STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 13-16 ACCEPTING THE DEDICATION OF SPECIFIED PROPERTY IN TUSTIN LEGACY FOR PUBLIC STREET PURPOSES AND ACCEPTING INTO THE CITY'S SYSTEM OF STREETS SUMMARY As a part of the development of The District by Vestar and Columbus Square by Lennar, certain property located on the former site of the Tustin Marine Corps Air Station was reserved and constructed for street purposes. The proposed resolution would dedicate and accept this property for public street purposes as well as accept these street improvements into the City's system of streets pursuant to Streets and Highways Code section 1806. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 13-16 accepting the dedication of specified property in Tustin Legacy for public street purposes and accepting this property into the City's system of streets. FISCAL IMPACT There is no fiscal impact associated with this item. DISCUSSION Both the development of The District by Vestar and Columbus Square by Lennar reserved and constructed various lettered lots on the former site of the Tustin Marine Corps Air Station for street purposes. The proposed resolution would dedicate and accept this property for public street purposes as well as accepting the street improvements into the City's system of streets. The streets dedicated and accepted include Kensington Park Drive as well as portions of Tustin Ranch Road and Warner Avenue as described on Exhibit "A" and shown on Exhibit "B" of Resolution No. 13-16. Public Works/City Engineer Resolution No. 13-16 S:\City Council Items\2013 Council Items\Adopt Reso 13-16 Accepting Dedication of Specified Property in Tustin Legacy for Public Street Purposes and Accepting into City's System of Streets.docx RESOLUTION NO. 13-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE DEDICATION OF SPECIFIED PROPERTY FOR PUBLIC STREET PURPOSES AND ACCEPTING SPECIFIED STREETS INTO THE CITY'S SYSTEMS OF STREETS PURSUANT TO STREETS AND HIGHWAYS CODE SECTION 1806 WHEREAS, the City owns certain property reserved for public street purposes located on the former site of the Tustin Marine Corps Air Station as is described and depicted and attached hereto as Exhibits "A" and "B" (the "Property"); and WHEREAS, the City desires to formally accept the dedication of the Property for public street purposes; and WHEREAS, the street improvements to the Property have been completed to City standards and such streets are open to public use; and WHEREAS pursuant to Streets and Highways Code section 1806 the City desires to formally accept such streets into the City's system of streets. NOW THEREFORE, the City Council of the City of Tustin hereby resolves as follows: Section 1. The above recitals are true and correct. Section 2. The City Council finds it necessary and convenient that public streets be opened on and over certain property belonging to and situated in the City. Section 3. That the Property shown attached hereto as Exhibit "A" describing and Exhibit "B" depicting Kensington Park Drive and portions of Tustin Ranch Road and Warner Avenue is hereby dedicated and set apart for public street purposes. Section 4. That the streets shown on the map attached hereto as Exhibit "B", namely Kensington Park Drive and portions of Tustin Ranch Road and Warner Avenue be accepted into the City's system of streets and hereby designated by such names. 905234.1 PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, held on the _ day of 2013.
