HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES CONTRACT AMENDMENT FOR ADDING SYCAMORE LANDSCAPE MAINTENANCE AREAS TO THE EXISTING CONTRACT WITH PLANT CONTROL LANDSCAPE MAINTENANCE, INC. SUMMARY Approval of a fourth contract amendment with Plant Control Landscape Maintenance, Inc., will add the Sycamore landscape areas to the agreement for Landscape Maintenance Sen, ices for General Fund Areas, the Senior Center. and the Maintenance Facility, and provide a price increase of $362.84 per month, effective October 5. 1999. RECOMMENDATION It is recommi~nded that the City CoUncil approve the fourth amendment to the contract agreement between Plant Control Landscape Maintenance. Inc. and the City of Tustin for landscape maintenance services, subject to City Attorney.' approval. FISCAL IMPACT The $362.84 will increase the monthly contract price to $11.855.74 and increase the annual contract total amount to $141.133.54. The increase in the monthly service fee was anticipated and was incorporated into the 1999/2000 Fiscal Year Budget. DISCUSSION The City has contracted with Plant Control Landscape Maintenance. Inc. since August 1. 1996 for maintenance of ali General Fund areas including ali center islands and specific City and Water Operations facilitiies. The original agreement was for a l-vear period with three l-year extensions available to the City. The contract is currently in the third and final l-year extension, from July 1. 1999 through June 30, 2000. The fourth amendment, adds. additional landscape areas and would grant the contractor a $_,6_.84 increase in the monthly base price of the contract, effective October 5. 1999. Plant Control Landscape Maintenance. Inc. requested a $500.00 increase in tile contract amount for tile addition areas. However. staff negotiated a $362.84 increase for the additional areas. The overall increase to the contract price is $3.218.74. for the remaining a 9-month period of the contract. · Plato Control Landscape Maintenance. Inc. has provided consistent service of a reasonably high quality tbr the past 3-years and has been very responsive in the correction of any service that was not up to City standards. The additional landscaping will have no effec~ on the Contractor's ability to provide tile quality and responsiveness the Cit3 has received previously. Tim D. This Amendment is made with reference to the following: RECITALS WHEREAS, City and Contractor entered into an Agreement dated November 11. 1996, tile "Agreement", wherein Contractor agreed to perform landscape ~naintenance services, in accordance with the agreement and specifications entitled "Landscape Maintenance Services for General Fund Areas, Senior Center and Maintenance Facility": WHEREAS, City and Contractor entered into the First Amendment to that Agreement on November 20, 1997, entered into the Second Amendment to that Agreement on September 8, 1998, and entered into the Third Amendment to the Agreement on May 17th, 1999: C. WHEREAS, tile initial term of the Agreement was one 3'ear, with three, one 3'ear extensions: D. \VHEREAS. City and Contractor desire to add the landscape maintenance of additional areas to the Agreelnent. and also desire to adjust Contractor's compensation under the Agreement to reflect a negotiated, price increase for those areas. AGREEMENT The Agreement is hereby amended as follows: A. The areas of landscape maintenance sen, ices to be provided by the Contractor under this Agreement, is amended to include the following areas: Sycamore Avenue parkway's, north and south side. b~tween Newport Avenue and the S R 55 freeway. B. City shall pay the Contractor the following sums for the periods indicated: From October 5. 1999. to June 30. 2000. tile City shall pay tile Contractor on a monthly basis, an additional $362.84 per month, which will bring tile total monthly compensation amount equal to S11.855.74. City shall pay tile Contractor a sum not to exceed $3.218.74. for additional landscape maintenance sen'ices, for the period from October 5. 1999 lo June 30. 2000. C. Except as expressly' amended by this Fourth Amendment. all other terms and conditions of tile Agreement and ali attachments and exhibits thereto, shall remain in full force and effect.
