HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE ANNUAL SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, FY 1999-2000 (PROJECT NO. 402-6235) iSUMMARY i Construction of the City's Annual Sidewalk and Curb and Gutter Repair Project for correcting i tripping hazards, drainage problems, and ADA deficiencies has been completed and the project is ~ ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 00-57 accepting said work as complete and authorize the recordation of the Notice of Completion, and direct the City Clerk to: ]. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or Stop Notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $15,598.13 to Med Tox, Inc. This amount together with the previous payments of $140;383.12 represents 100% of the final contract amount. FISCAL IMPACT The final cost of construction for this project was $155,981.25, and no contract change orders were required. Funding for this project was provided through the 1999-2000 FY Public Works Department/Engineering Division Operating Budget (account #01-402-6235). This project is part of the City's on-going Maintenance of Effort requirements for compliance with Measure "M". BACKGROUND This project consisted of the removal and replacement of concrete sidewalk, curb and gutter and drive aprons to correct tripping hazards at approximately 175 locations throughout the City. Problem areas where roots from parkway trees repeatedly damage and lift the adjacent sidewalk creating these tripping hazards have been addressed by this year's project. Thirty-one parkway trees were removed and replaced with tree species that have a less invasive root system. Acceptance of Public Improvements and Authorization to File Notice of Completion for Annual Sidewalk and Curb and Gutter Repair Project, FY 1999-2000 August 7, 2000 Page 2 This project also provided a means to address improvements throughout the City to comply with the Federal Americans with Disabilities Act (ADA). These locations were requested by citizens or were identified by City staff to provide curb access ramps as well as completion of missing segments of sidewalk to improve disabled/pedestrian access. ADA related improvements during this year's project included six curb ramps at various locations, as well as construction of a missing segment of concrete sidewalk along the westedy side of Myford Road between Michelle Drive and approximately 1100' north of Walnut Avenue. This area previously had a limited stretch of sidewalk on Myford Road north of Walnut Avenue, and construction of this missing segment has eliminated the need for pedestrians to traverse this zone on the side of the road adjacent to vehicular travel lanes. This work has been completed by Med Tox, Inc. to the satisfaction of the Engineering Division. ~ Tim D~.%r~' ~ Director of Public WorkS/City Engineer TDS:JO:ccg:Final Accept Annual S,C & G 99-00 & Reso 00-57.doc Attachments 4e oE s ;n Associate Civil Engineer RESOLUTION NO. 00-57 2 6 7 $ '_,0 ~2 2:3 01 ?£ 26 27 25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION FOR THE ANNUAL SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, FY 1999-2000 (PROJECT NO. 402-6235) WHEREAS, Med Tox, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows' Annual Sidewalk and Curb and Gutter Repair Project, FY 1999-2000 (Project No. 402-6235) AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
