AN ORDINANCE OF THE CITY_OF TUSTIN ADOPTING
THE UNIFORM BUILDING CODE, 1940 EDITION,
REGULATING THE ERECTION, CONSTRUCTION, EN4
LARGEMENT, REPAIR, MGVING, RE'MOVALp CUNVEH—
SION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE,
HEIGHT, AREA, AND MAINTENANCE OF BUILDIvGS
AND/OR STRUCTURES IN SAID CITY: PROVIDING FOR
THE ISSUANCE OF PERMITS AND COLLECTION OF FEES
THEREFOR: DECLARING AND ESTABLISHING FIRE
DISTRICTS: PROVIDING PENALTIES FOR THE VIOLA
TION THEREUF, AND REPEALING ORDINANCE NO. 20.
The City Council of•tne City of Tustin, California,
does hereby ordain as follows:
Section l: That portion of a certain printed code,
three copies of which are on file in the office of the City Clerk
of the,City of Tustin, being marked and designated as "Uniform

Building Code, 1940 edition", wiica was published May 1, 1940 by
Pacific Coast Building Officials Conference, be and the same is
hereby adopted as the Building Code of the City of Tustin for the
regulation of.tne erection, construction, enlargemeent, repair,
moving, removal, conversion, aemolition, occupancy, equipment, use,
height, area and maintenance of buildings and/or structures in
said City: providing for the issuance of permits and collection of
fees therefor: declaring and establishing fire districts; provid—
ing penalties for the violation of sucn Building Code, and each
and all of the regulations, provisions, penalties, conditions and
terms of said "Uniform Building Code", on file in the office of
said Clerk and nereby referred to, are hereby adopted and made a
part hereof to the same effect as if fully set forth in this ordi—
nance,
Section 2. Tnat the portions of said Uniform Building
Code so adopted ate as follows;
Section 101 to Section 4501, both sections included,
being Chapters 1 to 45, both inclusive of said Code; and also
Section 4701 to Section 4721, both inclusive, being Chapter 47 of
said Code; and also the table of minimum foundation requirements
for Type V buildings, and table for weights of construction mater—
ial, as shown on pages 290 and 291 of said Code. Aso that certain
paragraph oeginning with the words "Refer to Sec. 2410". on page
296, to the bottom of said page, containing a formula for Computes—
tion of lime—cement Mortar.

Section 3:, If any section, subsection, sentence, clause
or phrase of this Ordinance, is for any reason held to be uncon—
stitutional, such decision snall not affect the validity of the
remaining portions of thins>Ordinance. The City Council hereby de—
clares that it would have passed this Ordinance, and each section,
subsection, clause or phrase thereof, irrespective of the fact that
any one or more sections, subsection, sentences, clauses and
phrases be declared unconstitutional.
Section 4: That Ordinance No. 20. is hereby repealed,
and all other ordinances, or portions of ordinances to the extent
that the same conflict herewith are, to that extent, hereby repealed.
Section 5: The City Clerk shall certify to the passage
of this Ordinance and shall cause the same to be published once in
the Tustin News, a weekly newspaper of general circulation, print—
ed, published and circulated in the City of Tustin, Orange County,
California, and said Ordinance shall take effect and be in full
force and effect thirty (30) days from the date of its final pas—
sage and adoption.

Tustin at its regular meeting held on the day of , 1942.
