HomeMy WebLinkAboutORD 36 (1933)TJV ORDINANCE NO. 36 AN ORDINANCE OF THE CITY OF TUSITIN, CALIFORNIA, AMENDING SECTIONS 38, 41, 42, 62, and 88, OF ORDINANCE NUMBER 4, AND AMENDMENTS THERETO. The 'City Council Of the City of Tustin ordains as follows:. SECTION 1: That Section 38 Of Ordinance Number 4, and amendments thereto, is - hereby amended to read as follows: "SECTION 38: For every person, firm or corporation carrying on the business of selling bread, pastry, or other bakery goods, at retail, from a wagon or other vehicle, operating from a bakery establishment maintained within the City of Tustin, and baking their products within the City of 'Tustin, §20,00 per yeax. SECTION 38A: For every person, firm or corporation carrying on the business of selling bread, pastry, or other bakery goods, at retail, f iom a wagon or other vehicle, which bakery goods are baked in an establishment without the City of Tustin, and who does not maintain a regular place of business in the City of Austin for which a license is paid under another proviaion of this Ordinance, the sum of 020.00 per year for each wagon or other vehicle." SECTION 2: That Section 41 of Ordinance Number 4, and amendments thereto, is hereby amended to read as follows: SECTION 41: For every person, firm or corporation conducting or carrying on the business of selling or peddling fruit or vegetables, at retail, from a wagon, or other vehicle, and not having a stand, and not paying a license under another provision of this Ordinance $20.00 per year for each such wagon or other vehicle." -1- i156 4 SECTION 3: That Section 42 of Ordinance Number 4, and amendments thereto, is hereby amended to read as follows: SECTION 42:_ For every person, firm or corporation engaged in the business of selling or peddling meat, fish, or poultry, at retail, from a wagon or other vehicle, and not having a fixed and established place of business in the City of Tustin; and not paying a license under another provision of this Ordinance, 020.00 per year for each such wagon or other vehicle." SECTION 4: That Section 62 of Ordinance Number 4, and amendments thereto, is hereby amended to read as follows: "SECTION 62. For every person, firm or corporation not specifically mentioned in this Ordinance, conducting, managing, or carrying on the business of running, driving, or operating any automobile, automobile truck, automobile tank, wagon, or other vehicle used for the transportation of baggage, freight, household goods, merchandise, lumber, brick, cement, oil, rock, - or gravel, or who shall, by means of any such vehicle, sell or distribute merchandise at wholesale within the City of Tustin, and for which business a license fee is not fixed by any other section of, Ordinance Number 4, or by any other Ordinance of the City of Tustin, the sum of $12.00 per year for each such vehicle. 'SECTION 5: That Section 88 of Ordinance Number 4, and amendments thereto, is hereby amended to read as follows: SECTION 88: For every person, firm or corporation engaged in a gainful occupation or pursuit not herein enumerated and for which occupation the City of Tustin has a legal right to require a license, and not including any occupation, calling, Pr business which pays a franchise taxi to the City,of Tustin, and not including any occupation, calling, or business for which a license fee is fixedrby any other Ordinance of the City of Tustin, $20,00 peryear." -2- .......... SECTION 6: If any section, sub -section, sentence, clause or phrase of this ordinance is for any reason held to be 2e, invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of the ordinance. The Council of the City of Tustin hereby declares that it would have passed this ordinance, and each section, sub -section, sentence, clause and phrase thereof,, irrespective of the fact that any one or more of the sections, sub -sections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 7: All ordinances or parts of ordinances, to the extent that the same conflict herewith, are to that extent hereby repealed. The City Clerk shall certify to the passage of this Ordinance -and cause the same to be published once in the 2ustin mews, a daily newspaper printed, published and -circulated in the City of Tustin, and said Ordinance shall take effect 30 days from the date of its final passage.
