APPROVAL OF AMENDMENT A-1 TO COOPERATIVE AGREEMENT NO.
12-238 WITH CALTRANS FOR NEWPORT AVENUE EXTENSION / SR-55
RAMP RECONFIGURATION PROJECT (CIP NO. 7130)
SUMMARY
The proposed amendment for the Cooperative Agreement 12-238 between the City of Tustin and the
State of California (Caltrans) extends the agreement termination date until December 31, 2002
instead of December 31, 2000. The Cooperative Agreement is for the Newport Avenue Extension /
SR 55 Ramp Reconfiguration Project (CIP No. 7130).
RECOMMENDATION
It is recommended that the .City Council approve amendment A-1 of Cooperative Agreement 12-238
and authorize the Mayor and City Clerk to execute the proposed amendment to the Cooperative
Agreement on behalf of the City.
FISCAL IMPACT
Funds to accomplish the work designated as Tustin's responsibilities in the subject agreement are
funded within the current ClP No.7130 budget. This project is funded from a combination of South
Central Redevelopment Agency funds, developer funds and Measure M competitive funds.
BACKGROUND
The Cooperative Agreement 12-238 provides coordination between the State of Califomia and the
City for the Newport Avenue Extension/SR55 Ramp Reconfiguration Project (CIP No. 7130). The
Cooperative Agreement outlines the specific areas of responsibility for environmental, design and
right-of-way exchange/acquisition phases of the project. Refer to the attached location map.
This project will establish a critical link in the accomplishment of the South Central Project Area
infrastructure improvements. The SR55 Northbound Ramp Realignment segment consists of
relocation/demolition of the existing northbound ramps at Edinger Avenue and construction of new
freeway ramps that will connect with the proposed southerly extension of Newport AvenUe between
Edinger Avenue and Valencia Avenue. Additionally, it will include the realignment of Del Amo
Avenue between Edinger Avenue and the new freeway ramps. A separate Cooperative Agreement
will be required to cover responsibilities and funding for the construction phase of this project.

DISCUSSION
The termination date for Cooperative Agreement 12-238 is December 31, 2000. It was anticipated
the design, environmental and right of way acquisition would be completed by this date. However, it
is necessary to extend this date because of additional environmental studies and additional time for
right of way acquisition. Thus, approval of an extension to the termination date to December 31, 2002
is recommended. The City Attorney has reviewed this amendment and approved as to procedure
and form.

AMENDMENT TO AGREEMENT
This AMENDMENT No. A-1 to AGREEMENT 12-238 entered into on

RECITALS

The parties hereto entered into an Agreement (District Agreement No. 12-23 8 Document
No. 14273) on August 3~, 1998, said agreement defining the terms and conditions of a
project to reconstruct the northbound on and off ramps on SR 55 at Edinger Avenue and
real property exchange between STATE and CITY.

The purpose of this Amendment No. 1 is to extend the termination date from December
31't 2000 to December 31't 2002 to resolve real property exchange issues.
IT IS THEREFORE MUTUALLY AGREED:
The termination date specified in Section 14, Article m of the "IT IS THERFORE
MLrrUALLY AGREED" section of the original Agreement shall now be December 31, 2002
instead of December 31, 2000.

The other terms and conditions of said Agreement No. 12-238 (Document No. 14273)
shall remain in full force and effect.

This Amendment No.1 to Agreement No. 12-238 is hereby deemed to be part of
Document No. 14273.
