractor
license pursuant to the approved Contract Documents. As a result, Asplundh Construction
Company is the lowest responsive/responsible bidder.
The State Contractor's License, bid bond and professional references for Asplundh Construction
Company have been verified and are appropriate for the project.
