NOISE REPORT 12-18-00 -, NO. 07 AGENDA )RT .oo MEETING DATE: DECEMBER 18, 2000 TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT INTERIM CONTRACT FOR JOHN WAYNE NOISE ABATEMENT PROGRAM QUARTERLY REPORT SUMMARY: The City Council as part of the 1990-91 budget approved an ongoing request to retain an acoustics consulting firm of J.J. Van Houten and Associates, Inc. to review the JWA Noise Abatement Quarterly Reports. In September of 2000, J.J. Van Houten and Associates, Inc. submitted a request for termination of the Consulting Agreement. As such, an interim consultant is needed to perform the JWA Noise Abatement Quarterly Reports analysis until a permanent consultant is obtained through a competitive procurement process. RECOMMENDATION That the City Council allow Wieland Associates to perform the JWA Noise Abatement Quarterly Report analysis in the interim basis until the City obtained a consultant through a competitive Request for Proposal (RFP) process; and authorize staff to prepare a letter of agreement to secure the interim service. FISCAL IMPACT Wieland and Associates has agreed to provide needed analysis of the JWA Noise Abatement Quarterly Report in the interim basis at the same rate as it has been appropriated for the J.J. Van Houten and Associates, Inc. Therefore, there is no fiscal impact. DISCUSSION The firm of J.J. Van Houten and Associates had been providing noise monitoring and technical document review services to the City since 1987. As part of the 1990-91 budget, the City Council approved an on-going request to retain J.J. Van Houten and Associates for consultant services for airport noise monitoring and related tasks. In September of 2000, Mr. Van Houten submitted to the City a request for termination of Consulting Agreement due to his retirement. In the letter, Mr. Van Houten recommended David Wieland of Wieland Associates, Inc. since Mr. Wieland worked for J.J. Van Houten and Associates, Inc. for eighteen (18) years before starting his own firm in 1998. During City Council Report December 18, 2000 Page 2 employment with J.J. Van Houten and Associates, Inc., Mr. Wieland was responsible for preparing the analysis involved for each of the JWA quarterly reviews. Therefore, Mr. Van Houten highly recommends Mr. Wieland without qualification. Since then, the City has received two quarterly reports from JWA. In the past, these reports were sent to the consulting firm for their analysis prior to reporting to the City Council on the JWA noise status. Since the City must go through a competitive procurement process to retain new consultant, staff is proposing to retain Mr. Wieland in the interim until a permanent consultant is obtained through the RFP process. Of the good things that have come to me, the privilege of being a consultant to the City of Tustin is very high on the list. I am in the process of retiring from the consulting field and therefore request the termination of my agreement with the City. I have &eveloped an extensive file of reports that have been prepared for the City. These involve the review of quarterly reports for John Wayne Airport as well as a sundry of project reports involving various sources of noise of concern to the City. I will maintain these files for at least another two years and will be pleased to provide copies of the reports, if needed. As for the near term needs of the City, such as the review of the airport quarterly reports, I recommend David Wieland, Wieland Associates, Inc. David worked for J. J. Van Houten and Associates, Inc. for 18 years before starting his own consulting firm in 1998. As you are aware, he was responsible for preparing the analysis involved for each of the airport quarterly reviews conducted by my company and has continued to assist me as a consultant in this regard. I highly recommend him to the City without qualification.
