A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 TUSTIN, CALIFORNIA, ADOPTING THE FINAL NEGATIVE
4 DECLARATION A~ ADEQUATE FOR CODE AMENDMENT 99-001
AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL
s QUALITY ACT.

The City Council of the City of Tustin does hereby resolve as follows:

I. The City Council finds and determines as follows:

9 A. Code Amendment 99-001 is considered a "project" pursuant to the
' terms of the California Environmental Quality Act; and

B. A Negative Declaration has been prepared for this project and has
been distributed for public review.
C. The Planning Commission of the City of Tustin has considered
is evidence presented by the Community Development Director and
~4 other interested parties with respect to the subject Negative
Declaration, and on November 22, 1999 recommended that the City
~5 Council certify the Negative Declaration.

D. The City Council of the City of Tustin has reviewed and considered
~? the Negative Declaration and has determined that the Negative
Declaration is adequate and complete.

~9 II. A Final Negative Declaration has been completed in compliance with CEQA
and state guidelines. The City Council received and considered the
20 information contained in the Negative Declaration prior to approving the
2~ proposed project, and found that it adequately discussed the environmental
effects of the proposed project. Further, the City Council finds the project
2~- involves no potential for any adverse effects, whether individually or
cumulatively, on wildlife resources; and, therefore, makes a De Minimis
23 Impact finding related to the California State Department Fish and Game
24 Code Section 711.4.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on
