SUBJECT: ADOPT RESOLUTION NO. 13 -02 APPROVING LOT LINE ADJUSTMENT
NO. 2012 -03
SUMMARY
A lot line adjustment to reconfigure three (3) parcels is required to facilitate construction of the
proposed Bonefish Restaurant located at 3040 El Camino Real. The proposed lot line adjustment
application has been submitted by John W. Murphy and Louis K. Raymond, Senior Vice President
and Assistant Secretary of the Irvine Company.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 13 -02 approving Lot Line Adjustment
No. 2012 -03.
FISCAL IMPACT
There is no fiscal impact associated with this item.
DISCUSSION
The California Subdivision Map Act allows a local agency to approve lot line adjustments and
parcel mergers. The proposed lot line adjustment will provide the existing In -N -Out Burger
Restaurant additional property to construct a long drive - through, will allow for the building design of
the proposed Bonefish Restaurant to comply with the California Building Code (CBC), and will
provide the proposed Bonefish Restaurant with designated parking spaces. Prior to the
recordation of the lot line adjustment, the applicant will modify, as applicable, all ingress /egress
easements and /or Covenant, Conditions & Restrictions pertaining to the subject parcels.
Lot Line Adjustment 2012 -03 has been reviewed by the Community Development Department and
the Public Works Department. The proposed adjustment has been determined to be in compliance
with all zoning requirements of the City, the provisions of the California Subdivision Map Act, and
the California Environmental Quality Act.

RESOLUTION NO. 13-02
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 2012-03
WHEREAS, Section 66412(d) of the California Subdivision Map Act makes provisions
for a local agency to approve lot line adjustments where the land taken from one parcel is added
to an adjacent parcel and where no additional parcels are created; and
WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment No.
2012-03 and has made findings that the real property, described in Exhibit "A" and shown on
Exhibit "B", comply with the provisions of the California Subdivision Map Act and applicable City
of Tustin Ordinances and Regulations including the requirements for building sites; and
WHEREAS, the City Council of the City of Tustin has made the following findings:
1. That the proposal is eligible for processing as a lot line adjustment pursuant to
Section 66412(d) of the California Subdivision Map Act;
2. That the requirements of the California Environmental Quality Act have been met;
1 That the proposal is consistent with the City of Tustin General Plan; and
4. That the resultant parcels will meet the requirements of the City of Tustin Zoning
Code.
NOW, THEREFORE, BE IT RESOLVED that proposed Lot Line Adjustment No. 2012-
03, as shown on Exhibits "A" and "B", is hereby approved and that the resulting Parcels 1 and 2
be considered building sites and Parcel 3 as common parking area, subject to the following:
1. The applicant shall prepare and record a new deed reflecting Lot Line Adjustment
No. 2012-03, as shown on Exhibits "A" and "B";
2. The applicant shall prepare and record an updated Covenants, Conditions &
Restriction (CC&R) / easements, and
3. This Resolution shall become null and void if the deed reflecting Lot Line Adjustment
No. 2012-03 is not recorded with the Recorder's Office of Orange County, California
within two (2) years of the date this Resolution is adopted.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin
held on the 5t" day of February 2013.
