HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERINGDIVISION REQUEST TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO RELEASE A SUPPLEMENTAL PORTION OF THE COMBINED TRANSPORTATION PROGRAM FUNDS FOR THE JAMBOREE ROAD/EDINGERAVENUE INTERCHANGE (CIP NO. 7'1,54) SUMMARY Adoption of Resolution No. 00-7 will enable the City to request and receive an additional reimbursement of Combined Transportation Program Funds from the Orange County Transportation Authority of $1,259,394 for the Jamboree Road/Edinger Avenue Interchange Project. RECOMMENDATION It is recommended that the City Council request the Orange County Transportation Authority (OCTA) release an additional reimbursement of $1,259,394 from the Combined Transportation Program Funds for the Jamboree Road/Edinger Avenue Interchange Project by adopting Resolution No. 00-7. FISCAL IMPACT OCTA has allocated $11,585,000 to reimburse the Cities of Tustin and Irvine for the Construction Implementation Phase of this project through the Smart Street Program. Of this $11,585,000, the City of Tustin has previously received $8,619,743 from OCTA. Adoption of Resolution No. 00-7 will enable the City to request and receive an additional reimbursement of $1,259,394 for the project. Tustin, as designated'lead agency for the Smart Street Project, receives both Irvine's and Tustin's share of the reimbursement. Upon receipt of this additional reimbUrsementthe total received from OCTA will be $9,879,137. The remainder of the funds will be requested from OCTA as part of the final project report. BACKGROUND On May 15, 1995, the City Council approved the Master Funding Agreement (MFA) with OCTA for projects funded in the Combined Transportation Funding Program (CTFP). In February 1997, OCTA approved Smart Street funds for the construction of the Jamboree Road/Edinger Avenue Interchange as part of the Moulton Parkway Smart Street Project. On September 8, 1997, the OCTA amended the MFA and allocated construction funds in the amount of $11,585,000 for the Jamboree Road/Edinger Avenue Interchange project. The Jamboree Road/EdingerAvenue Interchange is a joint project with the Cities of Irvine and Tustin · and the Transportation Corridor Agency (TCA). TCA is the lead agency for the Construction Request to the Orange County Transportation Authority to Release a Supplemental Portion of the Combined Transportation Program Funds for the Jamboree Road/Edinger Avenue Interchange (CIP No. 7154) February 22, 2000 Page 2 Implementation Phase and shares in the final construction cost but does not receive any Smart Street reimbursement. TCA has arranged for the County of Orange to administrate the construction of the interchange. The County awarded the construction contract for the interchange project to Kajima Engineering & Construction Company in the amount of $14,366,238. Pursuant to OCTA guidelines, once a construction project has been awarded, the participating agency may request release of funds from OCTA up to 90 percent of the lesser of either the total allocated project funds or the construction contract amount. In this case, the Cities of Tustin and Irvine's portion of the (2/3) of 90 percent of the construction contract was the lesser amount. In Resolution 97-102 the City Council previously requested and received $8,619,743 frOm OCTA. DISCUSSION Currently, with Contract Change Orders approved to date, the total dollar amount of actual construction, right of way, and construction management stands at $16,465,228. With the increase in the costs of the project construction phase the City now becomes eligible for an additional reimbursement of $1,259,394. In'order to receive this additional reimbursement it is necessary for the City Council to pass and adopt Resolution No. 00-7, which requests that the OCTA release this $1,259,394. Upon completion of the plant maintenance period and full project accounting, including final construction costs, construction administration and contingencies, the City will prepare a final request to OCTA for the remaining allocation of eligible expenses up to the original allocation of $11,585,000. Serlet '~,~,, Director of Public Works/City Engineer Keith Linker Associate Civil Engineer TDS:/COUNClL:Releaseof Supp OCTA Funds & Reso 00-7.doc Attachment 25 25 27 23 RESOLUTION NO. 00-7 A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO RELEASE A PORTION OF THE COMBINED TRANSPORTATION PROGRAM FUNDS FOR THE JAMBOREE ROAD/EDINGER AVENUE INTERCHANGE AS A PART OF THE MOULTON PARKWAY SMART STREET PROJECT (PROJECT · NO. 7154) WHEREAS, the Orange County Transportation Authority approved a Combined Transportation Funding Program (CTFP) for fiscal year 1999-00; and WHEREAS, the program includes $11,585,000 for fiscal years 97-98 through 99- 00 and for the Jamboree Road/Edinger Avenue Interchange as a part of the Moulton Parkway Smart Street Project; and WHEREAS, the City of Tustin has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction; and WHEREAS, the City of Tustin has expended $11,000,000 in reimbursing the Transportation Corridor Agencies for construction of the Jamboree Road/ Edinger Avenue Interchange on behalf of the Cities of Tustin and Irvine. NOW, THEREFORE, BE IT RESOLVED that the City of Tustin, hereby requests the Orange County Transportation Authority release $1,259,394 of CTFP funds from the Smart Street Program for construction of said project to the City. This request is in conformance with the CTFP allocation process and does not exceed ninety (90) percent of the programmed amount or ninety (90) percent of the construction contract. AND BE IT FURTHER RESOLVED that the remaining ten (10) percent in CTFP funds will be transferred to the City of Tustin when construction is completed and a Final Report on the project is accepted by the Orange C~)unty Transportation Authority. The City of Tustin agrees to submit the Final Report to the Orange County Transportation Authority within one hundred twenty (120) days after acceptance of the improvement.
