ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE
NOTICE OF COMPLETION FOR THE RECONSTRUCTION OF PASADENA AVENUE
FROM MAIN STREET CUL-DE-SAC TO THE FIRST STREET CUL-DE-SAC (C.I.P. NO.
7157) AND SECOND STREET FROM PASADENA AVENUE TO MYRTLE AVENUE
(C.I.P. NO. 7158)
SUMMARY
The reconstruction of Pasadena Avenue from Main Street cul-de-sac to the First Street cul-de-sac
and Second Street from Pasadena Avenue to Myrtle Avenue has been completed and the projects
are ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council 'adopt Resolution No. 00-79 accepting said work as
complete and authorize the recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date
of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming no claims or Stop Notices are filed, it is further recommended that 35 days after the
date of recordation of the Notice of Completion the City Council authorize payment of the
remainder of the retention in the amount of $16,329.65 to Topline Construction, Inc. This amoUnt
together with the previous payments of $308,442.20 represents 100% of the final contract amount.
FISCAL IMPACT
The final cost of construction for this project was $324,771.85, which includes one contract
change order in the amount of $4,051.59. Funding for this project was provided through the City's
Capital Improvement Program Budget. This project is also part of the City's on-going
Maintenance of Effort requirements for'compliance with Measure "M".
BACKGROUND
These projects Provided for the reconstruction of the existing street pavement, curb, gutter,
sidewalk and drive aprons-with the addition of decorative residential street lighting.

This work has been completed by Topline Construction to the satisfaction of the Engineering
Division, and is now ready to be accepted by the City Council.

RESOLUTION NO. 00-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORK OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE
RECONSTRUCTION OF PASADENA AVENUE (CIP NO. 7157) AND
SECOND STREET (ClP NO. 7158)
WHEREAS, Topline Construction Inc. having a contract with the City of Tustin
to construct the hereinafter described public work and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvements hereinafter mentioned in a manner
satisfactory to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said
public improvement hereinafter more particularly described in accordance with the
provisions of the contract documents and the Notice of Completion, and acceptance
of said public work and improvement should be filed and payment of the balance due
said contract authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement is found to be complete, and the same
is hereby accepted. Said public work and improvement is more particularly desCribed
as follows:
Reconstruction of Pasadena Avenue from Main Street Cul-de-sac
To the First Street cul~de-sac (CIP No. 7157) and Second Street
From Pasadena Avenue to Myrtle Avenue (CIP No. 7158)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of
said public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Tustin, held on the 20th day of November 2000.
