CALL TO ORDER at 4:06 p.m. ROLL CALL Present: Chair Doug Davert, Secretary Puckett and Board Members Allan Bernstein, John Nielsen, Anthony Soria and Matt West Absent: Vice Chair Fitzsimons Successor Agency Clerk: Jeffrey C Parker Others Present: David E. Kendig, Legal Counsel to the Successor Agency PLEDGE OF ALLEGIANCE — Chair Davert PUBLIC INPUT — None REGULAR BUSINESS ITEMS 1 -2 1 APPROVAL OF MINUTES — REGULAR MEETING OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE FORMER TUSTIN COMMUNITY REDEVELOPMENT AGENCY HELD ON DECEMBER 11 2012 Motion. It was moved by Secretary Puckett and seconded by Board Member Bernstein that the Oversight Board: Approve the Minutes of the Regular Meeting of the Oversight Board of the Successor Agency to the Tustin Community Redevelopment Agency held on December 11 2012. Oversight Board of the Successor Agency to the Tustin Community Redevelopment Agency Regular Meeting Minutes — January 8, 2013 Page 1 Motion carried: 5 -0 -1 (Board Member Nielsen abstained) 2. APPROVE THE DUE DILIGENCE REVIEW OF THE NON - HOUSING FUNDS AND TRANSMIT THE DETERMINATION OF THE AMOUNT OF AVAILABLE CASH FOR DISBURSEMENT TO THE DEPARTMENT OF FINANCE AND COUNTY OF ORANGE AUDITOR - CONTROLLER The public comment session was closed at 441 p.m. Motion. It was moved by Secretary Puckett and seconded by Board Member Bernstein to: 1 Review the Due Diligence Review of the Non - Housing Funds from White Nelson Diehl Evans LLP the Successor Agency's certified public accounting firm, including comments from the public and County of Orange Auditor - Controller and Motion carried 6 -0 Motion: It was moved by Board Member Bernstein and seconded by Board Member Nielsen to 2. Adopt Oversight Board Resolution No. 13 -01 approving the transmittal to the Department of Finance and County of Orange Auditor - Controller of the Due Diligence Review's determination of available cash and cash equivalents for disbursement to taxing entities. Motion carried 6 -0 Motion: It was moved by Board Member Nielsen seconded Secretary Puckett to 3 Modify Schedule 7 Footnote (B), second sentence to read: Balance is not due until December 1 2013, unless amended or restated by the "Parties to the Note Motion carried 6 -0 OVERSIGHT BOARD RESOLUTION NO 13 -01 A RESOLUTION OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY APPROVING WHITE NELSON DIEHL EVANS LLPS DUE DILIGENCE REVIEW FINDINGS OF THE NON - HOUSING FUNDS AND AUTHORIZING THE SUCCESSOR AGENCY TO TRANSMIT THE FINDINGS Oversight Board of the Successor Agency to the Tustin Community Redevelopment Agency Regular Meeting Minutes — January 8, 2013 Page 2 Secretary Puckett adjourned the meeting in honor of his son's 44th birthday and Elvis Presley who would be 78 today ADJOURNED at 4 16 p.m. The next regular meeting of the Oversight Board of the Successor Agency to the Tustin Community Redevelopment Agency is scheduled for January 22, 2013 at 4.00 p.m. in the Council Chamber at 300 Centennial Way, Tustin, California.
