ITEM # 4 AGENDA REPORTs� MEETING DATE: JANUARY 22, 2013 TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: COMMUNITY DEVELOPMENT DEPARTMENT 2012 YEAR IN REVIEW RECOMMENDATION: That the Planning Commission receive and file the report. DISCUSSION: Throughout the year, staff provides the Planning Commission with a status of projects that the Planning Commission, Zoning Administrator, or Community Development Director approved; major improvement projects; and other items of interest. The Community Development Department 2012 Year in Review summarizes the Community Development Department's activity throughout 2012 including discretionary permits processed and approved (i.e. Conditional Use Permits, Design Reviews, Subdivision Maps, etc.), major accomplishments for various functional areas within the Department, Code Enforcement activities, and Building Division activities. Attachment: Community Development Department 2012 Year in Review Community Development Department Year in Review 2012 Report to the Planning Commission Current Planning In 2012, the Community Development Department processed various development applications. Projects currently in progress or completed in 2012 include: • Toyota Auto Dealership (36 Auto Center Drive): Tustin Toyota is now occupying the former Joe's Garage building. Construction is complete and the dealership is in operation. • Hyundai Auto Dealership (16 Auto Center Drive): Hyundai acquired the former Tustin Chevrolet dealership location. The Hyundai dealership tenant improvements have been completed, and it is now open for business. 1-911 LA Tustin Hyundai Auto Dealership Tustin Toyota Auto Dealership • Wood Market (14551 Red Hill Avenue): Woori Market, offering a combination of Japanese and Korean groceries along with a food market, is now open for business. C • Old Town Mixed -Use Building (170 EI Camino Real): A conditional use permit and design review were approved for the construction of a three-story mixed-use building, including commercial, office, and residential uses. Tenant improvements for the beauty salon on the first floor of the building are at the drywall stage. The second and third floors are complete and occupied. • Granada Plaza (17291 Irvine Blvd.): Reconstruction of the burned -down two- story office building at Irvine Boulevard and Yorba Street is currently in the final stage of completion, and a Temporary Certificate of Occupancy has been issued. On January 17, 2013, the plaza had a grand opening and ribbon cutting ceremony. • Aria International Supermarket (2505 EI Camino Real): Aria International Market replaced the former Sears/Kmart. The supermarket offers a variety of produce, meat, hot food. Granada Plaza Aria International Supermarket D • Cream Pan Bakery (690 EI Camino Real): Cream Pan Bakery underwent the process of providing outdoor seating and reconfiguring its kitchen area. Tenant improvements are now complete. • New Carwash Facility (3017 Edinger Avenue): The addition of an express carwash to an existing 76 service station has been completed and is open for business. The carwash tunnel design is modeled after the Tustin Blimp Hangars. 1:3 Tustin Medical Arts Center (13362, 13372, 13422 Newport Avenue, & 1101 Bryan Avenue): In February Express Carwash 2012, the Planning Commission approved a request to subdivide three (3) medical office parcels into four (4) separate parcels and 39 units for condominium purposes. The project also included a conditional use permit for joint -use parking. Plans are being prepared for the final parcel map submittal. • Archie's Ice Cream (12932 Newport Avenue): Tenant improvements for Archie's Ice Cream next to Trader Joe's have been completed. The location is now open for business. • New Mixed -Use Development (125 W. Main Street): A proposal was approved for the construction of a new mixed-use development including a restaurant, office, and residential uses. The grading plan is in plan check and a request for a Lot Line Adjustment has been submitted to combine the lots into one parcel. The Community Development Department is awaiting the submittal of structural plans. 125 W. Main Design Proposal C • The Lost Bean Coffee & Tea (13011 Newport Avenue): The expansion of The Lost Bean Coffee & Tea in Plaza Lafayette has been completed. • New Commercial Building (195 EI Camino Real): The Planning Commission approved a design review to construct a new 3,291 square foot commercial building to be occupied by a jewelry store and a coffee shop. The architectural/building plans are currently in plan check. • Goodwill Industries of Orange County (502 E. First Street): A request was approved to operate a retail store selling new and used merchandise and clothing with an ancillary donation area within an existing tenant space. Interior demolition is currently underway and tenant improvement plans have been submitted for plan check review. Construction is anticipated to commence in the first quarter of 2013. • Oxford Tutoring (3057 Edinger Avenue): In November 2012, the Planning Commission approved a request to operate a tutoring center within an existing tenant space at the subject property. No tenant improvements are proposed with this project and the business should be operating in the coming weeks. • Wilcox Manor (310 S. Pasadena Avenue): The Planning Commission recommended approval to City Council for the applicant to hold a total of 24 outdoor events per year. The project has been continued at the request of the applicant, and is scheduled for a public hearing before City Council on September 17, 2013. • Mixed -Use Hotel Project (Southwest corner of Newport Avenue & Edinger N Avenue): A request was approved to develop a mixed-use hotel project. The o CN project includes hotel, restaurant, and retail uses. The Fairfield Inn and Marriott Suites structures are under construction. Plans are currently being prepared for the retail building on the site. Fairfield Inn and Marriott Suites Construction • Vintage Lady (434 EI Camino Real): Plans to rebuild the burned retail building have been submitted for plan check. • Kiddie Academy Daycare (14501 Newport Avenue): The Planning Commission approved a request to demolish an existing building and tennis courts, and construct a new child-care facility. The Planning Commission approved the project on December 11, 2012, contingent on City Council approval of a parking code update. • Kaku Casual Bistro (1150 Irvine Boulevard): A new restaurant with alcoholic beverage sales was approved and is in the process of locating adjacent to Cafe Rio in the Tustin Heights Center. The project is under construction. • 24 -Hour Convenience Store (13842 Newport Avenue): In October 2011, the establishment and operation a 24-hour 7 -Eleven convenience store at the subject location was approved. The store opened for business this year. 24 -Hour 7 -Eleven • The Zoning Administrator approved the following projects: o Groundwater Remediation (535 E. Main Street): A conditional use permit was approved to allow temporary groundwater remediation activities for a period of two (2) years. The groundwater remediation equipment was installed and is currently operating. o Guest House (445 W. Main): The Zoning Administrator approved a request to develop a guest house on an existing residential property; however, the applicant appealed the approval based on his objection to the deed restriction requirement. The Planning Commission upheld the C approval of the project based on the original conditions of approval. The applicant has since indicated that he does not plan to proceed with the guest house at this time. o Florist Shop (155 W. First Street): A request was approved to construct a new 2,244 square foot, 2 -story retail and office structure with eight (8) on-site parking stalls. Structural plans have been submitted and are under review. ZO Florist Shop Design Proposal o Springfield College (17542 17th Street, Suite 200): The operation of an instructional school with a maximum 200 students in an existing 14,919 square foot tenant space was approved. The project is now complete. o Recycling Facility (1022-1112 Walnut Avenue & 14510-14520 Newport Avenue): The establishment and operation of a recycling facility (bulk vending machine) in conjunction with the existing R -Ranch Market located in Park Lane Plaza was approved. The facility is currently under construction. o The Dogsland (3065 Edinger Avenue): In December of 2012, a request was approved for a dog grooming, daycare, and boarding services business to operate in an existing tenant space in Jamboree Plaza. Staff is awaiting the submittal of tenant improvement plans. • Tennant improvements for new businesses at the District include: o Capriotti's Sandwich Shop (2487 Park Avenue) o Red Robin (2667 Park Avenue) o Lunna Rossa Ristorante (2449 Park Avenue) o Flame Broiler (2419 Park Avenue) O'� • Tenant improvements for new businesses in Tustin Plaza include: o Fusion Tea Bar (13771 Newport Avenue) o Jersey Mike's Subs (13681 Newport Avenue) • Tenant improvements for new businesses in The Market Place include: o Famous Footwear (2821 EI Camino Real) o CorePower Yoga (2872 EI Camino Real) • Tenant improvements for new businesses in Old Town Tustin include: o Dapper 401 (401 EI Camino Real) o Johnny Jeans (403 EI Camino Real) o Platinum Ink (692 EI Camino Real) Dapper 401 (top) Johnny Jeans (bottom) Current Planning updates specific to the Tustin Legacy area include: • Master Developer: The City Council has approved a Disposition Strategy having the City to assume a limited Master Developer role by marketing Disposition Packages (smaller development sites). RFPs for certain development sites have been released. The following projects have been authorized by the City Council: o The Irvine Company Apartment Development (Legacy Disposition Package 2A): On October 30, 2012, the City Council approved the development of 533 residential apartment units. The Irvine Company has executed the required Disposition and Development Agreement (DDA), Development Agreement (DA), and Agreement to Conditions. Plans are anticipated to be submitted for plan check in the spring. Vim- of F—t Pt; C o St. Anton Partners Apartment Development (Legacy Disposition Package 1A -North): On October 30, 2012, the City Council approved the development of 225 affordable multi -family residential apartment units. St. Anton Partners has executed the required Disposition and Development Agreement (DDA), Development Agreement (DA), and Agreement to Conditions. Plans are anticipated to be submitted for plan check in the spring. o The Council approved an Exclusive Agreement to Negotiate with Standard Pacific Homes as the developer for the for -sale residential site 1 B. Approximately 235 homes will be built at Disposition Parcel 1 B. o The City Council recently approved an Exclusive Agreement to Negotiate with Regency Centers for a commercial development at site 1 C located at the southeast corner of Kensington and Edinger Avenue. CITY 6F tes A Early Development Opportunity Sites �J • Columbus Square: Construction is progressing at the Columbus Square community. The following are updates related to each development: o Mirabella: The development of 60 attached townhomes at the Mirabella site is complete and Certificates of Occupancy have been issued. o Augusta (formerly Astoria): The development of 64 detached single family homes is in the final phase of construction, and the models will be converted for occupancy. • Columbus Grove: The last remaining development of Ainsley Park (84 duplex units) is complete. All units have been finaled and sold. • Fire Station 37 (Relocation): Design of Fire Station 37 has been completed. The bidding of plans and specifications, and the opening of bids, has been completed. The project is expected to begin construction in February 2013, and to be completed by the beginning of 2014. • The District at Tustin Legacy: Vestar Development Company together with the U.S. Army Reserves are in the process of exchanging properties to accommodate a new parking area for the District at Tustin Legacy. Two Specific Plan Amendments were initiated in 2012, and are outlined as follows: • MCAS Tustin (SPA 2011-04): Specific Plan Amendment 2011-04 to increase the allowable number of rental units (max. thirty (30) percent), allows transfer of residential units and non-residential square footages between planning areas, eliminates a 9 -acre park from neighborhood E, requires the execution of a development agreement prior to or concurrent with City approval of any development project, and implements other minor text amendments to the MCAS Tustin Specific Plan. • First Street Specific Plan Amendment (SPA 2012-001): After recommendation by the Planning Commission, the City Council adopted Ordinance 1414 approving Specific Plan Amendment 2012-001. Generally, the First Street Specific Plan Amendment sought to: o Address residential uses; o Eliminate expansion areas; o Eliminate the hopscotch zoning pattern of primary uses so that retail and office uses can occur anywhere in the District; o List auto repair as a conditionally permitted use; o Update parking, development and use regulations; o Revise First Street Specific Plan boundaries to include or exclude entire properties; o Eliminate references to the Community Redevelopment Agency; �'o o Eliminate the First Street Specific Plan's two-tier system of supporting primary uses and discouraging secondary uses, and; o Update the First Street Specific Plan Design Guidelines. Three General Plan Amendments were approved in 2012, and are outlined as follows: • Conservation/Open Space/Recreation Element (GPA 2011-01): General Plan Amendment 2011-01 updated existing parks and recreation facilities inventory, updated proposed parks and recreational facilities, updated parks descriptions, and other minor text amendments. • First Street General Plan Amendment (GPA 2012-001): General Plan Amendment 2012-01 was prepared in support of the proposed amendment of the First Street Specific Plan, and was adopted along with the First Street Specific Plan. It involved minor amendments to the text, and map updates to the Tustin General Plan that are consistent with amendments to the First Street Specific Plan. General Plan Amendment 2012-001 also incorporated minor text amendments requested by the Orange County Airport Land Use Commission, and reflects the City's current sphere of influence as approved by the Orange County Local Agency Formation Commission. It also introduced a digital General Plan Land Use Map which presents existing general plan designations in an updated format. • Red Hill Lutheran Church (GPA 2012-002): The City Council approved General Plan Amendment 2012-002 along with a zone change and conditional use permit allowing Red Hill Lutheran Church to convert existing residences adjacent to the church into parsonages for church members, and permit a storage area and a youth center. Plans have been submitted for plan check. Peter's Parish at Red Hill Lutheran Church The following Code Amendments were processed in 2012: Zoning Code/Zoning Map (CA 2012-001): It was recognized that certain, older portions of the Tustin Zoning Code did not consistently reference the abbreviated Zoning District title utilized in the Tustin Zoning Map. Specifically, certain code sections adopted in the 1960's utilized a hyphenated Zoning District abbreviation (e.g. R-1, R-2, etc.). Based on the need to establish consistency between the Zoning Code and Zoning Map, this amendment was presented to the Planning AMR Commission and subsequently approved by the City Council. , • Old Town Parking Exception (CA 2012- 002): Ordinance No. 1416 was adopted by City Council establishing a new parking exception option that allows all or a portion of a project's required on-site parking spaces to be met through the payment of an annual $60 fee intended to compensate the City for the proportional use and maintenance of public parking. o1 DN Parking Code (CA 2012-003): The Planning Commission recommended this code amendment for approval to the City - --- p Council and it will be considered at the Council's January 15, 2013, meeting. Code Amendment (CA) 2012-03 includes amendments to the Part 6 Off -Street Parking section of the Tustin City Code. The text amendments involve revisions to parking requirements and regulations to strengthen and clarify the off-street parking standards and ensure consistency with the goals and objectives of the General Plan. • Parking Option (CA 2012-004): This code amendment update went along with an approved conditional use permit, design review, zone change, and minor adjustment for Kiddie Academy Daycare. CA 2012-004 would allow the option of a parking ratio of one (1) space per ten (10) children with adequate drop off/pick up area. This item will be considered by City Council at their January 15, 2013 meeting. U11 6 . During 2012, Community Development Department Staff prepared multiple workshops for the Planning Commission. The 2012 advanced planning developments and special projects include: • In April of 2012, the City Council voted to approve a special project to update the Residential Design Guidelines for the Cultural Resources District. The new guidelines have updated photos and graphics, it addressed adaptive reuse, clarified types of architectural styles, and corrected outdated information. City of Tustin CULTURAL RESOURCES DISTRICT RESIDENTIAL DESIGN GUIDELINES • Previously in 2011, the City Council approved a policy for construction and business license fee waivers. The purpose of this policy was to encourage residential and commercial development within the City, attract new businesses, retain existing businesses, and encourage improvements, thereby benefiting the entire community. At the exhaustion of funds in 2012, the Construction Permit Fee Waiver Program waived a total of $400,000 in fees which included 500 plan checks and/or permits. The Business License Fee Waiver Program waived a total of $313,104 in fees and includes 5,350 renewed business licenses and 1,045 new business licenses. • Administered the City's historic preservation program as described in the 2012 Certified Local Government Annual Report (Attachment A). 13 • Continued the Mills Act Contract program and monitored all 16 contracts for the following locations: 178 N. B Street • Prepared the General Plan Annual Report, which is a progress report to the City Council on the status of the City's General Plan and the progress on its implementation, including the progress in meeting the share of regional housing needs and efforts to remove government constraints to housing development, maintenance, and improvement as required by State Law. • Reviewed and prepared environmental documents and prepared comments for significant projects throughout the county. • Administered the AB 2766 Vehicle Subvention Fee Program. During 2012, the following project was funded: o Rail Station Parking Structure Maintenance - $90,000 • Monitored and reviewed the John Wayne Airport Noise Abatement Report and Program to ensure compliance with airport/city noise standards. • Monitored the implementation of Assembly Bill No. 32 and Senate Bill No. 375. • Prepared residential activity reports, compiled demographic forecast data, and reviewed Census 2010 data. • The City received an annual allocation of $587,277 from the federal Department of Housing and Urban Development (HUD) under the Community Development Block Grant (CDBG) program for the Program Year 2012-13. The following statistics and charts describe Code Enforcement Activity for 2012: • A total of 249 cases were opened in 2012. This represents a 39% reduction in formal code cases due to the use of tear -away notices for minor property maintenance, trash cart placement, and business licenses. • Code Enforcement Officers, Police Safety Officers, and the City's graffiti removal contractor actively responded to and removed a total of 4,811 incidents of graffiti. This is a 7% increase from last year. Monthly spending for graffiti removal during 2012 can be seen on the chart below represented by the orange and black bars. This represents a 35% increase in items removed compared to 2011. • The administrative citations program has continued to assist Code Enforcement Officers and Police Officers in resolving code violations in a timely manner. A link on the City's website provides general information and access to online payment information for the public. Thirty-eight (38) citations were issued in 2012, with twenty (20) citations currently open, and eighteen (18) closed. 17 Building Division The Building Division handles the application of building and grading permits, performs plan reviews and issues permits, performs inspections during construction, coordinates with the Fire Authority and various utility companies, and other regulatory agencies such the State Department of Health Services, the Orange County Health Care Agency, Public Works Department, Redevelopment Agency, and the Regional Water Board to ensure storm water runoff is well controlled during construction. The following are the major accomplishments by the Building Division in 2012: • In 2012, the Building Division saw the stabilizing of construction activities with an increase from 2011. This is potentially due to the City Council's decision to waive permit fees for improvement projects beginning July 2011 (expired March 2012 with over $400,000 waived.) • Construction of major residential projects includes: o Mirabella (Townhomes) at Columbus Square — 100% complete o Augusta (Single family dwellings) at Columbus Square — 64 units 95% complete o Coventry (Apartments) at Columbus Square — 9 buildings (240 units) and a Recreation Building 100% compete o Ainsley Park (Duplex) at Columbus Grove — 84 units 100%, complete • Construction of non-residential projects o Tustin Toyota new offices and show room — 100% complete o Marconi Museum seismic/structural strengthening — 100% complete o Aria International Market (former Sears building) tenant improvement — 100% complete 0 170 ECR Retail/office/residential 100% complete o Woori Market (formerly Fresica) renovation 100% complete o Granada Plaza reconstruction — 95% complete and Permit issued o Tustin Meadows 2nd Club House — 100% complete o Cadillac Dealership tenant improvement — 100% complete o Hyundai Auto Dealership relocation at the Auto Mall — 100% complete o Marriott Hotels (294 units in two buildings) 15% complete o Auto Club 100% complete o Kaiser Permanente - 61,878 -square foot medical building, construction to commence soon o Fire Station #37, construction to commence soon O'� • In conjunction with the expansion of over-the-counter (OTC) plan check, the plan checkers and inspectors were scheduled to serve at the counter and answer questions from home -owners and contractors. • Building Division staff are called by the Police Department and OCFA when there are fires or vehicular collisions involving a structure. These activities include after -hour responses. In 2012, the Building staff responded to 21 auto -structure collisions, structural fires, and structural or other damages due to high wind. • Building Inspectors are also responsible for the storm water runoff control on construction sites. This includes the inspection of construction sites before the beginning of the storm season to ensure the approved preventive measures are in place, during and after the storm to ensure that the preventive measures are effective, and that there is no runoff and mud leaving the construction sites uncontrolled. • Building Division staff review business license applications to ensure that the new or the proposed change of use of buildings are acceptable for their intended uses. This effort also involves coordinating with OCFA on occupancies regulated by the Fire Code. • Building Division staff members are often called upon to assist Code Enforcement on construction related cases.
