HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/WATER SERVICES DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS- FOOTHILL RESERVOIR REPAIRS (CIP No. 6113) SUMMARY This action consists of the acceptance of work and authorization of recordation of the Notice of Completion for the Foothill Reservoir Repairs (CIP No. 6113). RECOMMENDATION It is recommended that the Tustin City Council adopt Resolution No. 02-94 accepting said work and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release of Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no other claims or stop payment notices are filed, it is further recommended that the City Council authorize payment of the final 10% retention amount of $49,496.33, to Denboer Engineering and Construction, Inc., thirty-five days after the date of recordation of the Notice of Completion. This amount together with previous payments totals $494,963.26 and represents 100% of the final contract cost. FISCAL IMPACT The final cost of the contract is $494,963.26. Adequate funds have been allocated for the completion of this project, which included the construction services activities. BACKGROUND On May 21, 2001 the City Council awarded the Foothill Reservoir Repair project to Denboer Engineering and Construction, Inc. This project consisted of the following items of work performed at the existing Foothill Reservoir site: · Construct reinforced concrete retaining wall and piers. · Modify existing reservoir hatch and opening. · Remove existing wooden stairway and construct new access onto reservoir roof. · Replace FAA furnished Outer Marker Beacon Facility equipment. · Repair cracks and apply waterproof coating on reservoir roof slab. · Replace chain link fence around site. Final Acceptance of Public Improvements - Foothill Reservoir Repairs (CIP No. 6113) October 7, 2002 Page 2 · Modify reservoir roof vents. · Construct concrete drains, culvert and swales. · Install landscaping and irrigation. Ragland ~' Water Services Manager 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 02-94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORK OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR FOOTHILL RESERVOIR REPAIRS (CIP No. 6113). WHEREAS, DenBoer Engineering & Construction, Inc. having a contract with the City Council to provide the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Foothill Reservoir Repairs (CIP No. 6113) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the Acceptance of said public works and improvement described herein as required by law.
