PUBLIC HEARING (ITEM 1) 1 ACTIONS RELATING-TO JOINT PUBLIC HEARING IN CONNECTION WITH THE 1999 .AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE SOUTH CENTRAL AREA REDEVELOPMENT PROJECT The City Council is requested to open and hold a joint public hearing of the City Council and the Redevelopment Agency on the 1999 Amendment to the Redevelopment Plan for the South Central Area Redevelopment Project. The 1999 Amendment proposes to re-establish the Agency's eminent domain authority for twelve years. Recommendation by the Redevelopment Agency staff: 1. Transmit and receive the proposed 1999 Amendment and Report to City Council. 2. Open and hold the joint public hearing of the City Council and the Redevelopment Agency on the proposed 1999 Amendment to the Redevelopment Plan for the South Central Area R~iil%r~~i~ p~ll~ct. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $710,983.16 and ratify Payroll in the amount of $379,703.08. e CENSUS 2000 UPDATE Recommendation: Receive and file Community Development Department. subject report as recommended by the 5, PROJECT FUNDING FOR THE MOTOR VEHICLE REGISTRATION SUBVENTION FUNDS (ASSEMBLY BILL 2766) PROGRAM Recommendation: (1) Authorize the use of' City AB 2766 funds for the Tustin Commuter Rail Station, and (2) Authorize the City Manager to approve additional AB 2766 expenditures, consistent with Air Quality Management District guidance, throughout the 1999-00 program year as needed as recommended by the Community Development Department. m AWARD OF CONTRACT FOR HOUSING ELEMENT PREPARATION Recommendation: Authorize the Community Development Director to enter into a contract with The Planning Center for preparation of the mandated 1998-2005 City of Tustin Housing Element as recommended by the Community Development Department. YEAR 2000 PLAN UPDATE REPORT- OCTOBER Recommendation: Receive and file subject report as recommended by the Finance and Community Development Departments. , AUTHORIZATION TO EXECUTE A MEMORANDUM OF AGREEMENT UNDER SECTION 106 OF THE NATIONAL HISTORIC .PRESERVATION ACT FOR THE MCAS TUSTIN PROJECT Rec~n'a~aclati~q~, ~Aorove the Section 106 Memorandum of Agreement for MCAS ~~I~I' i ~gen a - City Council October 4,1999- Page 2 1 10. 11. 12. 13. Recommendation: Approve the Section 106 Memorandum of Agreement for MCAS Tustin subject to corrections requested by the City and authorize the City Manager or Assistant City Manager to execute said Agreement subject to approval of the City Attorney as recommended by the Assistant City Manager. APPROVAL OF AMENDMENT NO. I TO THE MASTER FUNDING AGREEMENT NO. C-95-993 WITH ORANGE COUNTY TRANSPORTATION AUTHORITY FOR PROJECTS FUNDED BY MEASURE M Recommendation: Approve Amendment No. 1 to Cooperative Agreement No. C* 95-993 with the Orange County Transportation Authority, and authorize the Mayor and City Clerk to execute the agreement on behalf of the City as recommended by the Public Works DePartment/Engineering Division. RESOLUTION NO. 99-83 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF A NOTICE OF COMPLETION FOR THE EAST TUSTIN LANDSCAPE REPLACEMENT PROJECT (ClP NO. 700159) Recommendation: Adopt Resolution No. 99-83 accepting said works as complete and authorizing the recordation of the Notice of Completion and direct the City Clerk to: (1) Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion, and (2) Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion as recommended by the Public Works Department/ Field Services Division. RESOLUTION NO. 99-72. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN FILES Recommendation: Adopt Resolution No. 99-72 authorizing destruction of 'Engineering records as recommended by the Public Works Department/ Engineering Division. SOLID WASTE FRANCHISE AGREEMENT AMENDMENT NO. 5 Recommendation: Approve Amendment No. 5 to the Agreement for the Collection and Transportation of Solid Waste Refuse with Great Western Reclamation, a division of Waste Management, Inc. as recommended by the Public Works Department. _ _ PLANNING COMMISSION ACTION AGENDA- SEPTEMBER 27, 1999 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. ABOVE GROUND CABINETS DESIGN GUIDELINES AND ORDINANCE Ordinance No. 1213 and the Above Ground Cabinet Design Guidelines would establish regulations pertaining to the installation of above ground cabinets for the public right-of-way. Recommendation by the Community Development Department: 1. Have first reading by title only and introduction of the following Ordinance No. 1213: ORDINANCE NO. 1213 - AN ORDINANCE OF THE CITY COUNCIL OF THE .CITY OF TUSTIN, CALIFORNIA, 'ADOPTING REGULATIONS FOR ABOVE GROUND CABINETS WITHIN THE CITY'S RIGHT OF WAY 2. Adopt the following Resolution No. 99.84: RESOLUTION NO. 99-84 . OTHER BUSINESS - City Manager, City Attorney, City Council COMMITTEE REPORTS - City Council CLOSED SESSION - The City Council shall convene in closed session to confer with the City Attorney regarding pending litigation to which the City is a party: (1) Sara Pashalides v. City of Tustin, et.al., OCSC Case No. 801875; and (2) Diamond Cab, et.al. v. City of Tustin, et.al., OCSC Case No. 81'3738; and to confer regarding significant exposure to litigation pursuant to Government Code Section 54956.9(b) two cases. ADJOURNMENT - The next regular meeting of the City council is scheduled for Monday, October 18, 1999, at 7:00 p.m. in the Council Chamber at 300 Centennial Way.
