AN ORDINANCE OF THE CITY OF TUSTIN RE-
STRICTING THE USE OF CERTAIN STREETS
The City Council of the City of Tustin does ordain as
follows:
Section 1. Truck Routes
a. Ehenever any Ordinance of the City of Tustin or the
City Council by Resolution designates. and describes any street
or portion thereof as a street the_us.e..of.which is permitted
by any vehicle having a rated capacity of two (2) tons or more,
the Superintendent of Streets of the City of Tustin is hereby
authorized to designate such street or streets by appropriate
signs as "Truck Traffic Routes" for the movement of vehicles
having a rated capacity of two (2) tons or more.
b. When any such truck traffic route or routes are estab-
lished and designated by appropriate signs the operator of any
vehicle having a rated capacity of.two (2) tons or more shall
drive on such route or routes and none other except when nee-
essary to traverse another street or street or streets to a
destination for the purpose of loading or.unloading, but then
only by such deviation from the nearest truck traffic route
as is reasonable necessary. The provisions of this Section
shall not apply to passenger busses under the jurisdiction of
the Public Utilities Commission.
e. The following streets hereinafter designated and de-
scribed are hereby declared to be truck traffie'routes for
............. .
the movement of vehicles having' a rated capacity of two ( 2)
tons or more:
(1) First Street for its entire length.
(2) "D" Street, that portion of which is commonly known
as State Highway Route No. 2 and U. S. Highway No.
101.
(3) Laguna Road, also known as State"Highway Route No.
2 and U. S. Highway No. 101 for its -entire length.
(4) Main Street East of ttDrt Street.
(5) Tustin Avenue for its entire length.
(6) Newport Avenue for its entire length.
Section 2. Penalty. Any person violating any of the
provision of this Ordinance shall be guilty of a misdemeanor
and upon conviction thereof shall be -punished by imprisonment
in the City Jail or in the. County Jail.,.but not exceeding six
(6) months, or by a fine.of not to exceed Five hundred Dollars
($500.00), or by both such fine and imprisonment.
Section 3. All Ordinances -or portions. of Ordinances of
the City of Tustin in conflict herewith..are hereby repealed;
Section 4- If any section, sub-section,.sentence, clause,
phrase or other portion of this Ordinance shall for any reason
be declared to be invalid or unconstitutional,by any desision
of any court of competent jurisdiction.,. such decision shall
not affect the validity of the remaining portions of this Or-
dinance. The Council hereby declared tha it would have adopted
this Ordinance and each section, sub-section,.sentence, clause,
phrase or portion thereof irrespective of the fact that any one
or more sebtions, sub -sections, clauses, phrases or portions be
declared invalid or unconstitutional.
Section 5. This Ordinance is hereby declared to be an
emergency necessary for the immediate preservation of the pub -
lie peace, health and safety and the facts constituting such
emergency are as follows:
There is a growing tendency for large and heavily laden
trucks to pull off the main truck route, U. S. Highway No. 101,
onto city streets for the purpose of making.t.emporary rest and
refreshment stops within the city; that unless, checked such use
of city streets will endanger public peace..- health and safety
through destruction of city streets not constructed for heavy
truck usage.
Section 6. The City Clerk shall certify as to the pas-
sage and adoption of this Ordinance and s#all: cause the same
to be published once in "The Tustin News",'a newspaper of gen-
eral circulation printed, published, and circulated weekly in
said City of Tustin, and: the same shall take effect and be in
force immediately upon its adoption.

The above and foregoing Ordinance -was -duly and regularly
introduced at a' regular meeting of the City. Council of the City
of Tustin held on the 5th day of Novemher,..19.51, and was duly
passed and regularly adopted at a regular meeting of the City
Council held on the 19th day of November:.1951, by the follow-
ing vote:
AYES: Councilment Humeston, miller, Gray, Bacon.
NOES: Councilmen: None
ABSENT: Councilmen: Teter
