RESOLUTION NO. 00-77 ACCEPTANCE OF PUBLIC IMPROVEMENT AND
AUTHORIZATION TO FILE NOTICE OF COMPLETION
SUMMARY:
Construction of the restrooms, picnic shelter and tot lot equipment at Peppertree Park
and Magnolia Tree Park (Project No. 2039) is complete, and the project is now ready for
acceptance and filing of the Notice of Completion.
RECOMMENDATION:
The City Council of the City of Tustin is recommended to adopt Resolution No. 00-77
accepting said work as complete; authorize the recordation of the Notice of Completion;
and direct the City Clerk to:
1. Release the Labor and Materials Bond no sooner than 35 days after the date of the
recordation of the Notice of Completion, and
2. Release the Faithful Performance Bond no sooner than one year after the date of
recordation of the Notice of Completion.
FISCAL IMPACT:
The renovation of Peppertree Park and Magnolia Tree Park restrooms, picnic shelter
and tot lot equipment was scheduled for completion in fiscal years 1999-2000, and
2000-2001. As part of the City's Parks Capital Improvement Program, an original
amount of $781,000 was allocated for the completion of this project. The Iow bid for the
project was $599,700. Project contingencies, change orders and new improvements
totaled $67,334.27, approximately 11% of the original bid price. Total project cost was
$667,034.27.
Contributing fund sources for this project included a grant from the County of Orange in
the amount of $100,000, Park Development Fund allocation of $226,000;
Redevelopment Agency Town Center Fund, $240,000; and a Capital Improvement
General Fund allocation of $210,000.
BACKGROUND:
The project was substantially complete on August 2, 2000. The City occupied the band
shell and picnic shelter facility at Peppertree Park prior to the substantial completion.
The City occupied the remaining improved facilities at the end of the 30-day
maintenance period, which concluded on September 5, 2000. The punchlist review and
product warranty follow-up were completed in September and October. The City is now
prepared to accept the project and file the Notice of Completion. The City is retaining
$66,723.43, which will be disbursed no sooner than 35 days after the recordation of the
Notice of Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTiNG WORKS OF IMPROVEMENT .~ND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
PEPPERTREE PARK AND MAGNOLIA TREE PARX (PROJECT NO.
2039).
The City Council of the City of Tustin does hereby resolve as follows:
WHEREAS, Big Ben Construction Co., having a contract with the City of Tustin to
construct the hereinafter described public works and improvements; and
WHEREAS, the City Engineer has duly certified to the construction and completion of
said public improvements hereinafter mentioned in a manner satisfactory to the City Council of
the City of Tustin; and
WHEREAS the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions of the
contract documents and the Notice of Completion, and acceptance of said public work and
improvement should be filed and payment of the balance due to said contractor authorized in
accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Tustin
that said public work and improvement be accepted, and the same is hereby accepted. Said
public work and improvement is more particularly described as follows:
PEPPERTREE PARK AND MAGNOLIA TREE PARK
RESTROOM RENOVATION (PROJECT NO. 2039)
PASSED AND ADOPTED by the City Council of the City of Tustin at a regular
meeting held on the 20th day of November, 2000.
