ORDINANCE 170. 32. i I AN ORDINANCE 01" THE CITY OF TUSTIN, CALIFORNIA, AMNDING SECTIONS 12, 13, 25, 37, 38, 39, 41, 429 59, 62. 699 and 86, OF ORDINANCE NO. 4, AND AMENDMENTS THERETO, IF ANY'. The City Council of the City of Tustin ordains as follows: SECTION I: That Section 12 of Ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows "SECTION 12: For every person, firm or corporation conducting, managing, or carrying on business of distributing advertising samples, hand bills, dodgers, or printed advertise- ments of any kind, in the City of Tustin, 05.00 per day; pro- vided that no license shall be required from any person, firm, or corporation maintaining a regular place of business within the City of Tustin, and advertising his or, its own line of goods, and paying a regular license under another section of this Ordinance. For the purpose of this section, the expression "carrying on the business" is defined to be, and is construed to mean the doing of any acts, or series of acts, of distributing or advertising in any means, or in any manner, in this section specified." SECTION 2: That Section 13 of Ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows: "SECTION 13 For every person, firm, or corporation, operating or carrying on the business of advertising by leasing, operating or maintaining bill boards in the City of Tustin, $25.00 per year for the first bill board, and (10.00 per year for each additional bill board so leased, operated or maintained within said City, provided that the bottom of all bill boards shall be not less than three (3) feet from the ground, and provided further that no bill board shall be.of greater dimen- sion than twenty (20) feet in length, or eight (8) feet from top to bottom, such measurement covering the advertising space thereof; and provided further that no license shall be required under this section from any person, firm. or corporation main- taining a regular place of business within the City of Tustin and advertising his or its own line of goods, and paying a regular license for such business under another section of this Ordinance4 SECTION 13A: For every person, firm or corporation conducting, managing, or carrying on the business of advertising by posting, sticking, tacking, fixing, or painting bills or signs to, or upon, posts, fences, buildings, or other structures, except bill boards, or advertising sign boards, $25.00 per year; provided, however, that no license shall be required under this section from any person, firm, or corporation maintaining a regular place of business within the City of Austin and adver- tising his or its own line of goods, and paying a regular license for said business under another section of this Ordinance. SECTION 13B Provided that nothing contained in the preceding Sections 13, and 13A, shall be deemed or construed as applying'to'the owners of real estate, or th it agents, in advertising their property for sale or lease by means of bill boards or signs located upon the property advertised for sale or lease, by such bill boards, or advertising.sign boards, or signs." SECTION 3: That Section 25 of Ordinance No. 4, and amendments thereto, if any, is hereby amended'to read as follows: -2- 131 SECTION 25: For every person, firm. or corporation engaged in the business of, or who solicits, or takes orders for, or agrees to deliver Upon orders for cleaning, dyeing or reno- vating articles or personal apparel or household furnishings, or has or maintains a fixed and established place of business in the City of Tustin, $20.00 per year. SECTION 25A: For every person, firm, or corporation engaged in the business of, or who solicits, or takes orders for, or agrees to deliver upon orders for cleaning, dyeing, or renovating articles of personal apparel or household furnishings, and who does not have and maintain a fixed and established place of business in the City of Tustin, $25.00 per year." SECTION 4: That Section 37 of ordinance No. 4, and amendments thereto, if any, is.hereby amended to read as follows: AZ "SECTION 37: For every person, firm, or corporation conducting, -managing, or carrying on the business of a laundry, or operating a vehicle collecting or delivering laundry within the City of Tustin, 420-00 per year foreach separate place of business, I or for each separate vehicle; and in addition thereto shall pay a license in connection4ifor each laundry office or agency maintained in connection with such business within the City of Tustin,.and separate and apart from the place of business of said laundry. Provided, however, that where laundry I work is done or performed by members of one family, or where not more than two persons are employed for oompensatioh, then $10.00 per year. Provided further that this Section does not include the busine ps of, or the soliciting, or taking orders for, or agreeing to I deliver upon orders for cleaning,, dyeing, or renovating articles of personal apparel or household fur- nishingB, or . operating a vehicle collecting or delivering such work within the City of Tustin, but such business and such activities shall require a separate license which is provided for in Section 25 of this Ordinance as amended." -3- SEOTION 5: That Section_38 of Ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows: "SECTION 38: For every person, firm, or corporation carrying on the business of selling bread, pastry or other bakery goods, from a wagon or other vehicle, or from bakery establishments Mintained within the City of Tustin, and baking their products within the City of Tustin, X20.00 per year. SECTION SBA: For every person, firm, or corporation carrying on the business of selling bread, pastry, or other bakery goods, at retail, from wagon or other vehicle, which bakery goods are baked in an establishment without the City of Tustin 036.00 per year for each wagon or other vehicle." SECTION 6: That Section 39 of Ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows: "SECTION 39: For every person, firm, or corporation engaged in the business of selling or delivering,milk'at retail within the City of Tustin from a wagon or other vehicle, $20.00 per year for each wagon or vehicle." SECTION 7: That Section 41 of Ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows: "SECTION 41: For every person, firm, or corporation li l �cundnetng or carrying on the business of peddling fruit or vegetables from a wagon, or other vehicle, not having a stand, and not paying a license under another provision of this Ordinance §36.00 per year per wagon or other vehicle." SEOTION 8• That Section 42 of ordinance No. 4, and amendments thereto, if any, is hereby.amended to read as :follows: "SECTION 42: For every person, firm, or corporation engaged in the business of selling or peddling meat, fish or poultry from a wagon, or other vehicle, and not having a fixed and established place of business in the City of Tustin, and not paying a license under another provision of this Ordinance# $36.00 per year for each wagon, or other vehicle." -4- LM SECTION 9: .That Section 59 of Ordinance No. 4, and amendments therto, if any, is hereby amended to read as follows; "SECTION59: For every person, firm or corporation conducting, managing, or carrying on.the business of job print- ing or soliciting orders therefor, ,or operating a job printing establishment, §10.00 per year. SECTION 596; For every person, firm or corporation who prints or publishes a newspaper within the City of Tustin, or who circulates therein, or solicits subscriptions therein for any newspaper, 410.00 per year." SECTION 10;, That Section 62 of Ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows: "SECTION 62: For every person, firm or corporat on not specifically mentioned in this Ordinance, conducting, managing, or carrying on the business of running, driving or operating any automobile, automobile truck, automobile tank, wagon, or other vehicle, used for the transportation of baggage, freight, household goods, merchandise, lumber, brick, cement, oil, rock, or gravel, shall pay a license fee of ;20.00 per quarter for each such vehicle. SECTIUB 11: That Section 69 of ordinance No. 4, and amendments thereto, if any, is hereby amended to read as follows. a"S$CTIONC69 F6r every person, firm, or corporation conducting, managing, or carrying on the business of painting, cement work, sewer work, plastering, masonry, brick mason, floor polisher, wall paper hanger, builder, and any person, firm, or corporation engaged in the business of contracting on buildings or structures, or in regard to the kinds of work in this Section mentioned, either as independent or sub -contractors, within the City of Tustin, and who maintains an office or place of business within the, City of Tustin, X10.00 per year; for each such person, firm, or corporation not maintaining either an - 5- offiee.or place of business within the City of Tustin, $20.00 per year; provided that a general contractor who as such performs work under any or all of the foregoing lines of business without sub -letting to independent contractors any of said separate lines of -business in such general contracting business of work, shall pay the sum of $30.00 per year,.payable annually. For the purpose of this ordinance the terms "Contractor", and Contracting", as used in this Section, are defined to be the business of contracting to do, or doing each, all, or any of the kinds of work or lines of business mentioned in said Section 69, whether the contract be oral or -in writing, and shall also include every person, firm, or corporation, furnishing both labor and material, or furnishing labor and sell- ing material, on the same contract or job, regardless of whether such contract be for a definite sum, or be performed and to be paid for on the basis of time consumed and materials used." SECTION 11: That Section 88 of Ordinance No. 4 and amendments thereto, if any, is hereby amended to read as follows: "SFCTION 88: For every person, firm, or corporation engeged in a gainful occupation or pursuit not herein enumerated, and for which oeeudpation the City of Tustin has a legal right to require license of, and not including any occupation or calling or business which pays a franchise tax to the City of Tustin, $20.00 per year. SECTION 12: If any section, sub -section, sentence, clause or phrase of .this ordinance is for any reason held to be invalid.or unconstitutional such decision shall not affect the validity of the remaining portion of the ordinance. The Council of the City of Tustin hereby declares that it would have passed this ordinance, and each section, sub -section, sentence, clause and phrase thereof, irrespective of the fact that any one or more of the sections, subsections; sentences, clauses or phrases be declared invalid or unconstitutional- -6- im SECTION 13: All ordinances or parts of ordinances, to the extent that the same conflict herewith, are to that extent hereby repealed. The City Clerk shall certify to the passage of this Ordinance and cause the same to be published once in the Tustin News, a daily newspaper printed, published and circulated in the City of Tustin, and said Ordinance shall take effect 30 days from the date of its final passage.
