REJECTION OF BIDS AND AUTHORIZATION TO RE-ADVERTISE FOR
BIDS - RED HILL AVENUE MEDIAN LANDSCAPING FROM EDINGER
AVENUE TO WALNUT AVENUE (ClP NO. 7124)
SUMMARY
Reject all bid proposals received on this project and authorize and direct the City Clerk to re-
advertise for bids. Three of the four bid proposals received were deemed non-responsive, and
the remaining bid proposal was considerably higher than the engineer's estimate. This project will
install landscaping, irrigation, and brick pavers within the existing median islands.
RECOMMENDATION
It is recommended that the City Council:
1. Reject all bids received on July 18, 2000 and;
2. Authorize and direct the City Clerk to re-advertise for bids.
FISCAL IMPACT
The engineer's estimate for construction is $185,000. The City's Capital Improvement Program
(CIP) budget for FY 2000-2001 included sufficient funding to construct this project.
BACKGROUND
The first phase of work on Red Hill Avenue between Edinger Avenue and Walnut Avenue, as
shown on the attached location map, was the street rehabilitation project which was completed
in May, 2000. This project also included the replacement of the median island curbs and the
removal of the existing turf, trees, and irrigation systems.
The median landscaping project is the second phase of work, and will replace the landscaping
with drought tolerant shrubs and trees. A Iow flow irrigation system will be installed which will
also eliminate runoff onto the street. Brick pavers will be utilized as the hardscape treatment at
the ends of the median islands. These design components have been developed through the
coordination of the City's design consultant, Robert Goto & Associates, the Community
Development Department, and the Public Works Field Services Division.

City Council adopted Resolution No. 00-45 approving the plans and specifications for this project
on June 19, 2000. The project was subsequently advertised and the bids were opened on July
18, 2000, and the four (4) bids received are summarized as follows:

Midori Landscape's bid is 34% above the engineer's estimate of $185,000. Staff believes this bid
to be excessive and recommends rejection of this bid. The City, at the direction of the City
Attorney, requested information on the contractor's insurer that would be supplying the payment
bonds. This information, which was required to be submitted as part of the bid package,
included: the name of the insurer, Certificate of Authority from the State of California, Certificate of
Fact from the County of Orange, and their most recent quarterly and annual statements. By
requesting this information during the bidding phase, the City can ensure the sufficiency of the
payment bond prior to award of the contract. The remaining three bidders, which were deemed
non-responsive, failed to submit ali of the required information.
In analyzing the unit costs for all bids received on this project, it was determined that
modifications to the plans and specifications were not necessary, and that re-bidding the project
could result in an overall project cost near the engineer's estimate.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR RED HILL
AVENUE MEDIAN LANDSCAPING FROM EDINGER AVENUE TO
WALNUT AVENUE (CIP NO. 7124)
WHEREAS, it is the intention of the City Council of the City of Tustin, California to
contract for the median landscaping improvements on Red Hill Avenue from Edinger
Avenue to Walnut Avenue; and
WHEREAS, the City Engineer presented plans and specifications for the
construction of said work; and
NOW, THEREFORE, BE IT RESOLVED that the plans and specifications
presented by the City Engineer be, and are hereby approved, as the plans and
specifications for:
Red Hill Avenue Median Landscaping from Edinger Avenue to
Walnut Avenue (CIP No. 7124)
AND BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or proposals for
the performance of the work specified in the plans and specifications;
AND BE IT FURTHER RESOLVED that this project is categorically exempt from
the requirements of the California Environmental Quality Act; Class I Section 15301;
