HUSTON, CITY MANAGER PATR/CK SANCHEZ, DIRECTOR, PARKS AND RECREATION SERVICES HERITAGE PARK (PROJECT NO.400042) RESOLUTION NO. 99-80 ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF COMPLETION SUMMARy:): COm~On0f H~tage~Par.k':0hL°j~'.N0): 4.00042)is~'i:?~plete and the.'] '~0j'~'~S ~re~dy~..f0?~,'~t~i~'~ :~d th~ filing~ofthe N0ti~'0f COmpletion: :'-:' 1 RECOMMENDATION: That the City Council of the City of Tustin adopt Resolution No. 99-80 accepting said work as complete, authorize the recordation of the Notice of Completion and direct the City Clerk to: o Release the security deposit as per the escrow agreemem, pursuant to Section 22300 of the Public Contract Code, no sooner than thirty-five (35) days alter the date of the recordation of the Notice of Completion, and . Release the Faithful Performance Bond no sooner than one (1) year after the date of the recordation of the Notice of Completion.. FISCAL IMPACT: The final cost of the construction contract for the development and improvements to Heritage Park, including change orders,, was $1,498,850.71. Funding for construction of Heritage Park was provided through Park Development Funds and Capital Project Funds. BACKGROUND: The project was substantially complete on January 17, 1999. The CitY occupied the facility on October 31, 1998, at the end of the landscape maintenance period. The City is retaining $149,885.07, which will be disbursed no sooner than 35 days atter the date of recordation of the Notice of Completion. The Cky Council of the Cky of Tustin does hereby resolve as follows: WHEREAS, Valley Crest Landscape, having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to ttie City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acCeptance of said public work and improvement should be filed and payment of the balance due said contractor authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be accepted, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: HERITAGE PARK (Project No. 400042) PASSED AND ADOPTED by the City Council of the City of Tustin at a regular meeting held on the 20~ day of September, 1999.
