HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/REDEVELOPMENT AGENCY AUTHORIZATION TO APPLY FOR TRANSPORTATION ENHANCEMENT ACTIVITY (TEA) PROGRAM FUNDS. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 99-79 authorizing the nomination of the Tustin Streetscape Improvement Project for consideration by OCTA for funding as part of the TEA grant program, and authorize the Director of Public Works/City Engineer to act in connection with the nomination and to provide such additional information as may be required. FISCAL IMPACT There will be a fiscal impact realized from the cost of Tustin's share, or what is called the "match", of the total cost of the design and construction costs associated with the Old Town Streetscape Improvement Project. Of an estimated total design and construction cost of $456,785 Tustin's share has been identified to be $206,800. The TEA grant is estimated to be $249,985..At this time an appropriation is not being requested. However, it is anticipated that once the project is designed a large portion of funding for the project cost would come from the Ad Valorem Taxing District. BACKGROUND The Transportation Enhancement Activities (TEA) Program is a federal grant program, authorized for transportation related projects that enhance quality-of-life factors, such as bicycle and pedestrian facilities landscape, public art. The Orange County Transportation Authority is responsible for selecting regionally significant TEA projects in the County. Approximately $6.2 million will be programmed through this call for projects with a minimum local match requirement of twenty-five (25%) percent. OCTA does not anticipate issuing another call for projects until 2004. City Council Report OCTA TEA Program September 20, 1999 Page 2 A project within the TEA Program guidelines staff feels would be worthwhile to submit for funding would be the Old Town Streetscape Improvement Project. This project will provide for the design and construction of improvements to be constructed along E1 Camino Real from First Street to Sixth Street, and in two public alleys. The intent of the project is to design streetscape improvements and lighting to strengthen Old Town. The Old Town Streetscape Improvement Project incorporates and expands upon the Diagonal Parking project that staff has been working on for the past number of months. Any improvements would be designed so they could be installed in a phased manner at the discretion of the City. The scope of work for the project is as follows; · Conceptual/Schematic design of end islands to accommodate diagonal parking on E1 Camino Real; landscape and hardscape design of elemems within the end islands, and; streetscape amenities within the public right-of-way along E1 Camino'Real. · Preliminary and final design of end islands including curbs, gutters and drainage facilities. · Utility design and coordination to provide for installation (including phasing) of irrigation facilities for landscaping and lighting in the end islands. · Design and utility coordination of tree-well lighting for locations along both sides of E1 Camino Real within the project limits. · Landscape design in end islands and alleys. · Street lighting design of any additional pedestrian features in alleys. · Identification and evaluation of various landscape, streetscape amenities and lighting alternatives, recommendations, calculations, quantities and cost estimates. · Preparation of plans, specifications, and cost estimates. The Orange County Transportation Agency (OCTA) is responsible for coordinating the TEA Program. If Tustin's application is approved, the TEA Program grant will reimburse the City for certain costs associated with the design and construction of portions of the Old Town Streetscape Improvement Project. A condition of approval for participation in the TEA Program is a resolution that will designate certain individuals as authorized officials and authorize them to execute for and in behalf of the City of Tustin applications and documents for the purpose of obtaining financial assistance. Approval of the above-referenced resolution will potemially provide the City with reimbursement for approximately 45% of the design and construction costs associated with the streetscape improvement project proposed for Old Town. WHEREAS, the United States Congress in June 1998 enacted the Transportation Equity Act (TEA) for the 21 ~ Century, replacing the expired Intermodal Surface Transportation Efficiency Act of 1991 which makes funds available to the Orange County Transportation Authority (OCTA) for transportation enhancement activities; and WHEREAS, OCTA has established the procedures and criteria for reviewing nominations and applications for TEA funds; and WHEREAS, the City of Tustin possesses authority to nominate transportation enhancement activities for TEA funding and to finance, acquire, and construct the proposed project with matching funds. NOW, THEREFORE, BE IT RESOLVED o That the City of Tustin hereby authorizes the City Manager or Assistant City Manager to act as the official representative of the City of Tustin and to apply for the Transportation Enhancement Activities Program of the Tustin Old Town Streetscape Improvement Project. The City's representative is authorized to execute whatever documems are required to receive funds under the TEA program under the Transportation Equity Act for the 21 a Century for the Tustin Old Town Streetscape Improvement Project. 2. The City of Tustin will maintain and operate the property acquired, developed. rehabilitated, or restored for the life of the resultant facility(les) or activity. . With the approval of the California Department of Transportation (CalTrans) and OCTA, the City of Tustin or its successors in interest in the property may transfer the responsibility to maintain and operate the property. . The City of Tustin will give the CalTrans and OCTA representatives access to and the fight to examine all records, books, papers or documents related to the nominated transportation enhancement activity. . The City of Tustin will cause work on the project to be commenced within a reasonable time after receipt of notification funds have been approved and that the project will be carded to completion with reasonable diligence. 1 2 3 4 5 6 7 8 10~ 11 12 13 14 15 16 17 18 19 20 21 22 23 24 26 27 28 o The City of Tustin will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, the Secretary of Interior's Standards and Guidelines for Archeological and Historic Preservation, and any other applicable federal, state, and/or local laws, roles and/or regulations.
