HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - EAST TUSTIN LANDSCAPE REPLACEMENT PROJECT (CIP NO. 700159) ISUMMARY . . . This project accomplished the removal and replacement of 10,700 diseased plants in the Tustin Ranch area along with a new' irrigation system in the public right-of-way at Sycamore Avenue and SR55. The project has been completed to the satisfaction of the Public Works Department and is ready for acceptance by the City Council. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 99-83 accepting said works as complete and authorizing the recordation of the Notice of Completion and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (3 5) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion,.that the Council authorize payment of the final retention in the amount of $15,333.60. This amount together with previous payments of $231,060.49 represents 100% of the final contract amount. FISCAL IMPACT The final cost of the construction contract was $246,394.09. additional replacement plants and replace faulty irrigation lines. This amount includes six change orders to add BACKGROUND The purpose of the East Tustin Landscape Replacement Project was to remove and replace the Oleanders that had been infected with the Oleander Leaf Scorch Disease. Subsequently, change Orders were issued to replace approximately 500 diseased Pyracantha plants, replace and add irrigation lines, and add additional landscaping in the Sycamore Avenue parkways east of SR55. The contractor was Accurate Landscape & Maintenance. This work has been completed to the satisfaction of the Public Works Department. Serlet Director of Public Works/City Engineer TDS:WA:ccg:Final acceptance of Public Improvements ETLR Proj. &Reso 99-83.doc Attachment Wisam Altowaiji Field Services Manager' .1.8 RESOLUTION NO. 99-83 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF A NOTICE OF COMPLETION FOR THE EAST TUSTIN LANDSCAPE REPLACEMENT PROJECT, (CIP NO.700159) WHEREAS, Accurate Landscape and Maintenance. having a contract with the City of Tustin to construct the hereinafter described public works and improvements: and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements, hereinafter mentioned, in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: EAST TUSTIN LANDSCAPE REPLACEMENT PROJECT, (CIP NO.700159) AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
