CALL TO ORDER — Meeting #2308 at 6:01 p.m. ATTENDANCE Present: Mayor Al Murray Mayor Pro Tem Charles 'Chuck" Puckett and Councilmembers John Nielsen, Rebecca 'Beckie Gomez and Allan Bernstein Absent: None City Clerk: Jeffrey C Parker City Clerk Others Present: David E. Kendig, City Attorney PUBLIC INPUT — None CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1 CONFERENCE WITH LEGAL COUNSEL — EXPOSURE TO LITIGATION [Govt. Code § 54956.9(d2)] — One Case 2. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION [Govt. Code § 54956 9(d1)] — One case A. Tustin Unified School District v City of Tustin et al. Case No. 30 -2010- 00345476 Orange County Superior Court RECESSED at 6:02 p.m. RECONVENED at 7:05 p.m. Special City Council Meeting Minutes January 28, 2013 Page 1 of 2 CLOSED SESSION REPORT — City Attorney David E. Kendig — The Council unanimously approved a settlement agreement, the specifics which will be made available to the public upon request. ADJOURNMENT at 7.06 p.m. — The next meeting is scheduled for Tuesday February 5 2013 at 5.30 p.m. for the Closed Session Meeting followed by the Regular Business Meeting at T00 p.m. in the Council Chamber 300 Centennial Way Tustin, California.
