SUMMARY
Redevelopment Law requires that the Redevelopment Agency submit to the legislative
body an annual report of housing activity for the preceding fiscal year.

RECOMMENDATION
it is recommended the City Council and Community Redevelopment Agency take the
following actions:
1. Receive and File the Annual Report of Housing Activity for 1999-2000.

Direct a copy of the Annual Report to be filed with the State Controller and State
Department of Housing and Community Development.
FISCAL IMPACT
There is no fiscal impact associated with this action.
BACKGROUND/DISCUSSION
California Health and Safety Code Section 33080.1 requires the preparation and filing of
an annual report of housing activity by a redevelopment agency, with its legislative body.
A copy of this report-must be filed with the State Controller and also with the State
Department of Housing and Community Development.
The annual report must contain the following information:

'An independent financial audit of the previous fiscal year. The audit must include
an opinion of the Agency's compliance with laws, regulations and administrative
requirements goveming activities of the Agency.
2. A fiScal statement containing the following information:'
a. The amount of outstanding indebtedness of the Agency.

For 2000-2001 the Redevelopment Agency will be continuing with ongoing
:.programs tg' provi~de ~additional Opportunitie, s for affordable housing. These
"prOgrams i~clude~'~e 'FirSt~'Ti~e' Ho~eb~j'yers DownpaYi:n~nt Assistance
Program, Mortgage" Credit certificate Program, and rehabilitation of
dwelling units through the Housing Rehabilitation Program. In addition,
the Agency will continue negotiations with Property Owners and
developers in the Southwest Neighborhood regar, ding redevelopment
objectives and options in the area in furtherance of the Planning Study for
Housing Opportunities in the South Central Project Area, the City-wide
Comprehensive Affordable Housing Strategy and the Second Five-Year
Housing Implementation Plan completed during the 1999-2000 reporting
period.

e. As of June 30, 2000, the accrued balance in the Agency's Iow to
moderate-income housing set-aside fund for the South Central Project
Area was $3,438,643.
f. As of June 30, 2000, the accrued balance in the Agency's Iow to
moderate-income housing set-aside fund for the Town Center Project
· Area was $1,731,702.
g. As of June 30, 2000,' there are excess surplus funds in the Housing Fund
for the combined Project Areas in the amount of $70,199. It is anticipated
that the excess surplus funds will be encumbered during FY 2000-2001.

established October 20, 1976, pursuant to the. State of Califomia'Health and Safe/5' Code,
Section 33000, entitled "Community Redevelopment Law". Its purpose is to prepare and carry out
plans for improvement, rehabilitation and redevelopment of blighted areas within the territorial limits
of the City of Tustin. The City provides management assistance to the Agency, and the members of
the City CoUncil also act as the governing body of the Agency.
In accordance with GASB Code Section 2100, "Defining the Reporting.Entity", the Agency' s financial
activities .will be included (blended) with the financial activities of the City of Tustin for reporting
purposes.

The Agency's primary soUrCe of revenue, other than lo-an~ and advances from the City, comes from
property taxes. Property taxes allocated-to the Agency are computed in the following manner:

The Agency follows the practice of pooling cash and investments of all funds. Interest income earned
on pooled cash and investments is allocated based on the weighted average cash balances in each fund
receiving interest. In February 2000, the Redevelopment Agency began processing all cash activity
in a pooled account with the City of Tustim The overdraft of $2,934,944 represents the Agency's share

In December 1995, the Agency entered into an agreement with a developer whereby the Agency is to ·
loan the developer an'mount not to exceed $397,183 for the development ah/i'b//emfi6n of a 145 unit,
single-family, own~...oCcUp.ied prOJec.~¢, .accor,d~ce with the agreement, the mounts disbursed shall
accrue, interest at tii~7'~ate'/bf.7%~p~,;~ar,.'c0~p0uiided monthly, from the applicable dates of
disbursement. PortibnS 6fthe-pringip..~' and relitsd a6cimed interest shall be forgiven'upon ~he Close
of escrow of the' .ninety-fn-st and one htindredrninth' of the. units, and the remaining principal and
accrued interest shall be forgiven up°n the close of escrow for the last of the one hundred forty-five
units. Principal and interest are repayable only upon developer default under terms of the agreement.
Due to the contingent repaymeni schedule, the Agency records an expenditure when a portion of the
loan is made and no receivable is included in the financial statements. The balance of the loan
outstanding at June 30, 2000 is $44,932. '.

material weakness is a condition in which the design or operation of one or more of the internal control
components does not reduce to a relatively low level the risk that misstatements in amounts that would be
material in relation to the financial statements being audited may occur and not be detected within a timely
period by employees in the normal course of performing their assigned functions. We noted no matters
involving the internal control over financial reporting and its operation that we consider to be material
weaknesses. However, we noted other matters involving internal control over financial reporting that we
hhve reported to management of the City of Tustin in a separate letter dated October 5, 2000.
