HUSTON, CITY MANAGER REDEVELOPMENT AGENCY STAFF CONTRACT AMENDMENT WITH KUTAK ROCK, MCAS TUSTIN SUMMARY: Tustin City Council approval is requested to amend an existing agreement with Kutak Rock, a legal firm providing specialized legal services to the City of Tustin on matters concerning the former Marine Corps Air Station Tustin. RECOMMENDATION It is recommended that the Tustin City Council authorize the City Manager or Assistant City Manager to execute an amendment to the existing Consultant Services Agreement with Kutak Rock adjusting the hourly rates to be charged in providing legal services to the City of Tustin on matters concerning the former Marine Corps Air Station (MCAS) Tustin. FISCAL IMPACT Kutak Rock has requested an increase of its hourly billing rates for services rendered to the City of Tustin. Costs associated with the use of services provided by Kutak Rock have previously been funded as part of the City's annual budget. Staff believes that the requested salary adjustment will not result in any additional fiscal impact upon the City's current allocation of funds. Redevelopment Agency staff will be responsible for contract administration. BACKGROUND/DISCUSSION On January 16, 1995, the City of Tustin executed an agreement with Kutak Rock for special legal services associated with the City's efforts to plan and implement the reuse of the former MCAS Tustin. At that time, the hourly rate for senior attorney George Schlossberg and others was set at $225 per hour. In 1997, the City authorized an increase of this hourly rate to $245 per hour. On August 3, 2000, the City of Tustin received a written request for an additional salary adjustment to $265 per hour for senior attorneys along with new hourly rate adjustments for other Kutak Rock attorneys and staff associated with the MCAS Tustin project to range from $190-$205. If approved by the Tustin City Council, the proposed increase would represent less than a 2.7% average increase since the contract was last amended in 1997.
