HUSTON, CITY MANAGER ARLENE MARKS, DIRECTOR OF HUMAN RESOURCES RESOLUTION RELATING TO SALARY AND BENEFITS OF CONFIDENTIAL EMPLOYEES RECOMMENDATION: Adopt Resolution No. 00-87 amending the City's compensation plan and granting salary and benefit increases to the City's "Confidential" employees for calendar years 2001 and 2002. FISCAL IMPACT: Approximately $29,097 over two years. BACKGROUND AND DISCUSSION: Pursuant to the act that governs labor-management relationships in California local government, the Meyers-Milias-Brown Act (MMBA), public agencies may designate those employees who are privy to information that affects employee relations as "Confidential" employees. These designated employees are excluded from being represented by any employee organization that represents other employees in the agency. This City currently has six classifications (seven employees) that fall within the broad definition of "Confidential" pursuant to the MMBA. In the past the City has generally given its "Confidential" employees the same salary and benefits as those employees represented by the Tustin Municipal Employees Association (TMEA) so that their salaries and benefits remain similar to those in that particular represented unit. However, this year the City has endeavored to end retroactive salary increases and reach agreement with all of its bargaining units prior to the conclusion of our existing contracts. To date we have reached agreement on salary and benefits for all of our represented units other than TMEA. We are hopeful that we will have a successor agreement with TMEA for the December 18, 2000 Council meeting. However, we believe it is in the best interest of the City and our "Confidential" employees to bring forward a recommendation for salary and benefit increases utilizing the same cost parameters established by the City Council for TMEA and our non-sworn police support services unit. The attached ReSolution will authorize a 3.25% increase for classifications in the "Confidential" unrepresented employee group and an increase in the City's contribution to the flexible benefit program of approximately $50 per month per employee effective January 1, 2001 and an increase of 4.50% to be allocated between salary and benefits, at the discretion of the City Manager, effective at the beginning of the first pay period closest to January 1, 2002. In the event the first year costs associated with this Resolution cannot' be absorbed by current departmental budgets, staff will return for a supplemental appropriation at the time the City Council conducts its annual mid-year budget review. Costs for the second year of the Resolution will be included in the appropriate future years' budget. Staff believes this Resolution will ensure that our "Confidential" employees are treated equitably and consistently with those classifications represented by labor associations and that the increases in salary and benefits will enable us to continue to be competitive in our efforts to recruit and retain highly qualified individuals for our "Confidential" classifications. Arlene Marks, SPHR Director of Human Resources Attachment: Resolution 00-87 S:~lOU's\Staff Report Confidential 01 .doc RESOLUTION NO. 00-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION OF CONFIDENTIAL EMPLOYEES WHEREAS, the City now desires to provide increases in compensation to its Confidential employees as a result of a conference with respective Department 'Heads, and subsequent to recommendations of the City Manager. NOW, THEREFORE, the City Council of the City of Tustin, California, does resolve as follows: 8 Section 1. Salary Increase and Flexible Benefits: Effective January 1,2001, the 9 lase salary rates and the salaries of all employees in the Confidential Unit will receive a ;e and one-quarter percent (3.25%) salary increase.
