M002 TO ADMINISTERING AGENCY- STATE MASTER AGREEMENT NO. 12-5271 FOR THE PROSPECT AVENUE REHABILITATION PROJECT BETWEEN FIRST STREET AND IRVlNE BOULEVARD (ClP NO. 7161) SUMMARY Program Supplement Agreement No. M002 is a Project-Specific Program Supplement to the previously approved Administering Agency-State Master Agreement No. 12-5271 for reimbursement of Federal Funds covering construction engineering and construction for the Prospect Avenue Rehabilitation Project between First Street and Irvine Boulevard (CIP 7161). RECOMMENDATION It is recommended that the City Council adopt Resolution No. 00-60 approving Program Supplement Agreement No. M002 to Administering Agency-State Master Agreement No. 12- 5271 and authorize the Mayor and City Clerk to execute said agreement on behalf of the City of Tustin. FISCAL IMPACT With the approval of Program Supplement Agreement No. M002 the City will receive Federal reimbursement of up to 50% of the costs of eligible items covering construction engineering and construction for the Prospect Avenue Rehabilitation Project between First Street and Irvine Boulevard (CIP No. 7161). BACKGROUND On February 16, 1999, the City Council approved the Administering Agency-State Master Agreement No. 12-5271 which covers the general requirements of all Federal-aid projects. Program supplements to the Master Agreement formalize the financial responsibilities and provisions for each specific Federal-aid funded project. City Council approval of Program Supplement Agreement No. M002 is required for the reimbursement of Federal funds for construction engineering and construction for the Prospect Avenue Rehabilitation Project between First Street and Irvine Boulevard (CIP No. 7161). The Program Supplement Agreement has been reviewed and approved as to form by the Attorney. Tim D. M002 TO THE ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 12-5271 FOR THE PROSPECT AVENUE REHABILITATION PROJECT BETWEEN FIRST STREET AND IRVINE BOULEVARD (ClP NO. 7161) WHEREAS, the City of Tustin previously approved the Master Agreement No. 12-5271 with the State of California, acting by and through the California Department of Transportation (Caltrans); and WHEREAS, Program Supplements to the Master Agreement formalize the financial responsibilities and provisions for each specific Federal-aid funded project; and WHEREAS, approval of Program Supplement Agreement No. M002 is required for the reimbursement of Federal funds for construction engineering and construction for the Prospect Avenue Rehabilitation Project between First Street and Irvine Boulevard (CIP No. 7161); NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that Program Supplement Agreement No. M002 to the Administering Agency-State Master Agreement No. 12-5271 is hereby approved; AND BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute Program Supplement Agreement No. M002 on behalf of the City. The Local Agency will reimburse the State for their share of costs for work requested to be perfor~ned by the State. 2. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the FNM-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepamed by the Office of Local Programs Project Implementation. 3. The Local Agency will advertise, award and administer this project in accordance with the current Local Assistance Procedures Manual. 4. All maintenance, involving the physical condition and the operation of the imp. rovements, referred to in Article III MAINTENANCE of the aforementioned Master Agreement will be the responsibility of the Local Agency and shall be performed at regular inte~a!s or as required for efficient operation of the completed imp_rov~_ments.
