HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/FIELD SERVICES SUBJECT: FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS DRILLING OF MAIN STREET WELL NO. 4 (Project No. 6103) SUMMARY This action consists of the acceptance of work and authorization of recordation of the notice of completion for the drilling of Main Street Well No. 4 (Project No. 6103). RECOMMENDATION It is recommended that the Tustin City Council adopt Resolution No. 00-20 accepting said work and authorizing the recordation of the Notice of Completion and direct the City Clerk to: o Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and , Release the Faithful Performance Bond not sooner that one year after the date of recordation of the Notice of Completion; and Assuming no other claims or stop payment notices are filed, it is further recommended that the City Council authorize payment of the retention amount, minus any amount due the Department of Industrial Relations (DIR), thirty-five days after the date of recordation of the Notice of Completion. The amount of retention currently being held is 10% of the total contract and equals $27,470.20. This amount together with previous payments of $246,761.64 represents 100% of the final contract cost. The City is currently waiting for a determination from the State Division of Industrial Relations regarding the contractor's possible failure to pay prevailing wages. The City reviewed certified payroll records from the contractor and found a discrepancy. In October 1999, the City requested that the DIR determine if the contractor had paid the current prevailing wages to a well driller. In accordance with Sections 1730-1734 of the California Labor Code, the City is required to withhold the disputed amount and turn it over to the DIR. The amount in dispute is approximately $8,100. Final Acceptance of Public Improvements Drilling of Main Street Well No. 4 (Project No. 6103) April 3, 2000 Page 2 FISCAL IMPACT The final cost of the ddlling contract is $274,231.84. This well was constructed under the Orange County Water District (OCWD) conjunctive use well construction program as authorized in the' agreement approved by the City Council on October 21, 1996. The City is reimbursed for expenses on the project as they occur. Once the well is operating, the City will repay OCWD for capital costs over the next 20 years based on an interest rate of 3.5%. DISCUSSION This project consisted of drilling a new water well at the Main Street Plant to replace Main Street Well No. 2. This work is the first part of the phased project that includes demolition of existing buildings, construction of a 2.2 million gallon reservoir, a booster pump station and a disinfection facility. This project has been completed to the satisfaction of the Public Works Department. Tim D. Serlet Director of Public Works/City Engineer TDS:JS:ccg:Final accept drilling of Main St. well fl4 & Res 00-20.doc Attachments Joe Sovella Water Services Manager 5 6 7 $ ~0 '~0 ~5 .i6 ~9 29 2'.!, 2"3 27 RESOLUTION NO. 00-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORK OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR DRILLING OF MAIN STREET WELL NO. 4 (Project No. 6103) WHEREAS, Bakersfield Well & Pump Company having a contract with the City Council to provide the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvements hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvements should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvements is found to be complete, and the same is hereby accepted. Said public works and improvements is more particularly described as follows: Drilling of Well No. 4, Project No. 6103 BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is . hereby authorized to execute and file a Notice of Completion for the Acceptance of said public works and improvements described herein as required by law.
