SUBJECT: CONSULTANT SERVICES AGREEMENT FOR TUSTIN COMMUTER RAIL
STATION CONSTRUCTION MANAGEMENT (ClP NO. 7138)
SUMMARY
The Agreement between the City and Harris & Associates will provide construction management
services to oversee the completion of the construction of the Tustin Commuter Rail Station.
Construction management services will include an on-site construction manager, on-call
construction inspection services, materials and testing services and supplemental survey
services should the City need these.
RECOMMENDATION
It is recommended that the City Council approve a Consultant Services Agreement with the firm of
Harris & Associates. to provide construction management services for the Tustin Commuter Rail
Station in an amount not to exceed $175,000.00, and authorize the Mayor and City Clerk to
execute the Contract on behalf of the City, subject to approval by the City Attorney.
FISCAL IMPACT ,':,
The Consultant will be compensated on an hourly basis for providing a Construction Manager for
this project. Materials testing will be provided by the Consultant and has been included as part of
the construction management services. Supplemental services include surveying and inspection
on an as-needed basis. It is estimated that the total cost for construction management services
will not exceed $175,000.00, which is approximately 4% of the construction estimate for the
project. Funding for this service has been included in the Capital Improvement Program budget
for the Tustin Commuter Rail Station (CIP No. 7138).
BACKGROUND
At the February 7, 2000 City Council meeting the Council approved the plans and specifications
and authorized the bidding of the Tustin Commuter Rail Station. Bids are currently scheduled to be
opened on April 12, 2000. It is anticipated 'that construction will start in late May 2000 .and be
completed by the end of December 2000. This project provides for the construction of a new
'commuter rail station with a parking lot facility for 324 vehicles, double loading/unloading platforms,
a pedestrian undercrossing, and related station amenities. Amenities include: canopies, benches,
an information kiosk, ticket vending machines, newspaper racks, telephone service, rubbish cans,
bike racks, and a drinking fountain.

Construction of the Commuter Rail Station will at times require full time personnel to oversee the
construction activities of this project. There will also be 24-hour construction during four separate
weekends as required by Southern California Regional Rail Authority to construct the pedestrian
underpass. Rather than hire additional staff to oversee the construction of the Station, staff is
proposing to retain the firm of Harris & Associates to provide construction services and expertise
for managing this project. City staff will still be actively involved and will provide assistance and
oversight of the Construction Manager's activities.
The Construction Manager will be responsible for keeping the project on schedule and within
budget. The Manager will coordinate the construction activities of all aspects of, the project under
the oversight of the City's Engineering Division. Supplemental services to be provided on an as-
needed basis will include inspection and surveying. It is envisioned that City Inspection (Building
Division and Engineering Division) will be utilized for the majority of inspection services.
The Engineering Division requested proposals from two firms with experience in managing
construction projects of this magnitude. Proposals were received from Holmes & Narver, and Harris
& Associates. Both firms have good reputations, qualified staff, and have performed similar types of
services for other agencies in a very acceptable manner. Harris & Associates was selected based
upon their vast experience in the construction management field and high recommendations
received from other agencies. Based upon the contents of the proposals and the follow-up
interviews, it was apparent that Harris & Associates exhibited a more thorough understanding of the
work tasks and the effort required to successfully perform the'construction management services.

It is recommended that the City Council approve the COnsulting Services Agreement with Harris &
Associates for construction management services for the Tustin Commuter Rail Station, subject to
approval by the City Attorney.

CONSULTANT SERVICES AGREEMENT
THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into this day
~ day of .2000 by and between the CITY OF TUSTIN, a municipal corporation,
hereinafter referred to as "City", and Harris & Associates a California corporation, hereinafter
referred to as "Consultant".
RECITALS
WHEREAS, City requires the services of a consultant to furnish the necessary engineering
services for Tustin Commuter Rail Station Construction Manaaement hereinafter referred to as
"Project"; and
WHEREAS, Consultant has submitted to City a proposal dated March 6. 2000, a copy of
which is attached hereto, marked' as Exhibit "A" and is by this reference incorporated into this
Agreement; and
WHEREAS, Consultant is qualified to provide the necessary services for the Project and
desires to provide said services; and
WHEREAS, City desires to retain the services of Consultant for said Project.
NOW, THEREFORE, for the consideration and upon the terms and conditions hereinafter
set forth, the parties agree as follows:
AGREEMENT
Section 1' Scope of Consultant's Services.
Consultant shall perform all work necessary to' complete in a manner satisfactory to City,
the services set forth in the Consultant's Proposal dated March 6. 2000, a copy of which is
attached hereto, marked as Exhibit "A" and is by this reference incorporated into this Agreement.
Consultant shall also perform, at the direction of the City, any and all other consulting services
that in the opinion of the'City the Consultant is qualified to perform and is in the interest of the
City for the Consultant to perform.
Section 2: Order of Precedence.
In the event of a conflict between or among any of the documents comprising this
Agreement, the following order to precedence shall govern the provision in question:

Section 3: Time for Completion.
The time for completion of the work to be performed by Consultant is an essential condition
of this Agreement. Consultant shall prosecute regularly and diligently the work of this
Agreement according to reasonable schedules established by the City for various items described
and as outlined within Consultant's proposal. Consultant shall not be accountable for delays in
the progress of its work caused by any condition beyond its control and without the fault or
negligence of Consultant. Delays shall not entitle Consultant to any additional compensation
regardless of the party responsible for the delay.
Section 4: Compensation.
A. The compensation to be paid under this Agreement shall be as set forth in Exhibit "A", not
to exceed a total cost of $175.000.00.
B. Consultant shall submit detailed invoices, based upon the actual work perfOrmed
accompanied by backup documentation as requested by the City.
C. Progress payments for work completed shall be paid by City as the work progresses, within
thirty (30) days of the date of Consultant's invoice.
D. Consultant shall provide City with a monthly itemization of all work performed, and the
fees accrued thereon, in complete and sufficient detail to fully apprise City thereof.
Section 5: Independent Contractor.
Consultant's relationship to City in the performance of this Agreement is that of an
independent contractor. Consultant's personnel perf/Srming services under this Agreement shall
at all times be under Consultant's exclusive direction and control and shall be employees of
Consultant and not employees of City. Consultant shall pay all wages, salaries and other
amounts due its employees in connection with this Agreement and shall be responsible for all
reports and obligations respecting them, such as social security, income tax withholding,
unemployment compensation, workers' compensation and similar matters.
Section 6: Indemnification.
Consultant agrees to indemnify, defend and hold City, its officers, agents, employees,
successors and assigns harmless from any loss, damage, injury, sickness, death, or other claim
made by any person and from all costs, expenses and charges including attorney's fees caused by
or arising out of Consultant's, its officers', agents', subcontractors', or employees' negligent
acts, negligent errors, or negligent omissions or willful misconduct, or conduct for which the law
imposes strict liability on Consultant in the performance or failure to perform this Agreement.

Section 7: Insurance.

Consultant shall maintain in full force and effect during the term of this Agreement policies
of comprehensive general liability, personal injury and automobile liability insurance with
limits of at least $1,000,000 combined single limit coverage per occurrence.

Consultant shall maintain in full force and effect during the term of this Agreement a policy
of professional liability insurance coverage with limits of at least $1.000.000 combined
single limit coverage per claim or per occurrence. If Consultant provides claims made
professional liability insurance, Consultant shall also agree in writing either (1) to purchase
tail insurance in the amount required by this Agreement or to cover claims made within five
(5) years of the completion of Consultant's service under the Agreement, or (2) to maintain
professional liability insurance coverage with the same carrier in the amount required by
this Agreement for at least five (5) years after completion of Consultant's services under this
Agreement. Consultant shall also provide evidence to the City of the purchase of the
required tail insurance or continuation of the professional liability policy by' executing the
attached Letter Agreement on Consultant's letterhead.

Consultant shall carry and pay for such compensation insurance as is necessary to fully
protect Consultant and its employees under California Worker's Compensation Insurance
and Safety Laws, and shall relieve the City from all responsibility under said laws in
connection with the performance of this Agreement.

All insurance required pursuant to this Section shall be issued by a company admitted in the
State of California 'and rated A, VII or better by the latest edition of Best's Key Rating
Guide.

Upon execution of this Agreement, Consultant shall provide to City certificates of insurance
on the City's form evidencing the required insurance, along with endorsements in form
satisfactory to the City. If self-insured for worker's compensation, Consultant shall submit
to City a copy of its certification of self-insurance issued by the Department of Industrial
Relations.
Section 8: Termination of Agreement.
A. City shall have the right to terminate any or all of the services covered by this Agreement at
any time for any reason by giving written notice to Consultant.
B. Upon termination of this Agreement, Consultant shall be paid for services rendered by the
effective date of the termination.

Upon termination of this Agreement or completion of the Project, all documents relating to
the Project shall become the sole property of City. Should City terminate this Agreement
pursuant to subparagraph A. of this Section, Consultant shall, within ten (10) business days
of receipt of notice of termination, provide City with all documents within Consultant's
possession relating to this Agreement and the ProjeCt, including but not limited to all
completed documents and all drafts of uncompleted documents.

Section 9: Notices
Any notice allowed or required to be given shall be effective upon personal delivery thereof,
or upon depositing thereof in the United States Postal Service. certified mail, return receipt
requested, postage prepaid, addressed as follows:

Section 10: Miscellaneous Provisions.
A. Consultant shall proceed immediately and diligently to perform the services provided for in
this Agreement upon receipt of notice from City to proceed therewith.
B. No part of this Agreement may be assigned by Consultant without the prior written
approval of City.

This Agreement shall extend to and be binding upon and inure to the benefit of heirs,
executors, administrators, successors and assigns of the respective parties hereto.

Consultant shall perform all services required-hnder this Agreement using that degree of
care and skill ordinarily exerCised under similar conditions in similar localities, and shall be
responsible for all errors and omissions for services performed by Consultant under the
terms of this Agreement.

Consultant certifies that there shall be no discrimination against any employee who is
employed in the work covered by this Agreement, or 'against any application for such
employment, because of race, religion, color, sex or national origin including but not
limited to, the following: employment, upgrading, demotion or transfer, recruitment, or
recruitment advertising, lay-off or termination, rate of pay or other forms of compensation,
and selection for training, including apprenticeship.

Thank you for the opportunity to propose our services for the Tustin Commuter Rail Station project. As
discussed in our meeting with Doug Anderson and Dana Kasdan, we have prepared the attached proposal
e,',chibits based on a 130 working day construction duration. Our proposal includes Craig Johnson ar three-
quarter (3/4) time, and myself two hours per week, between April and November, 2000. It also includes 96
hours of additional rime for Craig, allocated for the two weekends of around-the-clock work for placement
of the precast structure under the mainline rrac 'ks. We also believe an administrative aid should be included
at eight (8) hours per week. This work will include project filing, database maintenance, and review of
prevailing wage documentation for compliance.
Enclosed you will find the resumes of two Harris construction inspectors, Tony Perez and Alex Naime. Both
of these individuals have rail experience as well as extensive experience in underground construction. Either
Tony or Alex would be available for on-call construction inspection should the City's public works
inspection staff be unavailable for portions of the project.
As noted in our meeting, materials testing and construction su.r*eying maybe incorporated into the scope of
work for construction management services. Harris would propose Ninyo & Moore for materials testing and
GPS Surveying. For several years, Harris & Associates has maintained relationships with both of these firms.
GPS Survey is our subconsultant for the Irvine Boulevard/Prospect Avenue widening project which we are
currently designing for the City.
Corporately Harris & Associates would be pleased to continue our relationship with the City on this Project,
and personally, Craig would be thrilled to have an assignment so close to home. Should you have any

Scope of Construction Management Services
for
Tustin Commuter Rail Station
The project consists of construction of a commuter rail station which includes two passenger
loading platforms adjacent to existing railroad tracks, pedestrian undercrossing, entrance stairs
and ramps, canopies, lighting, signage, ticket machines, parking lot, bus loading areas, and site
furnishings. The project site is near the intersection of Edinger Avenue and Jambroee Road and
is located within a new commercial/retail business park. Portions of the work are within the'
OCTA right-of-way. The scope of services for the construction phase is detailed as follows:
1. Establish and SetUp Field Office- Set up a field office at the site which will include all office
equipment, filing system, computer System with E-mail communications, and telephones.
2. Contract Administration and Management - Provide all contract administration and
management services for the construction contract to coordinate work of the construction
contractor with the activities and responsibilities of the City and the Designer. Provide a
three-quarter time Construction Manager at the site during the entire project until
acceptance of the project.

Railroad Coordination: Provide all coordination between the railroad operations and the
construction contractor regarding work hours, work distances, track outages, and flag man
operations and staffing.
Public Relations- Respond to local residents and business questions, concerns and provide
construction related information.
Labor Compliance - Receive certified payrolls for c~)nstruction contractors, review for
compliance, and maintain project file system.
Communications - The Construction Manager will be the single point of communication.
Foster improved project team communications through written, verbal and electronic ·
communication. Keep project team well informed.
Project Conferences - Conduct preconstruction, construction, and progress meetings. The
preconstruction meeting will outline project specifics and inform contractor of project
administration procedures. The weekly progress meeting will review progress of the work,
schedule, chaYxge orders, R.FI's, submittals, and outstanding issues, The Construction
Manager will prepare, minutes of each meeting for distribution to all project parties.
Project Controls- Review and approve the construction contractor's baseline schedule. The
schedule will be developed utilizing the critical path method (CPM) identifying all
milestones, relationship with each activity, and showing all activities necessary to complete
the project. Monitor construction contractor's CPM schedule monthly. Notify parties of
actual or potential deviation from schedule. Work with project team to correct non-
compliance with schedule.

Contract Conditions - Ensure that all conditions of the contract documents are meet by the
contractor. Notify contractor of any non-compliance with the contract documents. Review
remedial action with the Designer and City as necessary before corrective work is started.

Change Orders - Review potential change orders for contractual and technical merit.
Prepare independent cost estimate and schedule analysis of wOrk. Negotiate and prepare
change orders for execution by the City. Keep the City apprised of impact of cumulative
change orders.

Update Project Cost- Update the project construction cost estimate to reflect all additions
and deletions to the contractor's scope of work. Develop cash flow report and forecast on a
monthly basis for the project.
12. Permits and Environmental Compliance - Review and enforce requirements stipulated in
permits issued by regulatory and environmental agencies.
13.
Quali~y Control- Observe and monitor all aspects of project including construction
documentation and jobsite safety for compliance with contract documents. Notify
contractor when work is NOT in compliance. Prepare daily inspection reports. Provide
photographic and video documentation of construction process.
14. Survey and Testing Coordination - Schedule, coordinate, and monitor the survey and
geotechnical testing services.
15. Document Clarification - Analyze issue, seek appropriate advice, recommend redesign
parameters, and track all RFI's, clarifications, and issues.
16. Manage Review of Submittals -Receive, review, distribute, and manage the review of all
request for clarifications and submittals.
17. Utilize Management Information System (MIS) - Maintain tracking system for shop
drawings, submittals,, product data, and clarifications.
18.
Weekly Status Reports - Prepare weekly reports highlighting project progress, amount of
work completed, time elapsed, change orders, cost issues and schedule, potential issues, and
anticipated completion date.
19.
Site Safety - Review and monitor contractors' safety program for compliance with
Cai/OSHA. Notify contractor if unsafe condition is observed. Notify the City if contractor
refuses to rectify unsafe condition. Investigate accidents.
20. Dispute ReSolution - Make recommendations and implement procedures for reducing the
likelihood of disputes and claims. Make recommendations regarding Alternate Dispute
Resolution (ADR) meihods. Assist in the resolution of disputes.
21. Progress Payments - Review contractor's payment requests. Verify contractor pay items.
Prepare payment documentation for execution by the City.

Final Walkthrough - Make final inspection of the project with City staff and Designer to
develop punchlist. Verify that required certificates of compliance, operation and
maintenance manuals, and as-built drawings have been delivered.
Acceptance - When punchlist items are complete make recommendation to the City for
project acceptance. Secure O&M manuals, warrants, and spare parts.
Certificate of Occupancy - Obtain occupancy certificate from local code enforcement agency.
Turn-Over - Conduct, coordinate, and attend turnrover sessions necessary to familiarize the
City staff required to operate and maintain facility.
-lsuilt Drawings - Verify that the contractor and Designer have completed "As-
Builts" with all changes included.
33. Project Completion Report- Prepare final report. Deliver pro. ject records to the City.
34. FinalPayment- Prepare documentation for final progress payment to contractor. File
Notice of Completion. Resolve any liens filed by subcontractors or suppliers.
35. Claims Resolution - Resolve any remaining claims or disputes. Provide support in
negotiating claims. Provide litigation support. Be expert witness.

The following fee schedule for the Scope of Services detailed in Exhibit A, is based on a three-
quarter (3/4) time Construction Manager. spread over a six month period to administer a 130
working day construction contract. However, depending on the contractor's approach to the
project, it is possible that the level of effort necessary for the construction could be reduced to as
little as half time over the entire project.

Mr. Guerrero has 21 years of experience in the construction industry
serving as project manager, construction manager, inspector, and
working for a general contractor on numerous building projects. He
is ICBO certified in the areas of reinforced concrete, prestressed
concrete, and masonry.
Relevant Experience
Community Redevelopment Agency of Los Angeles, Angels
Flight. Construction Manager. This project was for the $5 million
historic reconstruction of the Angels Flight funicular railway in
downtown Los Angeles. The project required an extraordinary amount
of coordination and sensitivity. There were two concurrent contracts,
one for rehabilitation of the historic elements, and the other for design/
build of the transit related systems. On-time delivery of the system was
very important as the date for dedication to accommodate the City of
Los Angeles' Mayor and Council had to be set months in advance.
Regional Transportation Commission, Clark County, NV,
Integrated Bus Maintenance Facilities. Construction Manager. This
$40 milli6n RTC project involved the construction of 10 precast/
masonry structures on a 36 acre site; two of which are 22,000 square
foot and 190,000 square foot maintenance buildings. He was
responsible for coordination of design changes between a mid-west
design team, the own. er and the contractor. Timely project completion
of the facility was paramount in order to accommodate new buses that
will arrive at the scheduled project completion. This project was named
· in F. W. Dodge Southwest Contractor, Dec. 98 issue, Best of 1998
Awards Issue/Best of Nevada - Best Public, Mechanical/Electrical
Project.
City of Laguna Hills, Community Center and Sports Center.
Project Director/Construction Manager. Mr. Guerrero supervises a
full-time construction management and support staff on this $26
million sports park and community center. This two-phase project,
when complete, will consist of two lighted baseball fields, two
soccer fields, skateboard park, roller hockey ring, several theme
areas, and a 60,000 square foot community center bUilding. Mr.
Guerrero provided the lead services on the biddability/
constmctability review, and was instrumental in breaking the
project into two phases, allowing construction to begin a year
earlier than would have been possible had the City waited until the
architect was prepared to bid the community center building. Mr.
Guerrero attends the weekly meeting, reviews all change orders, and
continues to provide direct oversight on the building design as it is
being prepared for bid.

City of Hermosa Beach, North Pier Parking Structure.
Construction Manager. Mr. Guerrero is responsible for mana~ng the
day-to-day activities involved with the construction of the $4.7 million,
400-car structure. Duties prior to bidding included preparation of a
biddability/constmctability review, leading of the prebid meeting,
answering bidders' questions, and preparation and production of all
addendum. Construction activities include coordination ofshopdrawing
and RFI response, special inspection and supervision of additional
special inspectors, and change order negotiations. Due to the City's
small size and lack of qualified personnel, the City has appointed Mr.
Guerrero as the acting Building Official on this project.
City of Santee, Mast Boulevard. Resident Engineer. Mr. Guerrero
provided the full range of construction management services. Harris
completed full construction management services for the City of
Santee's Mast Boulevard Extension project. The extension, which
included an 800-foot-long concrete bridge spanning a recreational
lake and waterfowl nesting site, and one mile of four-lane arterial
urban roadway, was completed ahead of schedule and $2 million
under the city's $11 million budget.
City of Santa Cruz, Downtown Parking Structure. Construction
Manager. This four-story post-tensioned structure is located on a tight,
downtown site. This project required coordination and communication
with local businesspeople to ensure their businesses were not affected
by the construction. Harris was responsible for preparing EDA
approved bid documents and specifications, preparing monthly reports
and progress paymmts, and maintaining grant files.
City of Huntington Beach, Main Street Parking Structure..
Construction Manager. This four-story structure, with a two-level
commercial complex, is located on a restricted site and required
extensive schedule monitoring. Despite major changes made during the
project by the owner, Mr. Guerrero was able to work with the
contractor to modify their schedule. This allowed portions of the garage
to open prior to completion of the total project. This was important
because the city had contracted to provide off-street parking for
several commercial operations being developed in their redevelopment
plan. Had the garage not opened on time, the summer season would
have been lost. This project consisted of four separate contracts, with
the main structure being a design/build contract. Mr. Guerrero handled
all tenant improvements for the commercial development.
City of Merced, Civic Center. Construction Manager/Inspector. This
three-story fa. cility was built as two separate structures, one concrete
and one structural steel.

South Bayside System Authority, Laboratory Facility. Construction
Manager (during the preconstruction and construction phases). This $2
million addition and renovation involved working with the contractor and
complex scheduling. 8,000 square feet of new laboratory was built atop
an existing wastewater treamaent facility.
City of Santa Clarita, Earthquake Recovery Program. Project
Manager.. He aided in design, bidding, and repair of all city streets that
were damaged in the January, 1994 Northridge Earthquake. In addition,
he worked in close coordination with FEIMA and OES in arranging
funds for this recovery work. Seven concurrent emergency contracts
were administered by Mr. Guerrero and his Hams team.
City of West Hollywood, Senior Center HVA C Upgrade, Hart
Park. Construction Manager. He was brought on during the desig~n
phase to establish a construction strategy. This strategy allowed the
facility to remain open during construction. This was very important
to the County as it was the only facility feeding over 200 residents
daily in the local area.
City of Carson, Veterans Community Park and Sports Facility.

management of public works and private projects. He has provided
construction management services on the following projects:
Port of Long Beach, Ocean Boulevard Reconstruction. This
$10.4 million project is part of a Federally Funded Ports Access
Demonstration Project to increase surface transportatiOn at the port.
The section of roadway is a vital link between the Port of Long
Beach and the Port of Los Angeles. The project upgrades a one-mile
section of roadway to Caltrans standards and provides the
connection to two major north-south southland freeways. The
project scope includes microtunneling 3,000 linear feet of 48-inch
reinforced concrete pipe storm drain, lowering the roadway
elevation to increase the vertical clearance under an existing
overcrossing, reconstruction and widening of the existing roadway
section, utility relocations, street lighting, and traffic signal
replacement.
Port of Long Beach, Ocean Boulevard Stormwater Pump Station.
This $4.6 million project supports the widening and storm drain
upgrades to Ocean Boulevard. The 57,000 gallons per minute pump
station includes retaining walls; reinforced concrete trans.ition
forebay; pump house building; generator building; motor control
center; pumps; motors; emergency generator; and 3,000 linear foot,
42-inch diameter, welded steel force main discharge piping.
Port of Long Beach, Gerald Desmond Bridge. Originally built in
the late 1960's, the Gerald Desmond Bridge crosses the back
shipping channel on the Long Beach side of Terminal Island, and is
one of only three highway accesses to the island. The bridge is a
steel tied-arch main span with a 500-foot wide channel crossing
providing a 160-foot vertical clearance over the shippin channel.
Approach spans are built-up steel plate girders suppored on
reinforced concrete piers. The bridge totals over one mile in length.
The project consisted of seismic retrofit and remedial fatigue
measures to the foundation and superstructure; modifying the
bridge from four to five traffic lanes; adding a sidewalk to the
outside on the existing structure; and repainting. The first
construction phase, Seismic retrofit and fatigue remediati~n has
been completed. The second phase will include the lane and
sidewalk addition. The third phase will be the cleaning and painting
of the structural steel. Construction cost of all three phases is $54
million.

Ci~' of Santa Monica, Cloverfield Boulevard Offramp attd
Widening. This project widened an off-ramp from the Santa Monica
freexvay, widened a section of Cloverfield Boulevard (a major city
arterial), and realigned the freeway frontage road. The project's
schedule included three separate phases, each of which required
close coordination with adjacent businesses and city operated
transfer and recycling center.
City of Costa Mesa, Connector "D. "This project provided a new
connector ramp between the northbound Route 55 Freeway to the
southbound Route 73 Freeway. The project included a 290-foot,
single span, cast-in-place concrete bridge, asphalt pavement
connector ramps, electrical and freeway lighting.
Central Basin Municipal Water District, Rio Hondo
Reclamation Project. Resident Engineer. This program included
the construction of over 15 miles of pressure pipeline, ranging in
size fi-om 6-inch to 36-inch, within heavily traveled city streets. A
total of 11 separate construction contract were managed, many of
which ran concurrently. The lines crossed a major eight-lane
interstate freeway and the San Gabriel River. The pipeline
alignment was within the cities of Santa Fe Springs, Whittier, Pico
Rivera, South Gate, Cudhey, Bell, Huntington Park, and portions of
Los Angeles County. The program also included construction of a
main 30-MGD pump station, a separate underground booster pump
station, pressure reducing station, and modifications to an existing
steel tank reservoir.
California State Umvers~ty, Long Beach, Forty-Niner Shops
Bookstore. This $1 million project included the renovation and
expansion of the university campus bookstore. A new retail
mezzanine was added as well as extensive HVAC modifications.
This project was completed during operation of the bookstore and
required close coordination with the campus academic schedule.
City of West Hollywood, William S. Hart Park. This $800,000
park upgrade project included the renovation of a historical
residence, actors studio, and addition of a Memorial Garden.
City of Huntington Beach, Main Street Parking Structure. This
$9.3 million project consisted ora four-level, 850 stall parking
structure and attached 37,000 square foot retail shopping complex.
Additional assignments have included research and documentation
for negotiation and resolution of construction related disputes and
claims for two separate California Department of~I'ransportation
projects on the Harbor (I- 110) Freeway.

Additiona! Experience
Prior to joining Harris, Mr. Johnson served as a facilities project
engineer for Rockwell International Corporation where he managed
multiple facility modification projects from budget estimate through
construction completion and start-up. Mr. Johnson was responsible
to establish technical design criteria, design and construction
budgets, and schedule objectives to ensure the project would
support Rockwell's research and production commitments. Mr.
Johnson conducted procurement of both professional design

Information Systems Center. This project consisted of the seismic

foot, high-bay clean room facility, which met Department of
Defense security requirements. This design-build project was
completed on schedule to support Rockwell's contractual
requirements.
Classified Document Storage Facility. This project converted an
existing office area into a secure document storage facility to'
comply with new Department of Defense requirements for storage
of all classified documents held by Rockwell's Satellite Systems
Division. The project was completed under an accelerated schedule
to avoid violating new storage criteria.
Executive Conference Room. This upgrade and expansion of the
divisional conference room increased the room's capacity and
included audio and multiple visual projection systems. Schedule
completion was critical to support senior management meetings and
marketing activities.
Computer Room Expansion. This project consisted of the
expansion of a computer room facility including raised floor, floor
mounted air conditioning units and electrical distribution. This
facility expanded into an exiting office area and required on-time
completion to support software development commitments.

serving as an inspector for this $11 million project which includes the
improvements of two interchanges that are being done in coordination
w/th the development of the Murrieta Springs Mall. Improvements to
the I- 15 consist of the widening of Murrieta Hot Springs Road
Overcrossing from two to six lanes, a new southbound loop on-ramp,
widening of the existing entrance ramps to provide two lanes at their
intersection with Murrieta Hot Springs Rd., and widening the existing
exit ramps to provide three lanes at their intersection with Murrieta Hot
Spring Rd. Improv. e.~nents to the I-215 interchange consist of widening
the Murrieta Hot Springs Road Overcrossing from two to six lanes,
two new loop on-ramps in the northwest and southeast quadrants, two
interconnected traffic signals at the off-ramp terminals, and realigning
the existing exit ramps to provide three lanes for the southbound and
four lanes for the northbound exit ramps at their intersection with

Park. Inspector. This $300,000 project built adjacent to the Fallbrook
Community Center will provide sandlot vollyball courts, a picnic shelter

Tustin, California. We understand that our services will include field observation, sampling and
testing during earthwork, aggregate base placement, trench backfill, concrete placemeni, structure
backfill, and asphalt/concrete pavement placement.
PROJECT UNDERSTANDING
We understand that the current estimated construction duration is 130 working days. We also un-
derstand that the concrete improvements will generally consist of constructing two cast-in-place
elevated platforms, one on each side of the existing tracks and a pedestrian underpass. Retaining
walls will be constructed as part of the platforms and underpass structures. Other concrete work
involves construction of a communications building, canopy foundations and concrete pavement
in the bus driveway areas. The earthwork will consist of excavations to construct the underpass,
backtilling.behind the retaining walls, surficial site grading and subgrade preparation for the park-
ing, driveway and walkway areas. Aggregate base and asphalt/concrete pavement placement, and
miscellaneous minor concrete will complete the project.

SCOPE OF SERVICES
Based on the information outlined above and our current understanding of the project, we pro-
pose the following services:
· Project coordination and management, including review 'of the project geotechnical repons,
plans, specifications and special provisions.
· Attendance at pre-construction meetings and as-needed field meetings, as requested.
Geologic/geotechnical en~neering field support to evaluate the suitability of foundation ex-
cavations and to provide recommendations for overexcavation and stabilization; if required.
Field technician services for observation, testing and documentation during earthwork, in-
cluding structure excavations, structure backfill, trench backfill, subgrade preparation, and
aggregate base placement. Our representative will test the relative compaction of the materi-
als in accordance with the project specifications.
· Field technician services for observation, sampling, testing and documentation during con-.
crete construction including the platforms, underpass, communications building, and concrete
pavement placement. Our representative will provide sampling and testing of fresh concrete,
including slump, air-content, unit weight, yield, temperature, and molding compressive
strength specimens (cylinders). Cylinders will be cured onsite for the initial 24 hours, then
transported to our laboratory for moisture curing and compressive strength testing. Samples
will be handled, cured and tested in accordance with the project specifications.
· Laboratory testing of the soil, aggregates, asphalt, and Portland cement concrete materials,
including maximum dry density/optimum moisture tests, expansion index, sieve analysis, sand
equivalent, concrete compressive strength tests, and R-value.
· Preparation of field observation reports and laboratory test data will be provided as re-
quested.
· Preparation of a final report summarizing the results of our field density tests performed and
conditions observed during earthwork.
ASSUMPTIONS
The following assumptions have been made in the preparation of our scope of services:
· We anticipate both the soils and Concrete testing services can be performed by one field tech-
nician. Assuming the contractor does not work on weekends, 130 working days is equal to
26 weeks. We anticipate our field technician services will be requested an average of 10 hours

a week for a period of 20 weeks and 20 hours a week for a peak construction period of 6
weeks for a total of 320 hours.
Project coordination and scheduling by our Field Operations Manager has been included at
one-half hour per week for 26 weeks.
Project oversight and management by our Project Engineer has been included at one-half
hour per week for 26 weeks, and 2 hours for meeting attendance.
ESTIMATED FEE
We propose to provide our geotechnical and materials testing services based on time and materials
basis in accordance with the attached Schedule' of Fees. Our estimated fee for the scope of serv-
ices described herein is approximately $27,900 (twenty seven thousand nine hundred dollars). A
detailed breakdown of our estimated fee is presented in the attached Table. 1.
Please note that our estimated fee does not include time for concrete prequalification testing, con-
crete batch plant inspection services, nor does it include time for specialty inspection services,
such as welding, non-destructive testing or concrete deputy inspection. Should these services be
needed, we can provide them on a time and materials basis. Also, our estimated fee does not in-
clude time for resampling or retesting materials that fail to meet project specifications.

OTHER CItARGES
Direct project expenses will be charged at cost plus 15 percent.
Field vehicle usage will be charged at $6 per hour.
Nuclear density gauge usage will be charged at S9 p~er hour.
Seismograph usage will be charged at $12 per hour.
Inclinometer usage will be charged at $20 per hour. -
Expert witness testimony will be charged at $190 per hour.
Overtime rates for field/laboratory technicians will be charged at 1.5 times the normal hourly
rate.
Use of special equipment and laboratory testing rates will be provided upon request.
INVOICES
Invoices will be rendered monthly unless otherwise arranged, and are payable upon receipt. A
service charge of 1.5 percent per month will be charged on accounts not paid within 30 days.
Attorney fees or other costs incurred in collecting delinquent accounts will be paid by the cli-
ent.
