HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF COMPLETION FOR ANNUAL MAJOR MAINTENANCE PROGRAM FY 1999-2000 (ClP NO. 7001) ISUMMARY ~ehabilitation of various streets as identified in the Citywide Pavement Management System (PMS), as part of the Annual Major Maintenance Program for FY 1999-2000, has been completed and the project is ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 00-52 accepting said work and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice to Completion the City Council authorize payment of the final 10% retention in the amount of $56,047.31 to Sequel Contractors, Inc. This amount together with previous payments of $504,425.77 represents 100% of the final contract cost. FISCAL IMPACT The final construction cost of this project is $560,473.08 and the 1999/2000 fiscal year Capital Improvement Program budget provided sufficient funding for this project. The Major Maintenance Program is part of the'City's on-going annual Maintenance of Effort (MOL) requirements for the continuance of Measure M funding. BACKGROUND This project provided asphalt concrete repaidoveday, crack routing and sealing, slurry seal, traffic striping and markings and replacement of traffic loop detectors at various locations throughout the City. Streets requiring new paving due to the deteriorating pavement conditions were, El Camino Real between Browning Avenue and Red Hill Avenue, San Juan Street between Browning Avenue and Red Hill Avenue, Mitchell Avenue between "B" Street and Newport Avenue and Marshall Lane between Santa Clara Avenue and Laurie Lane. Damaged curbs and gutters at Marshall Lane were also replaced and parking lots at City Hall, Senior Center, Columbus Tustin Park, and Field Services were slurry sealed. Therefore, it is recommended that the City Council adopt Resolution No. 00-52 accepting this project as complete and authorize the recordation of the Notice of Completion. Tim D. II II II Ir ],l 6.~^~x~, Il Il Il Il I ~/..L _ Z~L J I_J ~i u u iL b ~ McFADDEN t >: NIl SrLL 'AY NOl-I'l¥ O~tI~ ±33W±S f 'AY _ >: < ~ 'A~ i L Z g MYFORD ROAD ROAD II ~7 ~S 27 RESOLUTION NO. 00-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE ANNUAL MAJOR MAINTENANCE PROGRAM FY 1999-2000 {CIP NO. 7001) WHEREAS, Sequel Contractors, Inc. having a contract with the City of Tustin to construct the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: ANNUAL MAJOR MAINTENANCE PROGRAM FY 1999-2000 (CIP NO. 7001) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
