TUSTIN LEGACY: RECOMMENDATION OF SHORT-LIST FOR
COMMERCIALIOFFICEIR&DIINDUSTRIAL DEVELOPER COMPETITION
SUMMARY: The Tustin City Council's confirmation of a short list of developers to
proceed to the proposal stage in the development competition for the Tustin Legacy
CommerciallOfficelR&DIIndustrial site is requested, as recommended by the Tustin
Legacy Technical Evaluation Team.
RECOMMENDATION
It is recommended that the Tustin City Council accept the recommendation of its Technical
Evaluation Team to short-list Legacy Partners, Lennar Partners, Shea Properties and
Lowe Enterprises as qualified to proceed to the Request for Proposal stage in competition
for development of the approximate 248 acre Tustin Legacy
Commercial/Office/R&D/I ndustrial site.
FISCAL IMPACT
There is no cost associated with the City Council's affirmation of a short list of
developers. Costs for the Request for Proposal (RFP) process have been
accommodated in the budget.
BACKGROUND
Agency staff earlier this year initiated the Request for Qualifications (RFQ) process for the
second of the three initial development sites planned for disposition at Tustin Legacy.
Agency staff initiated the process in anticipation of acquiring the approximately 1,200
acres of the former MCAS-Tustin from the Navy some time this year. This second site
offered to the development community was an approximate 248.8+ acre
CommerciallOfficelR&DIIndustrial site in the southwest portion of the Tustin Legacy
property. The site is generally bordered by Barranca Parkway and the existing
Barranca flood control channel on the south, Redhill Avenue on the west and future
extensions of Warner Avenue and Tustin .Ranch RoadJon Karman on the north and
east respectively. The majority of the office, industrial and general commercial land
uses proposed for Tustin Legacy are proposed to be located within the site. The MCAS
Tustin Reuse Plan anticipates a high quality, master-planned business park
development on the site.

Notification was mailed in late November 1999 to an extensive interest list of
development entities regarding the RFQ process for the site. Press releases also were
sent just ahead of the release of this RFQ package in February of this year.
Approximately 80 RFQs were requested on this opportunity and 12 responses to the RFQ
were received by the submittal deadline.
The 12 submittals were reviewed by the members of the Tustin Legacy Technical
Evaluation Team (TET). The TET included Agency staff, principal representatives from
Interra Strategies and Economic & Planning Systems (the Development Advisors for
Tustin Legacy), the City Attorney's office, and two representatives of the City Council
(Mayor Pro Tem Tracy Worley and Councilmember Tom Saltarelli).
The first step in the review was a rating of each developer based upon its capability,
quality and responsiveness as measured by the specific criteria in the RFQ. A
standardized evaluation form was filled out, with assignment of certain criteria categories
for review based upon specific expertise. These evaluation forms were consolidated for
each submittal, resulting in an overall numerical ranking of developers by score.
The TET members then met to review the consolidated evaluations, discuss the
conclusions and ratings they represented, and confirm the short-list of four top developer
candidates that would be recommended to the full City Council. The four respondents that
the TET recommends be short-listed (in no order of ranking) to proceed to the Request for
Proposal stage are as follows:
· Legacy Partners
· Lennar Partners
· Shea Properties
· Lowe Enterprises
These developers were selected as most qualified based upon a combination of their
exceptional financial and project management capability, demonstrated experience in
quality master-planned commercial-business development projects in California,
knowledge of the Orange County market, and understanding of the goals for the site as
defined in the MCAS Tustin Reuse Plan.

The approved short list of developers will be notified of their selection and advised as to
when they will receive the Stage Two - Request for Proposals (RFP). Staff is currently
working with its consultant team to finalize the development information, criteria and format
of the RFP. It is anticipated that the selected developers will have approximately three
months from the date of receipt of the RFP to prepare their proposals for this
CommerciallO~celR&DIIndustrial site.
Agency staff will be available at the August 21st meeting to respond to any questions from
the City Council on the RFQ process.
