RECOMMEN-DATION
Approve the attached Amendment No. 1 to the Agreement between the City of Tustin and Orange Children
and Parents Together, Inc.
FISCAL IMPACT
The amendment would provide for a $10,000 per year reduction in rent for the remaining term of the
Agreement; 1999, 2000, 2001. The total rent reduction would be $30,000.
BACKGROUND
The Tustin Community Redevelopment Agency entered into a lease agreement with Orange Children
and Parents Together, Inc. (OCPT) in February of 1997 to provide Head Start child development
programs at the newly improved Tustin Family & Youth Center. The terms of the lease provided the
Redevelopment Agency a rental return for the utilization of the premises, in order to support a
Resolution of Benefit for the improvement of the Center.
The City of Tustin provided a commitment to Orange Children and Parents Together, Inc. from
Community Development Block Grant funds to assist them in the payment of the rent. OCPT requested
$27,222 in CDBG funding for rent payments and facility maintenance fees for FY 1999-00.
Dunng the 1999-00 FY review of CDBG fund allocations, an overwhelming need was identified for
other public service funding. As a result, it was recommended that a reduction in the CDBG allocation
for OCPT be considered. Last year's adopted CDBG allocation found that the CDBG appropriation to
OCPT was reduced by $10,000. It was subsequently agreed that their lease payment reimbursement
would also be reduced by $10,000 to offset the reduction. Therefore, the Amendment to the Agreement
between the City of Tustin and Orange Children and Parents Together, Inc. is recommended.
Originally, the CommuniW Redevelopment Agency held title to the property,, and a Resolution of Benefit
for a rent reduction needed to be established. On November 1, 1999, the Council approved the transfer
of the property from the Redevelopment Agency to the City to alloTM this Amendment to the Agreement
to go forward. The proposed Amendment No. 1 to the Agreement with OCPT would help ensure that the
critically needed Head Start programs would continued to be offered in southwest Tustin.
OCPT has successfully provided Head Start child development program services at the Tustin Family &
Youth Center since it opened in March 1997. Presently the program is filled to capacity, with 102
children enrolled in two sessions. The program is highly rated by the City, because it provides critically
needed early childhood education and family services for low and moderate income families.

This Amendment No. 1, dated for purposes of identification only this day of ,1999, is
made and entered into between the City of Tustin, a municipal corporation, (herein after referred to
as '"City"), and Orange Children and Parents Together, Inc., (herein after referred to as "OCPT").
RECITALS
1. This Amendment is preceded by the Lease agreement between the Tustin Community
Redevelopment Agency and OCPT dated February 2, 1997. The term of.the Agreement was for
five years; 1997, 1998, 1999, 20.00, 2001.
NOW THE~FO~, for and in consideration of the mutual promises, covenants, and
conditions contained herein, the parties agree as follows:
AGREEMENT
1. Rent
The City shall reduce annual rent for OCPT by ten thousand dollars ($10,000) per year for
the remaining term of the Agreement; 1999, 2000, 2001.
2. A~eement remains in effect
Except as specifically amended herein, all other terms and conditions of the Agreement
shall remain in effect.
3. Notices

4. Conclusion
IN WITNESS WHEREOF, City has authorized this Amendment to be executed for and on
behalf of the City of Tustin by the Director of Parks & Recreation, and Lessee has caused the same
to be executed by its duly authorized officer on the date above written.
