We respond to the expanding demands of our customers, your constituents, for wireless telephone service. At thi.~ stage, we are generally supportive of the draft ordinanze with the excepfon ofundergrounding requirements. Undergro~g in many instances is a bad solution for both thc carrier and the city. Urgiergrounding causes adverse knpazts to tr~e, street degradation, and other operating un]ities. Typically' aesthetics drives the need for undergrotmdi~. There is mm~inal aesthetic bene~ for a ~o~cant downside. Thc aesthetic behest is marginal because there will still be above ground equ/pment for metexing ventilation and in some cases, access. A Myers meter (19 cubic fe~t) would still be required. We would argue that the above ground cubic foot savings would be less than 15 cubic feet. There are m/Ogation measures such as landscaping that blends the cabinet with tl~ surro~ area. In parts of Los Angeles, a local artist was given a stipend to paint a scene on the cabinet. In some zoning districts, such as Industrial, there is not a compan'hility issues with above ground c-quipmcnt. The below ground i ,~vacts to underground arc significant. We would place a 35 cubic foot cabinet ina Contxolled Equipment Vault (CEV) thgt would me, asurel0' by 8"by $'. The city compronlises its ab~ to place othex substru~e such as water, sewer, fiber optic infrastructure. Them is a danger that pipes, conduit and wiring would be adversely impacted. Further, thc construction of a -~matt would be more disruptive as it re, quires a backhoe and closure of tra~c lanes during consmu:tion and potentially mainteo~nec. There are also street degradation issues with undergroun~g. There are significant financial costs to underground. We would hope that the city would work with us to provide service in an ei~icient manner. Mandating undergrounding without consideration of technological, economic, and logistical t~etors is an unreasonable burden for the carrier. There is also a cost to the city. The c~ty is charged with managing its public rights-of-way, undergrounding wireless cabinets poses impacts with street degradation, trai~e, and operating of other utilities. It is our position that provisions mandating undergrounding o£ facilities unless the carrier' can demonstrate that undergrounding is not technologically feasible needs to be moderated to take into account economic and logistical factors. The standard should not simply be technological. This would require changes to the language proposed in Section 5 (j), Section 7.2(a)(1) and Section 7.1(c). We propose that the language be revised to include "economic and logistical factors." We did discuss this provision with staff and staff ~adieated that the current implementation of undergrounding does take into account economic and logistical factors a~s well as the surrounding area.
