HUSTON, EXECUTIVE DIRECTOR REDEVELOPMENT STAFF Inter -Corn NO 2 4 -5 -99 ADOPTED RESOLUTION NO. 99 -a7 ADOPTION OF RESOLUTION ADOPTING A PROCEDURE FOR THE SUMMARY Council approval is requested to adopt a Procedure for Formation and Election of a Project Area Committee, a required action in connection with the proposed 1999 Amendment to the Redevelopment Plan for the South Central Redevelopment Project Area, which would re establish the Redevelopment Agency's eminent domain authority RECOMMENDATION Adopt the attached resolution adopting the Procedure for Formation and Election of the Project Area Committee for the 1999 Amendment to the Redevelopment Plan for the South Central Redevelopment Project Area. FISCAL IMPACT None at this time. BACKGROUND The City Council of the City of Tustin ( "City Council ") adopted the Redevelopment Plan for the South Central Redevelopment Project Area ( "Redevelopment Plan') on August 1, 1983 by Ordinance No. 890 pursuant to the California Community Redevelopment Law, Health and Safety Code Section 33000, et. seq., ( "CRL '). The Redevelopment Plan was subsequently amended on two occasions. The first amendment added approximately 138 acres to the South Central Redevelopment Project Area (adopted on July 15, 1985, by Ordinance No. 439). The second amendment established certain time limitations required by the passage of Assembly Bill 1290 (adopted on November 21, 1994 by Ordinance No. 1142). The Redevelopment Plan, as adopted and amended, included eminent domain authority over all property in the South Central Redevelopment Project Area ( "Project Area "). However, the initial eminent domain authority within the original Project Area and the area added by the first amendment expired recently The power of eminent domain can only be re- established by amendment to the Redevelopment Plan. This authority is needed within the South Central Redevelopment Project Area to complete redevelopment and revitalization activities in the Project Area. William A. Houston April 5, 1999 Page 2 • • The first step in the process of amending the Redevelopment Plan is for the City Council to adopt a procedure for the formation of what is known as a Project Area Committee ( "PAC "). As required by Section 33385.3 of the CRL, a PAC must be formed if the proposed amendment would either 1) allow the Redevelopment Agency to acquire by eminent domain, property in a project area where a substantial number of low and moderate income people reside; or 2) add territory in which a substantial number of low to moderate persons reside, and authorize the use of eminent domain in the added territory for properties in which people reside. Since the proposed 1999 Amendment would extend the Agency's use of eminent domain, and the Project Area is believed to include a substantial number of low to moderate- income residents, a PAC formation is required. The PAC is an elected body comprised of residential owner occupants, residential tenants, business owners (including non - resident property owners), and existing community organizations within the Project Area. Each group must be adequately represented. Prior to serving on the PAC, each PAC member must complete a Conflict of Interest form, which has been attached for Council review The PAC will review the proposed 1999 Amendment to the Redevelopment Plan ( "1999 Amendment ") and may choose to prepare a report and recommendation about the 1999 Amendment to the City Council. If the PAC opposes the adoption of the 1999 Amendment, the City Council must adopt the plan by a two - thirds vote, rather than a simple majority After the 1999 Amendment is adopted, the responsibilities of the PAC are to consult with and advise the Redevelopment Agency on policy matters that affect the residents of the Project Area. The PAC serves for a three year period after the adoption of the Redevelopment Plan, subject to one -year extensions by the City Council. PAC meetings are subject to the Ralph M. Brown Act. The CRL sets out rules for the election including notification and voting procedures. City Council must, by resolution, adopt a procedure for the formation of the PAC. The Procedure for Formation and Election of the Project Area Committee for the Redevelopment Project Area is attached as Exhibit A to this report. The highlights are as follows: Membership/Eligibility • The PAC is composed of residential owner- occupants, residential tenants, business owners (which includes non - resident property owners), and existing community organizations within the Project Area. • Any person is eligible to vote and/or to be a candidate for the PAC if they are a residential owner- occupant, residential tenant, business owner, or existing community organization in the Project Area. Evidence of qualifications must be shown at the time of the election. Houston April 5, 1999 Page 3 • • Category Number of Representatives Residential Owner- Occupant 3 Residential Tenant 3 Business Owner 2 Existing Community Organization 1 TOTAL 9 Public Meetings and Notices • Notice will be mailed to all property owners, residents, businesses, and existing community organizations within the Project Area publicizing the opportunity to serve on the PAC. • The Redevelopment Agency will conduct a public informational meeting to explain the establishment and function of the PAC. • The election will take place within approximately two weeks of the informational meeting. • Information about the proposed 1999 Amendment and CRL will be distributed at the meeting, including the sections of the CRL pertaining to the PAC. • Notice will also be published in the newspaper. Voting • Eligible voters will vote for candidates in their category - Residential Owner- Occupant, Residential Tenant, Business Owner, and Existing Community Organization. • Absentee voting will be allowed. • Results of the voting will be tabulated at the election site and a run -off election will be held on that day if necessary • Results of the election will be certified by the City Clerk's representative and presented to the City Council for affirmation. 0 lie) Christine A.
