HUSTON, CITY MANAGER REDEVELOPMENT AGENCY STAFF PUBLIC WORKS DEPARTMENTIENGINEERING DIVISION OLD TOWN STREETSCAPE DESIGN PROJECT RECOMMENDATION It is recommended that the City Council: 1) Authorize the City Manger to enter into a Consultant Services Agreement with Urban Design Studio in the amount of $114,600.00 for engineering and design of streetscape and pedestrian enhancements on El Camino Real between Sixth Street and First Street and in two public alleys, and subject to the approval of the City Attorney; 2) Appropriate $94,600 from the City Capital Projects Fund, Fund #02 FISCAL IMPACT Services are proposed to be provided by the Urban Design Studio in the amount of $114,600. Twenty thousand dollars ($20,000) has been currently appropriated in the FY 1999-2000 Redevelopment Agency Budget (account 58600-6010). The difference between the RDA funding and the proposal cost (which is $94,600) will require an · appropriation from the City Capital Projects Fund, Fund #02. BACKGROUND On October 16, 1997 the matter of installing diagonal parking spaces on a temporary test basis in Old Town was brought before the City Council. Prior to taking any action, the City Council directed City staff to obtain additional information from the Old Town businesses about their desire for diagonal parking. This additional information was obtained, and based upon the favorable response of the Old Town community and on March 16, 1998 the City Mr. William A. Huston Old Town Streetscape Design Project May 1,2000 Page 2 Council authorized the installation of diagonal parking along a portion of El Camino Real on a temporary test basis. The test period for the diagonal parking went on for some months and on February 16, '1999 the matter was returned to the City Council for further action. At that meeting, staff was directed to prepare estimates of probable cost for the design and construction of diagonal parking spaces along E! Camino Real from First Street to 300 feet south of Sixth Street. The estimates were to include the design for and cost of permanent striping of diagonal parking spaces, and construction of end-islands design for and including landscaping, Iow level walls, and other streetscape enhancements, ongoing maintenance costs, phasing opportunities and funding sources. A Request for Proposal was solicited by City staff for the preparation of the aforementioned design work. Three firms submitted proposals. The firm of Urban Design Studio, was rated best overall by a staff committee designated to review the proposals. However, the initial proposal submitted by Urban Design Studio was thought to be too expensive for the anticipated scope of work. Urban Design Studio subsequently revised their proposal and resubmitted a revised scope of services. The following summarizes the major tasks to be accomplished by the design project: · An inventory and analysis of existing streetscape conditions in the Old Town area. · The development of preliminary design concepts achieved through the interaction between City staff and the consultant. · Preparation of a Project Report, which will graphically depict the preferred streetscape design. · Preparation of construction documents, specifications and estimates of cost. Upon acceptance of the Consultant's final design work, staff will return to the City Council for authorization of any construction project. Serlet Director of Public Works/City Engineer CONSULTANT SERVICES AGREEMENT · THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into this 1 day of May 2000. by and between the CITY OF TUSTIN, a municipal corporation, hereinafter referred to as "City", and Urban Design Studio a California corporation, hereinafter referred to as "Consultant". RECITALS WI-I]EREAS, City requires the services of a consultant to furnish the necessary engineering services for Engineering and landscape design for streetscape and pedestrian enhancements on El Camino Real between Sixth Street. and First Street and in two public alleys, hereinafter referred to as "Project"; and WHEREAS, Consultant has submitted to City a proposal dated April 13,2000 a copy of which is attached hereto, marked as Exhibit "A" and is by this reference incorporated into this Agreement; and WHEREAS, Consultant is qualified to provide the necessary services for the Project and deskes to provide said Services; and WHEREAS, City desires to retain the services of Consultant for said Project. NOW, TI-~YFREFORE, for the consideration and upon the terms and conditions hereina2er set forth, the parties agree as follows: AGREEMENT Sesdc ~ 1' Scooe of Consultant's Services. Consultant shall perform all work necessary to complete in a manner satisfactory to City, the services set forth in Exhibit "A". Section 2: Order of Precedence. In the event of a conflict between or among any of the documents comprising this Agreement, the following order to precedence shall govern the provision in question: 1. This Agreement 2. Consultant's Proposal (Exhibit "A") Section 3: Time for Completion. The time for completion of the work to be performed by Consultant is an essential condition of this Agreement. Consultant shall prosecute regularly and diligently the work of this Agreement according to reasonable schedules established by the City for various items described and as outlined within Consultant's proposal. Consultant shall not be accountable for delays in -1- the progress of its work caused by any condition beyond its control and without the fault or negligence of Consultant. Delays shall not entitle Consultant to any additional compensation · regardless of the party responsible for the delay. Section 4: Compensation. mo The compensation to be paid under this Agreement shall be as set forth in Exhibit "A", not t° exceed a total cost oft114,600.00. Bo Consultant shall submit detailed invoices, based upon the actual work performed accompanied by backup documentation as requested by the City. Co Progress payments for work completed shall be paid by City as the work progresses, within thi~y (30) days of the date of Consultant's invoice. Consultant slnall provide City with a monthly itemization of all work performed, and the fees accrued thereon, in complete and sufficient detail to fully apprise City thereof. Sec~59n 5: Independent Contractor. Consukant's relationship to City in the performance of this Agreement is that of an independent contractor. Consultant's personnel performing services under this Agreement shall at all times be under Consukant's exclusive direction and control and shall be employees of Consultant and not employees of City. Consultant shall pay all wages, salaries and other amounts due its employees in connection with this Agreement and shall be responsible for all repons and obligations respecting them, such as social security, income tax withholding, unemployment compensation, workers' compensation and similar matters. Section 6: Iademn:~fication. Consultant agrees to indemnify, defend and hold City, its officers, agents, employees, successors and assigns harmless from any loss, damage, injury, sic'kness, death, or other claim made by any person and from all costs, expenses and charges including attorney's fees caused by or arising out of Consultant's, its officers', agents', subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or willful misconduct, or conduct for which the law imposes strict liability on Consukant in the performance or failure to perform this A~eement. Section 7: Lqsurance. mo Consultant shall maintain in full force and effect during the term of this Agreement policies of comprehensive general liability, personal injury and automobile liability insurance with limits of at least $1,000,000 combined single limit coverage per occurrence. Bo Consultant shall maintain in full force and effect during the term of this Agreement a policy of professional liability insurance coverage with limits of at least $1,000,000 combined single limit coverage per claim or per occurrence. If Consultant provides -2- claims made profesSional liability insurance, Consultant shall also agree in writing either (1) to purchase tail insurance in the amount required by this Agreement or to cover claims made within five (5) years of the completion of Consultant's service under this Agreement, or (2) to maintain professional liability insurance coverage with the same carrier in the amount required by this Agreement for at least five (5) years after completion of Consultant's services under this Agreement. Consultant shall also provide evidence to the City of the purchase of the required tail insurance or continuation of the professional liability policy by executing the attached Letter Agreement on Consultant's letterhead. Co Consultant shall carry and pay for such compensation insurance as is necessary to fully protect Consultant and its employees under California Worker's Compensation .Insurance and Safety Laws, and shall relieve the City from all responsibility under said laws in connection wkh the performance of this Agreement. ,MI insurance required pursuant to this Section shall be issued by a company admitted in the State of California and rated A, VII or better by the latest edition of Best's Key Rating Guide. Upon execution of this Agreement, Consultant shall provide to City certificates of insurance on the City's form evidencing the required insurance. If self-insured for worker's compensation, Consultant shall submit to City a copy of its certification of self- insurance issued by the Department of Industrial Relations. Section 8: Termination of Agreement. m. City shall have the right to terminate any or all of the services covered by this Agreement at any time for any reason by giving written notice to Consultant. B. Upon termination of this Agreement, Consultant shall be paid for services rendered by the effective date of the termination. Co Upon termination of this Agreement or completion of the project, all documents relating to the Project shall become the sole property of City. Should City terminate this Agreement pursuant to subparagraph A. of this Section, Consultant shall, within ten (10) business days of receipt of notice of termination, provide City with all documents within Consukant's possession relating to this Agreement and the Project, including but not limited to all completed documents and all drains of uncompleted documents. A. Consultant skall proceed immediately and diligently to perform the services provided for in this A~eernent upon receipt of notice from City to proceed therewith. B. No part of this Agreement may be assigned by Consultant without the prior written approval of City. Co This Agreement shall extend to and be binding upon and inure to the benefit of heirs, executors, administrators, successors and assi~oxts of the respective parties hereto. Consultant shall perform all services required under this Agreement using that degree of care and skill ordinarily exercised under similar conditions in similar localities, and shall be responsible for all errors and omissions for services performed by Consultant under the terms of this Agreement. Jeffrey, City Attorney "'CONSULTANT" By -5- Scope of Work Our Scope of Services is ordered in a logical series of steps and products. They will interrelate from one product to the other and will result in a comprehensive urban design approach for the future of Tustin's Downtown. A. PHASE ! TASK 1.0 -INVENTORY AND ANALYSIS OF THE DOWNTOWN AREA A thorough analysis of existing conditions is central to an urban design streetscape program. This analysis will familiarize Urban Design Studic with a detailed, firsthand knowledge of El Caminc Real (be::ween Sixth and First Street) and the two alleys, its users, plans, existing problems, etc. TASK I.I - STAFF KICKO'FF MEETING UDS will meet for two hours with City Planning, Public Works and Parks Staff to discuss the project, set schedule milestones, set workshop meeting days and generally discuss the events that have occurred to date. Staff will give consultant all background studies, reports and any other pertinent information. TASK 1.2- FIELD RECONNAISSANCE A walking field reconnaissance of the Downtown will be conducted. Particular note will be given to sidewalk and parkway locations, condition, actual land use, user relationships, existing streetscape material, utilities, landscape, right-of-way, public signage systems, site utilization, and general observation. Video equipment will likely be used to assist our design team in reacquainting themselves with certain areas at critical design junctures. We strongly encourage the Staff to join us on the Reconnaissance. TASK 1.3-DOCUMENT/ PLAN/REPORT REVIEW Urban Design Studio will review all transmitted background information (identified by the City)in order to gain abetter understanding of the project's parameters. TASK 1,4- SURVEY ©UALI~ BASE NAPS Due to the need for specific topographic information to assist engineers with calculating drainage information, RBF will prepare Design Quality topographic maps in a format preferred by the City TASK 1.5 - EXISTING STREETSCAPE CONDITIONS AND OPPORTUNITIES MAP GRAPHIC This step will identify and evaluate existing conditions and planning opportunities that should be addressed in the Conceptual Design Program,as it will include findings from technical reviews, field investigations and interviews/ discussions with City representatives. Information may include: Curbs Gutters and drainage Irrigation facilities Suggested existing material removals Utility constraints DowntoWn Streetscape Program City of Tustin Page A-2 Revised 4/I 3/00 Scope of Work TASK 2.0- STAFF CHAR, E"T-TE AND PRELIMINARY DESIGNS TASK 2. I - DEVELOP PRELIMINARY DESIGN CONCEPTS Urban Design Studio, following input from the initial Staff Meeting, will begin development of design concepts for public improvements. These may include: Diagonal parking end islands Sidewalk treatments/alley treatments / ~,'.~r.~n~,,'~*,--.-, tm" treatments Tree wells Walls/planters The City has stated that they are very focused ss to the design of the streetscape improvements. A lengthy selection process will not be necessary. Plan view sketches. TASK 2.2 - STREET TREE CONSIDERATIONS MATRIX Urban Design Studio will create a matrix of desirable street tree qualities deemed important by the City and property owners. It is recommended that a semi-uniform plan, which utilizes a primary and secondary roadway tree(s), be selected from this matrix. The criteria on the matrix may include: Non evasive root system Ability to provide shade Ability to see commercial signage through canopy Performance under urban conditions Maintenance Appropriate size when furl grown Drought tolerance Safety for pedestrians (i.e., thorns, droppings, etc.) Cost/installation Relationship to significant existing vegetation The matrix is an in-house tool to be utilized by Staff and UDS. It is not intended for public distribution. Alternatives will be discussed with Staff, prior to a product being submitted. TASK 2.3 - DEVELOP SCHEMATIC LANDSCAPE DESIGNS Urban Design Studio will take the preferred landscape/ tree alternatives created in the previous task and will schematically depict the streetscape/parkway/safe cross on a block-by- block basis or a parkway prototype basis. Location and spacing will be depicted in a plan and section view drawing. Conceptual designs will include: ,:o Landscape and hardscape design elements within end islands o:, Tree well lighting design, if desired. °,,, Alley enhancements of TASK 2.4 - STREET & INTERSECTION PAVING TREATMENTS We know that significant work has already been done. Urban Design Studio will not prepare paving schemes for any major and minor intersections and crosswalks in the area. Paving materials, arrangements, colors and configurations will be per existing conditions. TASK 7_..5 - SIDEWALK/ALLEY TREATMENTS Urban Design Studio will review and recommend any sidewalk improvements which might be desirable in the alleys. Plans will be depicted in plan view illustrations. Consideration will be given to sidewalks/alleys considered high activity or as image/theme setters and to sidewalks in areas of lower impact. Therefore design treatments may vary from location to location. Due to the limited fee for trees, UDS will submit drawings in colored plan view graphics and does not anticipate extensive modifiCations. TASK 2.6 - ENTRY SIGNING/ WAYF. INDING/PUBLIC SIGNAGE Urban Design Studio will prepare entry signs as well as a conceptual public signage program. Concepts will be depicted in a color elevation view drawing. The narrow focus of this design work will be limited to: Monument signs as part of iow walls Pubfic signs Pole signs Special art Note: We understand that conceptual drawings done previously by UDS may be available. Street lighting (street, median and sidewalk) Bollards Tree grates and guards Benches Trash receptacles Planters News racks Kiosks Bus shelters Due to the very focused design parameters, we will not have a lengthy selection process as is typical. Therefore, UDS will make the selections and submit those to the City staff. If City staff chooses to suggest modifications after UDS submits this product, it will be necessary for City staff to make a specific alternative design. TASK 2.7 - STREET FURNITURE PALETTE Urban Design Studio will select desirable street furniture qualities deemed important by the City and property owners. Furniture to be selected may include: Downtown Streetscape Program City of Tustin Page A-4 Revised 4/I 3/00 IAI Scope of Work TASK 3.0 - PRELIMINARY PLAN REVIEWS AND MODIFICATIONS Prior to the finalization of the Conceptual/Schematic Design Phase, it is imperative to provide different groups an opportunity to provide initial input. TASK 3. I - STAFF REVIEWS Urban Design Studio will conduct two meetings with this body during this Phase. The subject of this meeting will be to review the preliminary streetscape plans. TASK 3.4 - DEVELOP ROUGH COSTS Urban Design Studio will develop rough order of magnitude costs for major Capital Improvements as endorsed by the Council/Agency. Also, ongoing annual maintenance costs will be developed. TASK 3.2_ - DESIGN' IVlODIFICATIONS Based upon final direction Provided by City Staff, Urban Design Studio will make modifications to the schematic landscape designs. These plans will be colored for a final round of reviews. Includes one round of modifications. We anticipate that the amount of modifications required for the selected design will not be that substantial. Therefore, only one round of modifications is proposed. TASK 3.3 - TUSTIN OLD TOWN ASSOCIATION REVIEW MEETING The cniy presentation that Urban Design Studio would be required to make would be to the Tustin Old Town Association. Downtown Streetscape Program City of Tustin Page A-5 Revised 4/I 3~00 Scope of Work TASK 4.0- PRO!ECT REPORT Following input from a variety of sources on the preliminary plans, Urban Design Studio will initiate the final plan document. TASK 4. I - DRAFT REPORT Urban Design Studio will graphically depict the preferred streetscape/parking designs on a block-by-block or parkway prototype basis. All aspects of location, spacing, materials and specifications will be included on the drawings. All plans will be in color and depicted in a plan view drawing with corresponding text specifications regarding vendors, quantities, costs, phasing, and funding sources. No mcdifications fr(~m Task 2.3 final design are anticipated. TASK 4.2 - STAFF REVIEW OF DRAFT REPORT UDS will prepare a draft for City reproduction and distribution to the Staff PRIOR to a meeting with them. The meeting will be used for receiving input and suggested modifications. TASK 4.3 - (Deleted) TASK 4.5 -CAPITAL AND MAINTENANCE COSTS UDS will prepare a matrix of capital and annual maintenance costs for all selected streetscape elements. TASK 4.6- PHASING/ SCHEDULING Once funding sources, and amounts have been established, UDS will prepare a phasing/scheduling program. TASK 4.7 - (Deleted) TASK 4.4 - FINAL REPORTS Urban Design Studio will have all recommended design improvement drawings reduced to a size of 8 1/2" x 11" or 11" x 17" for inclusion in the Final Report. Five copies of the report plus a camera ready original will be submitted. Also, an electronic version will be transmitted. PHASE il TASK. 5,0 STREETSCAPE CONSTRUCTION DOCUMENTS/SPECIFICATIONS AND ESTIMATE OF CONSTRUCTION COSTS Urban Design Studio/RBF proposes to provide professional landscape architecture and engineering services to prepare construction documants, specifications and estimates in sufficient detail to facilitate public bidding and successful construction of the approved Streetscape Program. The drawings will be prepared by a California licenced landscape architect and engineer and will be presented to the City for their review, comment and approval. These plans will be prepared for El Camino Real between First Street and Sixth Street. As stated in the City's RFP, it is anticipated that the construction documents will include, but not be limited to, details related to the removal of existing concrete for new tree wells, installation of safe crosses, diagonal parking, and paving-the entire streetscape program, including calculation of all mainline and lateral pipe sizes for the irrigation system as well as electrical and water service connections. All construction drawings will be in CADD format and produced on one set of mylars for City reoords. TASK 5. I - BASE SHEET PREPARATION For the purposes of this proposal, it is assumed that Urban Design Studio/RBF has prepared, 20-scale base plans. Hard copies and electronic CADD files, if available, will be transmitted. UDS will prepare custom base sheets with title blocks, professional seals, and legends as necessary and required by the City. TASK 5.2- STREET IMPROVEMENT PLANS UDS\RBF shall utilize the approved preliminary plans as a base for completing the final plans. The plans will be completed at 1"=40' scale and will consist of a title sheet and roadway improvement plans. Consultant shall identify locations of curb access ramps necessary to meet ADA requirements on the parking end islands. Standard Plans or unique details will be included as a part of the Bid Documents to provide the Contractor direction regarding construction of ramps. It is anticipated that four (4) plan sheets will be required to adequately depict the construction area and to identify the street improvements. Consultant may. also include "soft conversions" of Imperial Units to Metric Units for dimensions shown on the plans for Caltrans. It is also anticipated that UDS orthe City will provide record drawings for the street improvements which the Consultant can utilize to prepare base maps. Necessary construction details will be included on the Street Improvement Plans. Downtown Streetscape Program . City of Tustin Page A-7 Revised 4/13/00 Scope o f Work TASK 5.3 - LAYOUT, HARDSCAPE CONSTRUCTION PLANS TASK 5.4 - ELECTRICAL AND LIGHTING PLANS UDS will prepare details and plans appropriate to accurately construct and install all hardscape, landscape and street improvement plan elements. The plans will include: -,'o tree weft design -,°o landscape and softscape design of parking and islands ¢o street furniture amenities ¢o tree plantings/tree wells ¢. de~.orative paving (street, alley, walkway) -;o afie y It is assumed that the decorative paving areas will be custom items to be designed by UDS. It is assumed that the City will provide structural section design recommendations for all pedestrian and vehicular decorative pavement areas for inclusion into the CD documents. It is anticipated that all other items will be standard or special items available from local manufacturers versus one-of-a-kind custom designed elements. It is possible that the streetscape enhancements may be increased based upon City, public, and design team recommendations at the conceptual design phase. UDS will inform the City of design features which may increase design time subsequently requiring professional services outside of this scope of work. UDS will obtain City approval of such extra work/fees prior to design at the construction document phase. In our opinion it would be a wasted effort not to include a potential provision for new lights and electrical power at the base of each tree well. This allows for future tree uplighting or holiday "twinkle" lighting. UDS/RBF will provide coordination with the City and utility companies and will prepare plans, details and schedules for installation of decorative uplighting and holidaytwinkle lighting. The plans will include: ¢o electric meters and pedestals ¢o conduit ¢o undercrossing sleeves ¢o wiring ¢, fixtures It is assumed 'that all new street lights will be done by SCE. Power poles and traffic control devices will be protected in place. TASK 5.5 - GRAPHIC PACKAGE PLANS. SPECIFICATIONS AND COST ESTIMATES Urban Design Studio will prepare plans, specifications and capital coSt estimateS for graphics package elements, including color palette, type face and design for all lettering, "Plans" are intended to be location plan plus "Design Intent" drawings for each type with construction specifications suitable for bidding and implementation by qualified fabricators. Downtown Stree*~cape Program City of Tustin Page A-8 Revised ~/I 3/0© Scope of Work TASK 5.6 - PLANTING PLANS UDS will prepare landscape planting plans for the end islands. The plans will indicate the species, size, quantity, and location of all trees, groundcover, and shrubs along with appropriate detail callouts, notes, and legends. Any furniture providing landscape support, such as tree grates, guards, root barriers, and planters shall also be detailed and referenced on the planting plans for clarity. TASK 5.7 -IRRIGATION PLANS The Irrigation Plans shall conform to the City's maintenance departments requirements and the local water district requirements. The plan shall indicate all heads, lateral lines, valves, sleeving, detail callouts, mainline., controllers, miscellaneous irriga:ion devices, and legends. The design will maximize efficiency and minimize runoff and maintenance 'costs. TASK 5.8 - PUBLIC UTILITY/SERVICE PLAN Consultant shall issue utility notifiCations to the various utility owners within the sphere of the Project. Consultant shall request locations for existing and proposed utilities. Provide coordination interface to establish controls for utilities that would be included within the right-of- way limits, identify agencies responsible for the design .and construction or relocation of said utilities and contact each agency to determine what utilities are needed. Identify and coordinate with utility companies affected by the Project. Delineate utilities within the sphere of the Project on the Project base maps. Prepare and issue appropriate utility notifications and perform related follow-up. Tasks include: Utility Information Request: Ask utility companies for location, size, etc., of their facilities within the Project limits. This notice is forwarded concurrently with commencement of design. Prepare to Relocate Notice: In the event that existing utilities are present within the limits of the Project, transmit notice and preliminary plans to the affected utility agencies to determine the magnitude of the relocation, schedules, and further coordination requirements. Notice to Relocate: Prior to Project bidding, transmit notice and approved Project plans to affected agencies to determine the magnitude of the relocation, schedules and further coordination requirements. Utility Information Documentation: Documenting existing and future utilities and identification of ne.cessary process for design, relocation or protection for utilities. Consultant shall prepare 100-scale utility plans to show location of all utilities to be included within the project site. Detailed design plans will be prepared for the following utilities. Waterline Alignment: Consultant shall show the alignment of the existing waterlines along El Camino Real. Consultant shall coordinate with the local Water District to locate the points of connection for the irrigation system. Dry Utility (Electrical, Gas, Cable TV, Telephone): Consultant shall show utility location of dry utilities on the project improvement plans based upon the information provided by the utility owner. Consultant shall coordinate with the serving electrical utility to locate the points of connection for tree lighting(if appropriate) and the irrigation system. AND ESTIMATE OF PROBABLE CONSTRUCTION COSTS The technical specifications for the construction documents shall be prepared in the City of Tustin format and shall incorporate the bid form and City supplied boilerplate details as necessary. The Estimate of Probable Construction Costs shall be developed for the final set of construction drawings. TASK 5.10 - CONSTRUCTION PHASING PLAN (OPTIONAL) Consultant shall prepare one (1) construction phasing plan to identify the construction phases. It is anticipated that all traffic control can be implemented in accordance with the W.A,T.C,H. Manual and a specific traffic handling/detour plan is not included as a part of this Scope of work. TASK 5.11 - PERMITS/WRITTEN APPROVALS (OPTIONAL) Consultant shall secure appropriate approvals from property owners as required to obtain an encroachment permit or easement. Consultant shall submit preliminary form or letter to City for comments to be incorporated into the final document. Consultant shall meet with City to review the comments and incorporate them into the forms or letters as necessary prior to submitting the forms or letters topography owners. TASK 5.12 - BID PROCESS ASSISTANCE (OPTIONAL) Consultant shall assist the City as requested during the bid process to answer questions 'relating to interpretation of the construction documents. Consultant shall also assist in the production and distribution of any contract addenda to clarify the bid documents that may be requested by the City. For budgetary purposes, 13 man-hours have been allocated to this task. TASK 5.13 - PRINTING AND REIMBURSABLE ITEMS This task is intended to hold a line item in the budget for project printing costs and reimbursable expenses.
