HomeMy WebLinkAboutORD 44 (1936)ORDINANCE NO. 44 ORDINANCE REGULATING THE KEEPING OF ANIMALS, POULTRY, AND LIVE STOCK IN THE CITY OF TUSTIN; CALIFORNIA. The City Council of the Oity of Tustin do ordain as follows: SECTION L. It shall be unlawful for any person, firm or corporation to keep or maintain, or to cause to be kept or maintained, any horses, mules, cows, cattle, sheep, goats, hogs or other domestic animal on any premises within the city limits of the City of Tustin. SECTION 2. It shall be unlawful for any person, firm or corporation, to keep or maintain turkeys, ducks, geese, chickens, pigeons, or other fowls, or rabbits, within fifty/(50) feet of any family residence or building designated for human occupancy, their own included, within the city limits of the City I of Tustin. SECTION j. It shall be unlawful for any person, firm or corporation to keep, or maintain more than twenty-five (25) in number of any turkeys, ducks, geese,chickens, pigeons, or other fowls, or rabbits, within the city limits of the City of Tustin, unless a special permit shall be issued therefor by the City Council of the City of Tustin, subject to the rules or regulations ;provided for herein by the Health Department of the Uity of { Tustin. i I That any person, firm or corporation maintaining more than twenty-five (25) in number of any turkeys, ddeks, geese, chickens, pigeons, or other fowls, or rabbits, shall be consid- ered as conducting, maintaining and carrying on a commercial Poultry yard, and shall be subject to the following rules and regulations of the Health Department of the City of Tustin apper- taining thereto; REGULATIONS (a) All buildings, pens, runs or otherplaces where such rabbits,chickens, turkeys, ducks, geese, pigeons or other fowls are kept, shall be located at least fifty 050) feet from any residence, their own included. W (b) The floors of every such building shall be smooth and tight, and maintained so as to prevent accumulation of filth or water or harboring all rodents thereunder. (c) The floor area of every such building shall be of sufficient area so as to allow for two and one—half (2 1/2) square feet per fowl. (d) All dead fowls, manure, refuse, feathers, etc., shall be�removed within a reasonable time, or kept in fly—tight containers until such removal. (e) If runs are provided and the formation of ground therefor cannot be kept in a clean and sanitary condition at all times as required by the Health Department of the City of Tustin, then the floor of said runs or pens shall be constructed of,cement, said cement to be laid so as to prevent rodents from entering thereunder. (f) 'Rabbits must be kept in hutches so constructed as hot to allow the urine to pollute the ground and provided with floors that are removable for the purpose of cleaning and disinfecting; -no box hutches will be permitted. SECTION 4. That when the application of any applicant for a permit to maintain and operate a commercial poultry yard has been first approved by the City Council of the City of Tustin, and when such applicant, after such first approval had, has com— plied with the regulations as contained within this Ordinance, the City Council of the City of Tustin must issue a permit t6 said applicant to maintain and operate said poultry yar. SECTION 5: This Ordinance shall in no wise affect or concern the keeping of dogs, cats, parrots, canary birds, or any other house birds. SECTION 6: Any and all reasonable regulations of the Department of Health as to time, place and manner of inspection of poultry, and of commercial poultry yards, shall be complied with by poultry raisers and their employees. SECTION 7 Any person, firm or corporation violating anis of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than Five Hundred ($500.00) Dollars, or by imprisonment in the County Jail of the County of Orange for not more than six (6) months, or by both such fine and imprisonment. SECTION S: If any section, sentence, clause or phrase Of this ordinance is for any reason held to be unconstitutional, or invalid, said decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, sentence, clause and phrase thereof irrespective of the fact that any one or some other sections, sentences, clauses or phrases be declared unconstitutional or invalid. SECTION 9: All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 10: The City Clerk is hereby directed to cause this ordinance to be published once in the Tustin News, a weekly newspaper of general circulation published and circulated in the City of Tustin, and hereby designated for such purpose by the City Council.
