, NO. 07 AGENDA RI ORT , ..... ....- oo MEETING DATE: DECEMBER 4, 2000 TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT FINAL TRACT MAP 16184 (TUSTIN RANCH ESTATES) SUMMARY: On August 18, 1997, the City Council approved Tentative Tract Map 14396 (portion of Master Tract Map 13627) for the development of 113 custom home sites, an equestrian center, and a 20- acre intermediate school site at the southerly terminus of Pioneer Road, Subsequently, the project was divided into three phases. The applicant chose to implement the project with multiple final maps. Phase I (Tract 15563) included forty-six (46) parcels which were approved on September 14, 1998. Final Tract Map 16184 is the second phase of the project and includes fifty-one (51) parcels. The remainder would be submitted as Final Map 14396. Tentative Tract Map 14396 included numerous conditions to be fulfilled prior to approval of the Final Map. Subject to fulfillment of specified conditions and approval by the City Council, the Final Map may be recorded with the Orange County Recorder's Office. ApplicantJOwner: Standard Pacific Homes RECOMMENDATION That the City Council adopt Resolution No. 00-85 approving Final Tract Map 16184. FISCAL IMPACT The Final Parcel Map is an applicant initiated project. The applicant has paid applicable fees for the processing of this map. DISCUSSION On August 11, 1997, the Planning Commission adopted Resolution No. 3539 recommending that the City Council approve Tentative Tract Map 14396 for the development of 113 estates residential units at the northwest intersection of Tustin Ranch Road and Pioneer Road (Attachment A- Location Map). The City Council approved Tentative Tract Map 14396 on August 18, 1997, by adopting Resolution No. 97-86. The project was subsequently divided into three phases. Phase I, or Final Map 15563 contained forty-six (46) units. Phase II or Final Map 16184, includes fifty-one (51) numbered parcels. These lots include Lots 1-51 for development of estate density homes and lettered lots A-BB for common areas to be owned and maintained by the Tustin Ranch Estates Maintenance Association (Attachment B- FM 16184). Phase III includes 16 units and the potential for a future equestrian center. City Council Report Final tract map 16184 December 4, 2000 Page 2 of 2 Approval of Tentative Tract Map 14396 included numerous conditions to be met prior to approval of the Final Tract'Map. Several conditions have not been satisfied; however, the applicant has requested an expedited review of the final map. Outstanding items include: · Resubmittal of a revised Water Quality Management Plan (WQMP) with corrections as noted in plans returned to Adams Streeter on November 21, 2000; · Resubmittal of a revised Tract Map with corrections as noted in plans returned to Adams Streeter on November 28, 2000; and, · Final approval of the City Attorney as to form for the submitted bonds and agreements. Upon fulfillment of these conditions, the Final Map will be in substantial conformance with the Tentative Parcel Map approvals, the City's Zoning Code and Subdivision Code, and the State Subdivision Map Act. Based upon this conformance, staff recommends that the City Council approve Final Tract Map 16184, subject to completion of Conditions, including, but not limited to, 1.3, 1.5, 2.1, 2.5, 2.8, 3.2, and 5.3 of Resolution No. 97-86 to the satisfaction of the Community Development Department, Public Works Department and the City Attorney prior to recordation. The City Council finds and determines as follows: Ao That Final Tract Map 16184 to subdivide seventy eight (78) acres into fifty one (51) numbered parcels and twenty eight (28) lettered lots (A-BB) for the purpose of developing fifty-one (51) estate density residential units was submitted by Adams Streeter on behalf of Standard Pacific Homes for consideration; Bo That the City Council approved Tentative Tract Map 14396 on August 18, 1997 and that Final Map 16184 is the second final map under Tentative Tract Map 14396; C. Pursuant to Section 15268(b) (Ministerial Projects) of the California Environmental Quality Act (CEQA), the Final Map is considered Statutorily Exempt from the requirements of CEQA. In addition, the project has been reviewed for consistency with the Air Quality Sub- Element of the City of Tustin General Plan and has been determined to be consistent or has been conditioned to be consistent with the Air Quality Sub-Element. D, That, as conditioned, the proposed subdivision is in conformance with the Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map Act and the City's Subdivision Code; E. That the site is physically suitable for the type of development proposed; F. That the site is physically suitable for the proposed density of development; Go That the design of the proposed improvements is not likely to cause substantial environmental damage or-substantially injure fish or wildlife in their habitat; H. The City Council hereby approves Final Tract Map 16184 to subdivide seventy eight (78) acres into fifty one (51) numbered parcels and twenty eight (28) lettered lots (A-BB), for the purpose of developing fifty-one (51) estate density residential units subject to completion of Conditions, including, but not limited to, 1.3, 1.5, 2.1,2.5, 2.8, 3.2, and 5.3 of Resolution No. 97-86 to the satisfaction of the Community Development Department, Public Works Department and the City Attorney prior to recordation.
